After investiga~o~ and inspection the Board finds that
applicant requests permission to alter existing building to
a two family occupancy off the north side of Main Road, Orient,
New York. The findings of the Board are that applicant hopes
to add a small apartment over the garage/hobby area space con-
sisting of two bedrooms, a bath and living room, all of which
will be an integral part of the existing structure and which
will use all the facilities of the main house. The small
apartment will be used by Mrs. Stephensonts mother. The
applicant is the owner of 5 acres of property.
The Board finds that the public convenience and welfare
and justice will be served and the legally established or
permitted use of neighborhood property and adjoining use
districts will not be permanently or substantially injured
an~ the spirit of the Ordinance w~l ~ obs~e.rved.
THEREFORE IT WAS RESOLVED, Donald A. Stephens.n, Main
Road, Orient, New York, be GRANTED permission to alter ~xisting
building to a 2 (two) family occupancy, located off the north
side of Main Road, Orient, New York, as applied for, subject
to .the following conditions:
1. That applicant obtain a new survey from Van
which sets off 80,000 sq. ft. using the northerly
boundary and extending 80,000 sq. ft. to the west
and southwest.
This permission is subject to applicant's obtaining
clear title to land, free of rights of way, to
property to be used for new construction.
3. This permission is subject to site plan approval
of the Planning Board.

SUBSECTION
THE SPECIAL EXCEPTION IS REQUESTED BECAUSE
~rs. Stephenson and I are moving to Orient s~d making our Orient
home i~to a year round residence~-~aere we intend to reside permanently.
~e have no garage and no dry~ ground level~ area for my hobby of
woodworking and ~rs. Stephenson's aft and design layout.. We hope to add m
small apartment over the garage/hobby area space consisting of two bedrooms~
a bath and li%~ing room~ all of which will be an integral part of the existing
structure and which will use all the facilities of the main house.
The need for this small apartment is for-~irs. Stephenson's mother~
~rs Loraine Ec~eekin~ who cannot be left completely alone~ but is fully
capable of taking care of herself and desires this responsible independence~
including the preparation of some of her o~m simple meals in a utility
kitchen.
I~ therefore request your consideration of this petition to
include utility cooking facilities in the proposed apartment.
A proper survey of the property now being prepared by
Roderick P.C~ Van Tuyl will be submitted in connection with this
application upon completion of such survey.

Dear Mr. Goehringer:
In connection with the above matter, could you please clarify to the undersigned the
determination of the Board of Appeals. It is my understanding that the board granted
permission to alter existing building to a 2 (two) family occupancy to which Certificate of
Occupancy #7038Z dated December 18, 1973 for an addition (Apt.) has been issued.
At the time of the application for the apartment, applicants step-mother's mother for
whom the apartment was originally created was approximately 80 years of age. She
required 24 hour (around the clock) care and was unable to readily move from the
apartment to other parts of the house for food or other living requirements. For this
reason, separate maintenance was needed. In accordance with that decision, Certificate of
Occupancy was granted for a 2 (two) family occupancy. No substitute changes, I am told,
have been made. It is to be remembered Mr. Gillispie, Chairman of the Zoning Board was
a neighbor. I am sure he knew the parties and their needs. That elderly lady lived in the
apartment into her 90's.

a first cousin of the applicant. I have no financial
interest whatsoever but aside from guiding the discussion

MR. STEPHENSON: The only thing it is useful for is to
walk down to the beach.
TH~ CHAIRMAN: Does Horace Terry have access to this
property?
MR. STEPHENSON: Not at that point. He comes up the
west drive and cuts across down towards his b~rn and garage.
TH~ CHAIRMAN: He owns the house on the bluff.
MR. STEP?2~NSON: The building would be 3°' or 40' from
where he now drives.
THE CHAIRMAN: The tennis court doesn't show on the
survey but it is southeast of the Rose area. It is my under-
standing that driveways and tennis courts and barns finally
descended to Beverly Lomas. She is presently the owner of the
east driveway, the one that goes around your house. Your
property is on both sides of this driveway and also on both
sides of the other driveway running around to the west. This
property dow~ here (referring to survey) non belongs to
Scofield and they have the right to use the driveway. It's
common property. It belongs to four properties on the premises.
It would not be proper for this Board to grant permission for
an addition if it would be ~n obstruction on a driveway that
someone else ow~s; even if they do not own it but use it. It
would be my suggestion that you obtain releases from these
people for that portion of the driveway, or maybe they will
sign off.
MR. STSDPHENSON: I need the garage sl~d the new dwelling.
The house is six steps up. It's six steps down and six steps
up to the new aps_rtment. I don't see s~ny other way to do it.
TH~ CHAIRMA~N: The only other way to do it would be to
use some porch area. You decide how you ws~ut to do it. We
would consider it favorably but you would have to set off
80,000 sq..ft.
MR. STEPHENSON: I have five acres.
THE CHAIRMAN: I understand that you own this property
between the private road on the west and the seawall and
running down to the summer ~ouse plus the beach. What we can
do is to approve it subject to the applicant se=ting off
$0,000 sq. ft. Have you got any way of obtaining this
80,000 sq. ft.?

T}{E CHAIRMAN: Is there anyone present who wishes to
speak against this application?
After investigation and inspection the Board finds that
applicant requests permission to alter existing building to
a two family occupancy off the north side of Main Road,
Orient, New York. The findings of the Board are that
applicant hopes to add a small apartmen= over the garage/
hobby area space consisting of two bedrooms, a bath and
living room, all of which will be an in=egral part of the
existin~ structure and which will use all the facilities
of the main house. The small apartment will be used by Mrs.
Stephenson's mother. The applicant is The 'owner of five acres
of property.
The Board finds that the public convenience and welfare
and justice.will be served and the legally established or
permitted use of neighborhood property and adjoining use
distric=s will not be permanently or substantially injured
and the spirit of the Ordinance will be observed.
On motion by Mr. Hulse, seconded by Mr. Grigonis, it was
RESOLVED, Donald A. Stephenson, Main Road, Orient, New
York, be GRANTED permission to alter existing building to a
2 (two) family occupancy, located off the north side of Main
Road, Orient, New York, as applied for, subject to the follow-
ing conditions:
