FINDINGS,DELIBERATIONS AND DETERMINATION I Southold Town Clerk MEETING OF NOVEMBER 15,2018 ZBA FILE# 7202 NAME OF APPLICANT: Paul Orlick PROPERTY LOCATION: 1300 Sound View Road, Orient,NY SCTM# 1000-15-3-23 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated July 6, 2018 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, pennit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION• The subject property is a non-conforming 12,500 square foot parcel located in an R-40 Zoning District. The property measures 100.00 feet fronting Sound View Road along the northerly property line, measures 125.00 feet along the westerly property line, measures 100.00 feet along the southerly property line, and 125.00 feet along the easterly property line. The property is improved with a two story house with an attached garage which is under construction. All is shown on a survey prepared by Nathan Taft Corwin III, LS, dated December 4, 2016 and last revised May 29, 2018. BASIS OF APPLICATION: Request for Variance(s) from Sections 280-124 and the Building Inspector's June 6, 2018 Notice of Disapproval based on an application for a building permit to construct an accessory in-ground swimming pool, at 1) proposed improvements more than the code permitted maximum lot coverage of 20 percent located at 1300 Sound View Road, Orient. SCTM# 1000-15-3-23. RELIEF REQUESTED: The applicant requests a variance to construct an in ground swimming pool that will result in lot coverage of 23.2 percent where code allows a 20% maximum. AMENDED RELIEF REQUESTED: During the hearing, the applicant was asked to bring the plan into more conformity with the code by reducing the proposed lot coverage. . On October 16, the applicant provided an updated survey dated October 16, 2018 prepared by Nathan Taft Corwin, L.S., depicting a 16 feet by 25 feet (400 sq. ft.) swimming pool with lot coverage totaling 22.3%. Page 2,November 15,2018 97202,Orlick SCTM No. 1000-15-3-23 ADDITIONAL INFORMATION: During the hearing the applicant was asked how large a pool could be built while still maintaining a code conforming lot coverage. The applicant testified that he could build a 9 x 8 foot pool. The applicant received building permit 442413 on February 26, 2018 to construct a single family dwelling, and a swimming pool was not contemplated at the time of issuance. At the hearing, the applicant was asked to provide information on variance relief granted by the Board for non-conforming lot coverage along Sound View Road and to consider ways he might reduce the degree of non-conformance being proposed for excessive lot coverage. The applicant asked the ZBA staff to assist with this research, and no prior comparable area variances in the applicant's neighborhood were found. After the completion of the dwelling, the survey shows that there would only be 107 square feet of allowed buildable lot coverage remaining. The Board received a letter from a neighbor expressing support for the application. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on October 4, 2018 and on November 1, 2018 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law &267-b(3)(b)(1). Grant of the variance as amended will produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood consists of single family homes of various sizes on lots similar in size to the applicant's, which properties meet the code conforming lot coverage. The applicant began construction on the home in February 2018 and the house under construction has conforming lot coverage of 19.1%, close to the maximum allowed, but in keeping with the character of the neighborhood. 2. Town Law X267-b(3)(b)(2). The benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant has reduced the proposed pool size, but can also make changes to the house currently under construction by making reductions that would allow for more lot coverage towards the installation of a swimming pool. 3. Town Law §267-b(3)(b)(3). The variance requested as amended is mathematically substantial, representing 11.5% relief from the code. 4. Town Law 4267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. The applicant had the opportunity to design a home and pool that would fit into the allowable lot coverage. 6. Town Law X267-b. Grant of the requested relief IS NOT the minimum action necessary to enable the applicant to enjoy the benefit of an accessory swimming pool while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. A variance is required from the construction standards Section 5-105 C-4,which states,"Sanitary systems shall be proposed-in the front yard." The applicant proposes to install the sewage disposal'syst=in the back yard. Section 5-105-C-6 of the Residential Construction Standards requires that the distance between sanitary ling pools and private wells be at least 150 feet. Tho applicant is proposing to install a new sewage disposal system to serve a single-family dwelling that does not conform to v, standards in that the leaching pools are less than 150 feet from the proposed on-site well. Section 406.4-3 of the Private Nater System Standards require#hat for lots that are exempt from the minimum lot size requiremen4 the distance between shallow private wells $rid sanitary leaching pools must be at least 100 feet and the well screen must be at least 40 feet below the water table. The applicant is proposing a well that does not conform to standards in that the well is less than 40 feet below the.water table. Section 406.44 of the Private water System Standards require that where the well screen is less than 40 feet below the water table, the distance between shallow private wells and sanitary leaching pools must be at least 150 feet. The subject parcel is located in Groundwater Management Zone 4, which requires a minimum lot size of 40,000 square feet when private well'are used r4 service residential dwellings. The lot size is 12,500 square feet. It is an exempt lot, and is shown as a separate lot on the 1981 tax map. 2• The existing parcel is undeveloped. 