The findings of the Board are that the entire property has been used for business except for a small portion which has been used for a residence. The Board, further, finds that, in effect, this division of property will not change the activities of the Body Shop presently occupying the westerly portion of the property. The Board agrees with the reasoning of the applicant. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance will not change the character of the neighborhood, and will observe the spirit of the Ordinance. THEREFORE IT WAS RESOLVED, George A. and Helen H. McCarthy, be GRANTED permission to divide property with less than required area and frontage on premises located on the west side of Bay Avenue, Mattituck, New York, as applied for. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unneces- sary HARDSHIP because although the entire parcel is designated Business, only part of the premises have been used for h~siness purposes and part occupied by a one-family dwelling. The remaining pmrt has been unoccupied most of the time. If variance i~ granted the entire parcel will conform to its designated use. 2. The ha~ship createdis UNIQUE and is notshared by aH properties clike in the immediate vicinity ofthis property and in this use district because i¢ is occupied by a one- family dwelling-which is not in conformity with its designated use, The purchase~ intend to replace this dwelling with a modern professional structure with adequate off street parking facilities which will be an improvement to the Community. 3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because for the past 20 years the premises have been physically separated.
