TERMS AND CONDITIONS The Permittee Gregory&Nellie Ramsey,residing at 1160 Oakwood Drive, Southold, New York, as part of the consideration for the issuance of the Permit does understand and prescribe to the following: 1. That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will,at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto, to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved,to provide evidence to anyone concerned that authorization was originally obtained. 4. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation,the said Permittee will be required,upon due notice,to remove or alter this work project herein stated without expenses to the Town of Southold. 8. That the said Board will be notified by the Permittee of the completion of the work authorized. 9. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit,which may be subject to revoke upon failure to obtain same. 10. No right to trespass or interfere with riparian rights. This permit does not convey to the permittee any right to trespass upon the lands or interfere with the riparian rights of others in order to perform the permitted work nor does it authorize the impairment of any rights, title, or interest in real or personal property held or vested in a person not a party to the permit. Box 582 Bohemia, NY 11716 RE: GREGORY & NELLIE RAMSEY 1160 OAKWOOD DRIVE, SOUTHOLD SCTM# 1000-70-12-29 Dear Mr. Patanjo: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, October 17, 2018 regarding the above matter: WHEREAS, Jeffrey Patanjo on behalf of GREGORY & NELLIE RAMSEY applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated June 15, 2018, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator recommended that the proposed application be found Inconsistent with the LWRP, and, WHEREAS, the Board of Trustees has furthered Policies 6.3 & 9.3 of the Local Waterfront Revitalization Program to the greatest extent possible through the imposition of the following Best Management Practice requirements: the issuance of a permit for the structures; condition that float and boat do not impinge on the channel; and WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on October 17, 2018, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, 2 WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that for the mitigating factors and based upon the Best Management Practice requirement imposed above, the Board of Trustees deems the action to be Consistent with the Local Waterfront Revitalization Program pursuant to Chapter 268-5 of the Southold Town Code, and, RESOLVED, that the Board of Trustees APPROVE the application of GREGORY& NELLIE iRAMSEY remove existing storm damaged dock and replace with a proposed 4'x30' long fixed dock using thru-flow decking and supported with 8" diameter piles; install a proposed 30"x14' aluminum ramp; and install a proposed 6'x20' floating dock using un-treated decking situated in an "L" configuration and supported by four(4) 10" diameter piles & cross-braces; with the condition that the float and boat do not impinge on the channel; and as depicted on the site plan prepared by Jeffrey Patanjo dated September 18, 2018, and stamped approved on October 17, 2018. NEGATIVE DECLARATION OF ENVIRONMENTAL SIGNIFICANCE: WHEREAS, on October 15, 2018 the Southold Town Board of Trustees found the application of GREGORY & NELLIE RAMSEY to be classified as an Unlisted Action Negative Decision pursuant to SEQRA Rules and Regulations. A Short Environmental Assessment Form and a field inspection have been completed by the Board of Trustees and it is hereby determined that it will not have a significant effect on the environment, and; WHEREAS, the Southold Town Board of Trustees are familiar with this project having visited the site on September 9, 2018, and having considered Jeffrey Patanjo plans for this project dated June 10, 2018, revised on September 18, 2018, and a hydrographical Page 1 of 2 survey dated Noircinber 14, 2017 showing the water"::M:hs provided by Robert H. Fox, and; WHEREAS, in reviewing project plans dated September 18, 2018 and water depths dated November 14, 2017, it has been determined by the Board of Trustees that all - potentially significant environmental concerns have been addressed as noted herein: • Navigation: The proposed dock meets standards and does not extend beyond 1/3 across the water body. Depths for the dock terminus are within Town Trustees, New York State Department of Environmental Conservation and United States Army Corps. of Engineers guidelines and there is no recognized Federal/New York State/Town navigation channel in the immediate vicinity of the proposed structure. • Scope: The proposed dock is comparable to docks on neighboring properties in an area where docks historically are used for commercial and recreational purposes. • Toxicity: The proposed dock decking shall be constructed entirely of non-toxic materials. • Scope in relation to the riparian rights of shellfishers: The plan allows a standard ramp to float design that will not impede access for small vessels at low tide, and those seeking shellfish and crustacean on foot in season. • Scope in relation to the rights of small human powered water craft to navigate the waters adjacent to the proposed structures: At low tide a kayak might be able to paddle around this proposed structure as it projects only 40 feet beyond mean low water. • Scope in relation to view sheds: The seaward end of the proposed dock lies landward of all existing docks that frame the view shed. As such the perspective will not be discernibly different from the existing view. • Environmental upkeep: The dock design projects a usual lifespan of 30 years, and with limited pile replacement so as to minimize disturbance of the bottom. THEREFORE, according to the foregoing, the Southold Town Board of Trustees Approve and Authorize the preparation of a Notice of Negative Declaration pursuant to SEQRA for the aforementioned project. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is INCONSISTENT with LWRP Policy 6, specifically 6.3 (below) and therefore, INCONSISTENT with the LWRP. The following needs.to be,addressed. 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their-jurisdiction 1: Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. A Wetlands Permit for the existing dock was not found. § 275-11. Construction and operation standards. The applicant must demonstrate that the following dock standards pursuant to § 275-11. Construction and operation standards have been met. (d) Review and approval of dock applications. Before issuing a permit for a dock structure, the Trustees shall consider whether the dock will have any of the following harmful effects: W [2] Whether the dock will unduly interfere with the public use of waterways for swimming, boating, fishing, shellfishing, waterskiing and other water-dependant activities; The proposed dock is 64' and significantly longer than area docks. The application does not correctly show the dock line with proposed vessel or discuss the 1/3 rule. The dock also significantly extends further into public waters that area docks. [5] Whether the dock will cause degradation of surface water quality and natural resources; Water depths are extremely shallow in the area and may not be conducive to the operation of vessels capable of disturbing bottom sediments, increased turbidity and resulting in the injury to wildlife. [11] Whether the cumulative impacts of a residential and commercial dock will change the waterway or the environment and whether alternate design, construction, and location of the dock will minimize cumulative impacts; and The proposed 64' length of the residential dock will negatively affect the waterbody by setting precedent allowing a potential increased area in private structures over and in public waters. Public recreational uses (shellfishing, swimming, kayaking) will be impeded. The cumulative impacts from docks in the waterbody were not fully discussed. [12] Whether adequate facilities are available to boat owners and/or operators for fueling, discharge of waste and rubbish, electrical service and water service. This information was not discussed in the application. 9.3 Preserve the public interest in and use of lands and waters held in public trust by the state and the Town of Southold. A. Limit grants, leases, easements, permits or lesser interest in lands underwater in accordance with an assessment of potential adverse impacts of the proposed use, structure, or facility on public interest in public lands under water. The applicant enjoys access to public waters via a path/structure to this shallow water area. The seaward extension of the dock results in a net decrease of public access to underwater lands and waters.
