SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated July 25, 2018 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued his recommendation dated October 22, 2018. Based upon the information provided on the LWRP Consistency Assessment Form, as well as the records available it is the coordinator's recommendation that the proposed action is INCONSISTENT with LWRP policy standards and therefore is INCONSISTENT with the LWRP, since the construction of an accessory building without a principle structure on a parcel is not supported by the Town Code or LWRP Policy Standards. PROPERTY FACTS/DESCRIPTION: The subject property is a conforming 1.37-acre parcel located in the R-40 Zoning District on Home Pike Road, in Mattituck, NY. The parcel is known as lots 6 & 7 of"Point Pleasant" subdivision map, filed in Suffolk County on May 7, 1917 as file# 720. The parcel has a road frontage on Home Pike of 102 feet; then running northeast for 412.03 feet to Mattituck Creek. There is a creek frontage of 219.47 feet along Mattituck Creek; then the property returns 392.07 feet southwest to Home Pike. There is an existing frame garage with wood deck on the property, along with a frame shed. The property shares a driveway with the adjoining property to the west. BASIS OF APPLICATION: Request for Use Variance under section 280-17A and the Building Inspector's May 16, 2018, Notice of Disapproval based on an application for a building permit to construct an accessory garage at; 1) garage does not constitute a permitted principle use on a residential parcel; at: 1175 Home Pike, Mattituck, NY. SCTM No. 1000-114-1-3.3. Page 2,November 15,2018 #7207,Raynor SCTM No. 1000-114-1-3.3 RELIEF REQUESTED: The applicant requests a use variance to construct a 672 sq. ft. accessory garage, where an accessory garage is not a permitted use without a primary use structure on the site, as depicted on survey prepared by Howard W. Young L.S., of Young and Young, dated June 8, 2018. ADDITIONAL INFORMATION: At the hearing the applicant testified that he resides in the house on the adjoining property owned by a family member. The existing frame garage on the subject property was built between 1935 and 1940, and is proposed to be demolished. There is currently a large supply of commercial fishing gear on the property used when the applicant ran a commercial fishing enterprise from the dock on the subject property. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on November 1,2018 at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: In granting a use variance, the Board of Appeals must examine three criteria; the record must show that (1) the land in question cannot yield a reasonable return if used only for a purpose allowed in that zone; (2) that the plight of the owner is due to unique circumstances and not to the general conditions in the neighborhood which may reflect the unreasonableness of the zoning ordinance itself; and (3) that the use to be authorized by the variance will not alter the essential character of the locality. Here,the applicant failed to establish that an examination of the criteria warranted granting of a use variance. The granting of a use variance requires a different, and in some aspects, a much higher standard be met than when applying for an area variance. Here however, even if the request was merely for an area variance, as set forth below,the applicant failed to meet the burden necessary to show entitlement to an area variance 1. Town Law 4267-b(3)(b)(1). Grant of the variance will produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The requested variance, if granted,will alter the essential character of the neighborhood by allowing an accessory use without a principle use(a dwelling) in a residential Zone District. Since the subject property is not unique or distinctly different from other residential lots, this would set a Town wide precedent for existing undeveloped properties in both the applicant's neighborhood, and the Town at large, by permitting garages, sheds, and other accessory structures to be built on vacant properties. 2. Town Law X267-b(3)(b)(2). The benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant can continue to use the existing accessory structures on the subject property, all of which pre-date zoning, until he is prepared to construct a principal dwelling on said property; or he can builds an accessory garage on the adjacent property in which he resides in a single family dwelling; or he can merge the subject property with the adjoining residential property. 3. Town Law&267-b(3)(b)(3). The variance requested herein is mathematically substantial;representing 100%relief from the code. 4. Town Law X267-b(3)(b)(4).No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. While the subject property is not visible from many other nearby properties and lies at the end of a private Right Of Way, if granted this variance could have far reaching adverse impacts on Page 3,November 15,2018 #7207, Raynor SCTM No. 1000-114-1-3.3 vacant properties throughout the Town by setting a precedent that would potentially allow accessory uses on vacant residential properties that are currently not permitted. 5. Town Law X267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased or inherited the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law &267-b. Grant of the requested relief IS NOT the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an accessory garage while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. If the applicant wants to pursue an accessory garage, the code allows it when there is an primary use or residence on the property.
