That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That this Permit is valid for a period of 24 months,which is considered to be the estimated time required to complete the work involved,but should circumstances warrant, request for an extension may be made to the Board at a later date. 3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved,to provide evidence to anyone concerned that authorization was originally obtained. 4. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation, the said Permittee will be required,upon due notice,to remove or alter this work project herein stated without expenses to the Town of Southold. 8. That the said Board will be notified by the Permittee of the completion of the work authorized. 9. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit, which may be subject to revoke upon failure to obtain same. 10. No right to trespass or interfere with riparian rights. This permit does not convey to the permittee any right to trespass upon the lands or interfere with the riparian rights of others in order to perform the permitted work nor does it authorize the impairment of any rights, title, or interest in real or personal property held or vested in a person not a party to the permit. Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards. 3. Move existing development and structures as far away from flooding and erosion hazards as practical. Maintaining existing development and structures in hazard areas may be warranted for.- a. oraa. structures which functionally require a location on the coast or in coastal waters. The as built structures are located in very close proximity to the top of bluff,.do not functionally require a location on the coast and are not water dependent. 5. Manage development in floodplains outside of coastal hazard areas so as to reduce adverse environmental effects, minimize the need for future structural flood protection measures, or expansion of existing protection measures and to meet federal flood insurance program standards. The area between the bulkheads is located in the VE (velocity hazard) Flood Zone. VE zones are defined as areas with special flood hazards associated with high-velocity waters generated by tidal surges and hurricane wave wash. Accessory structures located within these areas have the potential to suffer high rate of loss and pose hazards to life and property during storm surge events and should be minimized in area and placement. 6.3 Protect and restore tidal and freshwater wetlands. According to the information provided in a letter from the agency dated December 7, 2017, following an inspection conducted on December 6, 2017, the agency found that the bluff was in excellent and stable condition with vegetative cover, and the yard leading to the bluff top also in a well vegetated condition. No resource concerns involving runoff or erosion were apparent. Since the removal of the existing stairs and construction of new stairs will pose an erosion risk to the bluff face, care must be taken to minimize any disturbances to the bluff face to the greatest extent possible. Furthermore, it is critical that erosion control measures be implemented as quickly as-possible after construction. PROPERTY FACTS/DESCRIPTION: The property is a non-conforming 30,266 square foot parcel located in an R-40 zone. The parcel runs 99.68 feet of wood bulkhead along Little Peconic Bay. The property runs 100.94 feet along Nassau point Road, 185.60 feet on the North side, and 315.20 feet on the South side. The parcel is improved with a two story frame house, deck,2❑d floor deck, brick patio,wood stairs down bluff, stone steps and landing,and wood bulkhead. On May 1, 2018, the applicant submitted a site plan dated April 4, 2018 eliminating approximately 65 sq, ft, of proposed deck expansion and showing an attached deck at 24' 11" landward of the existing dwelling, per Trustee's recommendation, and reducing the size of the proposed wood landing. The non- conforming setbacks to the top of the bluff and distance of structures to the rear yard property line remain the same. Much of the existing attached decking and walkway improvements were done without the benefit of a building permit. The intent, by the applicant, is to legalize structures that were illegally built with non-conforming dimensional setbacks and to request variance relief to increase the non-conformities. Also at the hearing,the applicant's agent testified that several of the structures on the property had valid certificates of occupancy. However, the only certificate of occupancy on file, certificate of occupancy # Z11314 dated November 29, 1982 is for a private one family dwelling. Review of the Building Department's file shows that a site plan by Arthur G. Eppig, labeled A-1 and dated July 18, 1982 shows a deck +/- 17 feet from the top of the bluff. The site plan also shows a stair case going down the bluff to the beach. The submitted revised site plan shows the proposed re-constructed deck at a varying setback of approximately 15 to 17 feet from the top if the bluff FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on March 1,2018,April 5,2018 and May 3, 2018 at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law §267-b(3)(b)(1). The Nassau Point Road neighborhood'consists of single family water front homes. The bulkhead structure and retaining wall landward of the bulkhead and steps to the beach were constructed with Trustees approval to protect the bluff and the applicant's property and is a typical feature in this neighborhood (Board of Southold Town Trustees Permit No. E 111-15-82, dated 12-21-1992. The proposed wood landing is part of a staircase leading to the beach. Grant of the zero setback variance for a proposed wood platform/landing associated with proposed rebuilt steps along the bluff to the beach is greater than any bluff setback variance in the neighborhood and will produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. To protect the environment, structures should be set back from bluffs to the greatest extent practicable, per LWRP policy. 