I am one of the applicants for a Pre-existing Certificate of
Occupancy on premises owned by Bente F. Snellenburg located
on Private Road (Old Wood Path) east side of South Harbor
Road, Southold.

Premises are 1.25+ acres improved with a 2 1/2 story brown
shingle residence a garage and two sheds, all enclosed by
a split rail fence.
Premises were acquired by deponent and wife in the fall of
1962; we have resided there for 23 years last past. Except
for the enclosure of 3 porches, the residence is in the same
condition, exterior size and location as shown on the annexed
Survey dated 10/14/6~ Traveled road shown on such survey
is no longer in existence.
I had been advised that the residence was erected around 1916
by George W. Smith, Builder, as a summer cottage for the
Williams family who then resided on Main Road, Southold.
Property was conveyed by Margery Williams Terry (Mrs. Israel
P. Terry) to Ernest D. Story and wife around 1955. It was
renovated and occupied as a year round residence by them
from 1955 to 1962 when I purchased same.

I, Joseph J. Snellenburg, II, being duly sworn, deposes and
says:
1. I am one of the applicants, with my wife, Bente F.
Snellenburg, for amendment of a Pre-Existing Certificate of
Occupancy, Pre C.O. #Z13532 dated June 18, 1985, and wr~te this
affidavit supplemental to my affidavit dated May 22, 1985.
2. The porches shown on the survey dated October 14, 1960
were enclosed subsequent to our acquisition of the premises in
the Fall of 1962. The new porch (north side) is an entrance
hall. The front porch (south side) is part of the living room
and a connecting hall between the living room and east room den.
3. The rear porch (south), under an existing roof, was
enclosed immediately after our acquisition of the premises in
1962, i.e., the Fall-Winter of 1962-1963. The front porch
(south), under an existing roof was enclosed in 1968. No
additions or changes in the size or perimeters of the building
were involved.
4. Howard Terry, then Building Inspector, advised deponent
that no building permit pursuant to Section 703 of the Zoning
Ordinance of the Town of Southold were required. A reading of
Section 703, effective April 9, 1957, amended June 7, 1965 and
May 24, 1966 confirmed the foregoing advice.
5. Prior to the re-enactment and renumbering of the Zoning
Ordinance on November 23, 1971, renumbering Section 703 as
Section 1501 (present Section 100-141) and changing the language
to possibly encompass the enclosure of existing porches, no
building permit was required for such alterations.
6. Deponent requests that the Pre-existing Certificate,
#Z13532, issued June 18, 1985, be amended to reflect the present
condition of the residence building, i.e., tjb~t--~the porches have

tion required to prepare a certificate.
