COMMENTS: ' 64L MI Date SI nature o Reviewer May 1, 2019 To Whom It May Concern, We own the property located at 2900 Beebe Drive in Cutchogue. For the past few months said property has been under construction. It has come to our attention that our back patio will be considerably smaller than we thought. Enclosed is 4 copy of our, newest survey for your review. We have highlighted the approved portion in yellow and the proposed portion in red. We are proposing to add an additional 132 square feet. We are replacing the cracked, unsafe area with Armortec pavers. We have tried, throughout this process, to be respectful of the environment and any impact our construction might have. We believe this minor addition to our patio will have no impact other than to make our pool area safer with a level surround. Our contractor, Bill Toth, would be happy to answer any concerns you might have. Box 1179 Southold, NY 11971 , 'f i OCT -- 4 2018 ' 1 Re: Mironov, 2900 Beebe Drive,Cutchog,ue Southold Town Dear Mr. Domino: -Board of Trust6es As discussed during the public hearing held on September 18, 2018, please find enclosed three (3) copies of a site plan prepared by Kenneth M. Woychuk Land Surveying, PLLC, last dated September 25, 2018, which has been revised to reflect the following modifications: 1) In response to the Board's request and pursuant to our discussion at the hearing, the proposed non-turf buffer has been expanded to 10 feet in width, wherein the 5 feet of buffer area situated closest to the top of bank will be planted with native vegetation. 2) Pursuant to the Board's request, a pool drywell is proposed to the south of the pool equipment. 3) Pursuant to the Board's request, a note has been added to the drainage calculations indicating that the outdoor shower drainage will be plumbed to the proposed drywell system. With respect to the proposed sanitary system, the Board's recommendation that an innovative/alternative system be installed has been noted. However, the proposed sanitary system is located beyond Chapter 275 jurisdiction; and pursuant to §275-4(A)(1)(k), "the relocation of an existing septic system from within Trustee jurisdiction to outside of Trustee jurisdiction" is an activity exempt from requiring a wetland permit. Therefore, whatever septic system is ultimately installed by the applicants would not be part of the Trustees approval. Should the Board require any additional information in support of our application, please let us know prior to the date of the next public hearing so that it can be provided prior to the hearing. The as built structure 16'x32' pool (to remain) is recommended as INCONSISTENT based upon the following: 6.3 Protect and restore tidal and freshwater wetlands. A. Comply with statutory and regulatory requirements of the Southold Town Board of Trustees laws and regulations for all Andros Patent and other lands under their jurisdiction 1. Comply with Trustee regulations and recommendations as set forth in Trustee permit conditions. According to Town records, the structures or portions thereof were constructed without obtaining Board of Trustee review and a regulatory permit. The following is recommended to further Policy 6.3. I. The setback to the pool is not depicted. Clarify the setbacks. ii. Verify pool de-watering dry well and outdoor shower drainage. ill. Due to proximity to surface waters, consider requiring an Innovative/Alternative Sanitary System. iv. Require that the on-site trees adjacent to the waterbody remain. Pursuant to Chapter 268, the Board'of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. Please be advised that the location of the proposed pool fence has been modified to coincide with the landward limit of the proposed non-turf buffer rather than with the 10' elevation contour,as previously depicted. As a result, the small triangular section of pool patio will not need to be removed but will be replaced(in-place)along with the rest of the pool patio. Other design changes have been made outside Chapter 275 jurisdiction, including the relocation of the proposed detached garage to a 10' setback from the side lot line. All changes are reflected on a site plan prepared by Kenneth M. Woychuk Land Surveying, PLLC, last dated September 7,2018,three(3)copies of which are attached hereto. As a result, the project description should be revised as follows, with the only changes highlighted in red: On west/waterside of existing 1.5-story dwelling, construct a new 13.7' x 15.3' sunroom in place of existing sunroom over and within footprint of existing deck to remain, replace decking on existing 84 sf uncovered deck to J remain, reconstruct +2.8' x 4' steps off deck, remove existing fence and install new 4' high pool enclosure fencing, , and remove and replace (in-place) existing 534 sf on-grade masonry pool patio around existing pool(to remain); on south side of dwelling, construct 18'x 20'addition to on- `1 grade masonry pool patio, construct 3.4'x 5'landing and steps, and install 4'x 8'outdoor shower and new pool equipment; on north side of dwelling, construct an 11'x 24.2'2nd floor dormer addition; on east/landward side 4 of dwelling, construct an 8'x 14.5'1-story addition, a 4'x 13.6'l-story addition in place of existing porch, and a new 4'x 13.6'porch with steps; reconstruct and modify approximately 709 sf of existing dwelling roof; install a drainage system of leaders, gutters, and drywells; install approximately 1,035 sf portion of asphalt driveway with catch basins within Chapter 275 jurisdiction; and establish a 5'wide non-turf buffer to be planted with native vegetation in place of existing lawn adjacent to the top of bank, all as depicted on the site plan prepared by Kenneth M. Statement of the effect, if any, on the wetlands and tidal waters of the town that may result by reason of such proposed operations (use attachments if appropriate): See Attached WETLANDS ADDENDUM FOR MATTHEW MIRONOV& BARBARA LICHTENBERG-MIRONOV 2900 BEEBE DRIVE CUTCHOGUE,NY SCTM#1000-103-3-15 Wetlands Statement of Effect The project will have minimal impact on the existing structural footprint and lot coverage over the portion of the property situated within 100 feet of the top of the bank, i.e., the Chapter 275 jurisdictional area. Specifically, the proposed sunroom will be constructed in place of an existing sunroom and within the footprint of the existing portion of deck beneath it, which is to be removed. The remaining portion of deck will be replaced in- place; and the on-grade masonry swimming pool patio will be replaced in-place except for the addition of 360 