2. Town Law §267=b(3)(b)(2). The beneft'sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance for the rear yard setback to the proposed wood landing because it is necessary for the proposed staircase to the beach,which is characteristic to the waterfront area. The structure is in place with an approval from the Town to protect a naturally regulated feature and cannot be feasibly moved. The proposed zero foot bluff setback to a proposed wood platform can be achieved without a variance. The applicant can re-design the proposed staircase to the beach and/or use at grade pavers "as of right"to achieve the same goal. 3. Town Law §267-b(3)(b)(3). The variance granted herein for the rear yard setback is mathematically substantial,representing 73%relief from the code. However,a staircase to the beach has been in place without issue for many years, and the applicant is removing existing decking between the bulkhead and the retaining wall. The variance denied for the zero foot setback from the top of the bluff for a proposed wood platform/landing is substantial representing 100%relief from the code. 4. Town Law §267-b(3)(b)(4.). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and submit two copies of a storm water management and control plan for review and approval prior to the installation of any new drainage. Moreover,the applicant must maintain a non-turf buffer along the top of the bluff and obtain the Board of Trustees approval. 5. Town Law $267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a staircase to the beach with landing while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. Denial of the requested relief for the zero foot setback for the proposed wood platform/landing on top of the bluff is not the minimum action necessary and adequate to enable the applicant to enjoy the benefit of steps to the beach while preserving and protecting the character of the neighborhood and the health,safety and welfare of the community. Construct new stairway (173 SF) with two (2) 32 SF landings and one (1) 16SF landling (80 SF total). Revegetate 44SF of disturbed area. EXISTING BRICK-PATIO: Remove 223 SF of brick patio and replace with lawn EXISTING DECK OFF HOUSE WITH AS.-BUILT ADDITION A major portion of the deck off the main house was approved with the construction of the house in 1982.. The approved deck extended 19.8ft. from the house toward the (bluff and is 746.4 SF.. Sometime afterward, but'before,the present owner purchased in 2013, the Bleck was extended towair(:l the bluff by 5.2 ft., for a total deck of 805 SF.+/-. At some time thereafter, a 40 SF section of deck was added to the seaward side. This portion of the deck will be removed in accordance the Town Board of Trustees letter to the Zoning Board of Appeals. We propose to add 68 SF to Southern side of existing deck to provide ease of passage. In addition, the decking would be replaced on the main deck and the adjacent lower and upper decks north of the main deck and replace the access steps for both the main deck, and adjacent deck with added planting. EXISTING AS-BUILT LOWER DECKS/ BOARDWALKS/STORAGE BINS Between the bulkhead and retaining wall presently exists a series of two boardwalks connecting two decks with benches, concrete table storage bin, lighting fixtures as well,as a hose bib. We propose to relocate 19SF storage bin, remove 488SF of wood deck/ boardwalk, revegetate ;220 SF w/ ,Am. Beach grass, add 269 SF sand. Three (3) wood benches, one (1) 37 SF bench, one (1) concrete table, six (6) mounted path lights and (hose bib to remain. We propose to construct a 99 SF wood deck to connect the new proposed staircase to the existing wood steps to beach. PROPOSED MASONRY PAD The proposed pad would accommodate the placement of refuse containers and be ground level. PROPOSE=D GRADE: LEVEL STEPPING STONE PATH and MASONARY PAD The existing stepping stone path would be reconfigured to accommodate the proposed southern deck exparision with the new planting area and continue along the waterside of the deck along the new planting area to the proposed new platform. The proposed stepping path would comprise approx. 2'x 2' square stones set in crushed stone base with approx. 6" separations, seeded for grass boiiveen and surrounding. In addition, we propose 2'x4' stepping stones froirn northerly steps to connect to adjoining deck steps and proposed on grade 68 SF masonry pad 5 feet from top of bank. This pad would be at level grade at beginning of down slope to tie into a two step riser and small (12SF) landing to maintain required elevation above grade for DEC. 5. Construct new stairway (173 SF) with two (2) 32 SF landings and one (1) 16SF landing (80 SF total). Revegetate 44SF of disturbed area. EXISTING BRICK PATIO: Remove 223 SF of brick patio and replace with lawn EXISTING DECK OFF HOUSE WITH AS-BUILT ADDITION A major portion of the deck off the! main house was approved with the construction of the house in 1982. The approved deck extended 19.81"t, from the house toward the bluff and is 746.4 SF.. Sometime afterward, but before the present owner purchased in 2013, the deck was extended toward the bluff by 5.2 ft., for a total deck of 805 SF.+/-, At some time thereafter, a 40 SF section of deck was added to the seaward side. This portion of the deck will be removed in accordance the Town Board of Trustees letter to the Zoning Board of Appeals. We propose to add 68 SF= to Southern side of existing deck to provide ease of passage. In addition, the decking would be replaced on the main deck and the adjacent lower and upper deck:,, north of the main deck and replace the access steps for both the main deck, and adjacent deck with added planting, EXISTING AS-BUILT LOWER DECKS/ BOARDWALKS/STORAGE BINS Between the bulkhead and retaining wall presently exists a series of two boardwalks connecting two decks with benches, concrete table storage bin, lighting fixtures as well as a hose bib. We propose to relocate 19SF storage bin, remove 488SF of wood deck/ boardwalk, revegetate 220 SF w/ Am. Beach grass, add 269 SF sand. Three (3) wood benches, one (1) 37 SF bench, one (1) concrete table, six (6) mounted path lights and hose bib to remain. Vie propose to construct a 99 SF wood deck to connect the new proposed staircase to the existing wood steps to beach. PROPOSIED MASONRY PAD The proposed pad would accommodate the placement of refuse containers and be ground level. PROPOSED GRADE: LEVEL STEPPING STONE PATH and MASONARY PAD The existing stepping stone path would be reconfigured to accommodate the proposed southern deck expansion with the new planting area and continue along the waterside of the deck along the new planting area to the proposed new platform. The proposed stepping path would comprise approx. 2'x 2' square stones set in crushed stone base with approx. 6" separations, seeded for grass bei-ween and surrounding. In addition, we propose 2'x4' stepping stones from northerly steps to connect to adjoining deck steps and proposed on grade 68 SF masonry pad 5 feet from top of bank.
