Voto of the Board: Ayos:- ~fussrs: Gillispie, Grigonis, Hulse. " " ~fo " ~..~ PUBLIC HEARING: Appeal No. 1729 - 8:]0 P.M. (E.S.T.), upon application of Patrick & Margaret Walsh, Mill Road, Peconic, New York, for a varianoe in accordance With the Zoning Ordinance, Article III, Section 301, for permission to divide property with insufficient area and frontage. Location of property: Lot #11, Map of Bailey Park, and Lot #9, Map of Blanche T. Dickinson, Peoonic, New York. Fee paid $15.00. /b+O - (.,7- ?-7 The Chairman opened the hearing by reading the application for a variance, legal notice of hearing, affidavit atte.sting to its publication in the official newspapers, and notice to the applioant. THE CHAIRMAN: The application is accompanied by a sketch indicating that applicant is the owner of Lot #9 (50' x 200l on Mill Road), and is also the owner of Lot #11 (50' x 140' plus on Fasbender Avenue). Lot #9 is contiguous to Lot #11. THE CHAIRMAN: Is there anyone present who wishes to speak for this application? \ !'lR. PATRICK WAISH: The on~ reason we want to dispose of this lot is that it is of no use to us. Mr. Clark and Mr. Davito own adjoining property and it is muoh more valuable to them. o o Southold Town Board of Appeals - 11 - March 8, 1973 MR. CLARK: We bought the property' from Mrs. Walsh's mother. (Mr. Clark & Mr. Davito discussed map With the Board) MRS. WALSH: the lot? THE CHAmMAN: accessory use. It requirement. THE CHAmMAN: Is there anyone present who wishes to speak against this application? Would there be anything aCainst our selling No. However, it could only be used as an is less than one-fifth of the present (There was no response.) After investigation and inspection the Board finds that applicant requests permission to divide property with insufficient area and frontage'. The findings of the Board are that this division will not increase the density of population and this transfer wiJJ facilitate access t.o and from t.he property of Mr. Clark and Mr. Davit.o. a joint ownership. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary' hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance will not change the character of the, neighborhood, and will observe the spirit of the Ordinance. On motion by Mr. Gillispie, seconded by' Hr. Grigonis, it was RES,OLVED, Patrick and Margaret Walsh be GHANTElJ permission to divide property with insufficient area and frontage on premises: Lot #11, Map of Bailey Park, and Lot 119, Map 'of Blanche T. Dickinson, Peconic, New York, ,and permission to sell Lot #11 to Mr. Clark and 11r. DeVito a transfer 0 oin ow n t on t at t s property s al not be used for resident.ial purposes. ,However, it may be used for accessory residAntiAl purposes to their existing lot.