sf of new patio on the landward side of the existing pool. This additional patio surface will be partially offset by the removal of the most seaward 26 sf of existing patio, which will increase the wetland setback to the patio. Except for the installation of a stoop and outdoor shower over the proposed patio extension, the balance of the proposed additions and alteration to the existing dwelling will occur over(dormer and roof replacement) or on the landward side (new porch and 1-story additions) of the existing dwelling. Therefore, there will be no additional encroachment on the top of bank or adjacent tidal wetlands/waters; there will be no increase in Town-defined lot coverage on the waterside of the dwelling; and the existing minimum wetland setback will be increased. Nevertheless, additional mitigation measures have been included in the project design to offset any potential impacts of the proposed construction activities and improve existing site conditions to create a net environmental benefit upon project completion. For example, a drainage system of leaders, gutters, and drywells will be installed to capture and recharge roof runoff and potential runoff from the outdoor shower; and although a portion of the proposed impervious driveway will be located within Chapter 275 jurisdiction, it too will be equipped with catch basins to control associated runoff. A 5' wide nonturf buffer to be planted with native vegetation in place of existing lawn will be established adjacent to the top of bank, which can serve both as a sink and filter for stormwater runoff and contaminants. By thus reducing the lawn area and increasing its setback from wetlands, the quantity of runoff reaching the bank should be decreased, and the quality of runoff will be improved through a reduced concentration of potential fertilizers, pesticides, and insecticides. And temporary runoff and disturbance during construction will be contained with a project-limiting fence. Additionally, outside Chapter 275 jurisdiction, a proposed upgraded sanitary system will provide benefits to groundwater and ultimately surface water quality through the improved treatment of septic waste. Therefore, the project will alter the existing developed condition of the property within Chapter 275 jurisdiction only minimally and will have a beneficial effect on the environmental conditions of the site and thus the adjacent wetlands and Town waters. 617.20 Appendix B Short Environmental Assessment Form Instructions for Completing Part I-Project Information. The applicant or project sponsor is responsible for the completion of Part 1.Responses become part of the application for approval or funding, are subject to public review, and may be subject to further verification. See LWRP Section III - Policies Pages 16 through 21 for evaluation criteria ®Yes ❑ No ❑ Not Applicable In association with the proposed additions and alterations,a drainage system of leaders, gutters, and drywells is proposed to collect roof ninoff and potential runoff from the outdoor shower Catch basins are proposed to control potential runoff associated with the proposed impervious driveway Temporary runoff and disturbance during construction will be contained with a project-limiting fence. By also reducing lawn areas and increasing the setback of lawn areas from wetlands by establishing a 5'wide nonturf buffer adjacent to the top of bank, which can serve both as a sink and filter for stormwater runoff and contaminants, the quantity of runoff reaching the adjacent tidal waters will be decreased and the quality of runoff will be improved through a reduced concentration of potential fertilizers, pesticides, and insecticides Additionally, groundwater and ultimately surface water quality will benefit from the installation of a new, upgraded Suffolk County Department of Health Services-conforming sanitary system located outside Chapter 275 junsdretion Therefore, consistent with Policy 5,water quality and supply will be both protected and improved as a result of the mitigation measures associated with the project Attach additional sheets if necessary Policy 6. Protect and restore the quality and function of the Town of Southold ecosystems including Significant Coastal Fish and Wildlife Habitats and wetlands. See LWRP Section III - Policies; Pages 22 through 32 for evaluation criteria. ® Yes ❑ No ❑ Not Applicable LWRP CONSISTENCY ASSESSMENT FORM ADDENDUM FOR MATTHEW MIRONOV& BARBARA LICHTENBERG-MIRONOV 2900 BEEBE DRIVE CUTCHOGUE, NY SCTM#1000-103-3-15 Policy 6 Consistent with Policy 6, the project will contribute to the protection and restoration of the adjacent bank and tidal wetland ecosystem. The project will have minimal impact on the existing structural footprint and lot coverage over the portion of the property situated within 100 feet of the top of the bank, i.e., the Chapter 275 jurisdictional area. Specifically, the proposed sunroom will be constructed in place of an existing sunroom and within the footprint of the existing portion of deck beneath it, which is to be removed. The remaining portion of deck will be replaced in-place; and the on-grade masonry swimming pool patio will be replaced in-place except for the addition of 360 sf of new patio on the landward side of the existing pool. For example, a drainage system of leaders, gutters, and drywells will be installed to capture and recharge roof runoff and backwash from the outdoor shower; and although a portion of the proposed impervious driveway will be located within Chapter 275 jurisdiction, it too will be equipped with catch basins to control associated runoff. A 5' wide nonturf buffer to be planted with native vegetation in place of existing lawn will be established adjacent to the top of bank, which can serve both as a sink and filter for stormwater runoff and contaminants. And temporary runoff and disturbance during construction will be contained with a project-limiting fence. Additionally, outside Chapter 275 jurisdiction, a proposed upgraded sanitary system will provide benefits to groundwater and ultimately surface water quality through the improved treatment of septic waste. Therefore, the project will alter the existing developed condition of the property within Chapter 275 jurisdiction only minimally and will have a beneficial effect on the environmental conditions of the site and thus the adjacent bank and wetland ecosystem. Based on elevation, all proposed additions and alterations are located landward of the tidal wetland jurisdiction of the New York State Department of Environmental Conservation. See attached.
