Location of premises: south side of ~ple Avenue (Private Road) off east side of Grand Avenue, Mattituck; bounded north by Maple Avenue; east by M. Smith; south by Long Creek; west by M. & P. Surer. Fee paid $15.00. 2. VARIANCE. By resolution o! the Board it was determined that (a) Strict application of the Ordinance (would) (would not) produce practical di/ficulties hardship because (b) The hardship created (is) (is not) unique and (would) (woul'd not) be shared by all properties alike in the immediate vicinity of this property and in the same use distriel because ~ RRVER/~E ~ (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) change the character of the district because (would not) and therefore, it was further determined that the requested variance ( ) be .Sranted ( ) be denied and that the previous decisions of the Building Inspector ( ) be confirmed ( ) be reversed. FORM ZB4 After investigation and inspection the Board finds that applicant requests permission to maintain an accessory building in front yard area and with insufficient side yard on the south side of Maple Avenue (Private Read) off the east side of Grand Avenue, Mattltuck, New York. The findings of the Board are that applicant applied for a two car garage, 22' x 30~ in size. The garage was to be attached to the one story frame house. However, the garage has not been attached but is adjacent to and very close to the easterly llne of appltcantts property (2 feet off the line.). The Board also finds that part of the blacktop driveway extends over the llne to the east, and appears to be about ~ feet over the II ne. The Board finds that strict application of the Ordinance would not produce practical diffic~lties or unnecessary hardship; the hardship created is not unique and ~o~ld be~ shared by all prop-erties alike in the immediate vicinity' of this property and in the same use district; and the variance will change the . character of the neighborhood, and will not observe the spirt~ of the Ordinance. THEREFORE BE IT RESOLVED, 0conee Construction Corp., 67 W~st Main Street, East Islip, New York,- a/c Dr. Carlos Tejo, be DENIED per- mission to maintain accessory building in front yard area and with insufficient side yards on premises located on the south side of Maple Avenue (Private Road)off east side of Grand Avenue, ~ttituck, New York, as applied for. It is the decision of the Board that the garage must be moved to conform with the original building application, and that the blacktop m~st be moved from the adjoining property to the east. The garage, after being attached to the house, shall be no closer than fortynine (49~) feet to the front yard property line, and at least ten (10T) feet from the property line to the east, as originally projected. The Southold Town Board of &ppeals sets a sixty (60) day period from todayts date, March 8, 1973, in which the applicant shall conform with the original building application.
