Location of property: Lots #'95 and 96, Gardiners Bay Estates, Dogwood Lane, East Marion, New York. Fee paid $15.00. 2. VARIANCE. By resolution of the Board it was determined that (a) Strict application of the Ordinance (would) (would not) produce hardship because SEE REVERSE practical difficulties or (b) The hardship created (is) (is not) umque and (would) (would not) be shared by all properties alike in the immediate vicinity of this property and in the same use district because SEE REVERSE (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) change the character of the district because (would not) SEE REVERSE and therefore, it was further determined that the requested variance ( ) be granted ( ) be denied and that the previous decisions of the Building Inspector ( ) be confirmed ( ) be reversed. SEE REVERSE / 7 C~air~]~'B~raof A~al~ ~rjor~ McDermott, Secretary After investigation and inspection the Board finds that applicant requests permission to build an addition with reduced side yard on Lots # 9~ and # 96, Gardiners Bay Estates, East Marion. The findings of the Board are that t~e addition will be added to the ne~th side of William Serrell's house and will be 28 feet in width and 26 feet in depth. The Board agrees with the reasoning of the applicant. The Board finds that strict application of the Ordinance would produce practical difficulties or ~nnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance will not change the character of the neighborhood, and will observe thespirit of the Ordinance. THEREFORE IT WAS RESOLVED, William Serrell, Dogwood Lane, Gar~iners Bay Estates, East MArion, New York, be GRANTED permission to build an addition with reduced side yard, as applied for, subjec$ tothe following conditions: T4at the addition shall be no closer than 7 feet to the northerly side yard.