3. Test hole results show the following conditions: a. 0.010 0.5 feet—dark brown loam b. 0.5 to 17.0 feet—brown sandy silt with gravel c. 17.0 to 18.0 feet—water in brown sandy silt with gravel d, 18.0 to 28.0 feet—water in brown silt and silty sand with gravel e. 28.0 to 34.0 feet—water in brown fine sand(SP) 4. Basedon the test hole there are impervious materials located below groundwater. The test hole results indicate pale brown fine sand(SP)starting at 28 feet below grade, 5. The applicant is proposing to excavate down to the acceptable soils and'to backfill the excavation with acceptable sand. Due to the poor soil conditions,the applicant will have to use cutting rings to reach acceptable soils. 6. Grade elevation at the test hole was 23.9 feet above mean sea level (AMSL). Ground water was encountered at 5.9 feet AMSL. The proposed sanitary system has been designed for highest expected groundwater at 6.9 feet AMSL. 7• The applicant is proposing to install a 1,000-gallon septic tank and one 8-foot diameter by 12-foot deep leaching pool with one -expansion pool, Moot minimum above groundwater. The proposed system is designed for a residential dwelling with a maximum of 4 bedrooms. S. There are no public well fields within%utile. 9. The direction of groundwater flow is northerly towards Long Island Sound, as per the groundwater contributing areas and source water assessment maps prepared by Camp Dresser McKee in 2009, as part of the Comprehensive Water Resources Managemt Plan for Suffolk County. en 10. The subject parcel is also known as Lot 30 on the subdivision map of Orient by the Sea, Section 1,which was apprbved by the Department on September 9, 1957. Determination It was a 3 to 0 determination of the Board to grant the request for the variances for the well and sewage disposal system provided that the following conditions are met: ° Covenants and/or deeds shall be prepared and filed,in language acceptable to the County Attorney,establishing that. o The dwelling shall be limited to a maximum of foie•bedrooms. _ o The sapitary system to be constructed on the property does not comply with standards due to poor Soils and high grouadvs►atter conditions, will have limited accessibility due to the location in the rear yard, and that extensive costs may be incu red•in the future if repairs or replacement are necessary. • Notification shall be made to the removal and ]acetneut operation so that a representative can witness the soil peration as well as the sewage disposal system installation. • The property owner shall retain a licensed design professional to supervise and site excavation,b P certify the Wig,and installatign of the sanitary system. • The sanitary systetn shall be installed prior to construction of the dwelling. a • The expansion leaching pool.shall be installed at the time of construction of the sewage disposal system. • Any shoring required to accomplish the excavation to reach sand acceptable to the Department shall be designed and inspected by the licensed professional engineer. A licensed design professional will supervise the excavation and system installation, and future owners of the property will have notification that they may incur significant costs due to the location of the system in the rear yard with poor soils The WMting of the requested variances is not a formal approval to construct a dwelling, or to construct or.uttiize a new sewage disposal system on the subject parcel. Rather, it is a determination on the specific variances requested, based upon factors noted in §760-609 of.the Suffolk County 'Sanitary Code (Sanitary Code). In compliance with §760-609A(l)(a), the proposed variances are in general conformity with the Sanitary Code. The variances should not impair gnnundwater,surface water and drinking water supplies, and,as such,are consistent with criteria specified in 6760-609A(1)(b). The granting of the requested variances with the specified conditions will not adversely affect the design of an adequate on-site water supply and/or sewage disposal system,•taking into account soil conditions, depth to groundwater, and site-specific physical conditions,and as such,is consistent with criteria specified in§760-609A(1)(e). As per §760-609 of the Sanitary Code, the approval of the variances with the specified conditions is in harmony with the general purpose and intent•of the Sanitary Code to protect groundwater and drinking water supplies, surface water and other natural resources,and public health,safety and welfare.
