Arnoff, Esq., submitted a Lot Line Modification Application for consideration; and WHEREAS, on February 14, 2011, the Planning Board accepted the application for formal review with revisions; and WHEREAS, on March 3, 2011, the applicant submitted revised maps as requested by the Planning Board; and WHEREAS, on May 18, 2011, referrals were sent out to all applicable agencies; and WHEREAS, on May 23, 2011, the Planning Board reviewed the revised maps; and Droskoski & Sepenoski Page Two August 9, 2011 WHEREAS, on June 13, 2011, the Southold Town Planning Board set a public hearing regarding the map dated February 2, 2010 and last revised on January 14, 2011; and WHEREAS, on June 29, 2011, referral comments were received from the Board of Fire Commissioners which stated, they did not find any issue with the plan, however, they do request to allow a minimum of a 15' wide right-of-way for fire department equipment; and WHEREAS, on July 7, 2011, referral comments were received from the Suffolk County Department of Planning and they were addressed; and WHEREAS, on July 11, 2011, a public hearing on this application was held and closed by the Planning Board; and WHEREAS, on August 8, 2011, the Planning Board made a determination of non- significance; and WHEREAS, the Southold Town Planning Board, pursuant to Town Code §240-56, Waivers of Certain Provisions, may waive certain elements of the subdivision review if in its judgment they are not requisite in the interest of the public health, safety and general welfare. After reviewing the information submitted for this application, the Planning Board has determined that it is eligible for a waiver of the ERSAP, the Primary and Secondary Conservation Area Plan, and the Sketch Plan and Preliminary Plat steps of the subdivision process for the following reasons: 1. That conditional approval required Mr. Droskoski to obtain Suffolk County Department of Health Services approval. Unfortunately, we were advised by Suffolk County Department of Health that in order to get this approval, one Would also need to be obtained for previous modifications of the effected properties. Two of the three properties effected by this lot line modification are not owned or controlled by Mr. Droskoski. The other parties concerned were uncooperative, As such, we were forced to engage in lengthy discussions with the Department of Health as to how ince would proceed under the circumstances. We believe that we have worked out with the Department of Health how Mr. Droskoski can obtained approval for this modification without getting the approval for previous modifications on the other properties concerned not under his control. in order to do that, we're forced to obtain new surveys of the properties. However, Mrs. Sepenoski cannot consent to a lot,line change that does not contain assurances that the change is agreeable to the Suffolk County Dept. of Health Services. When an application for construction is made to the SCDHS, they will look at the 1981 tax map or any more recent approvals such as a subdivision they have approved. If there is any variation in the lot lines, they will not proceed until the realty subdivision process has been completed. Unfortunately we have encountered this problem many times. This was a particular problem for subdivisions approved by the Town of Southold in the 1980's before the Health Dept. approval was made a condition of the Town subdivision. Article 6 of the County Code came into effect in 1981, and since the Town continued thereafter to process their subdivisions without regard to it, as it was a new Code and apparently no one realized the issue, there were quite a number of subdivisions and lot line changes that were approved by the Town on which the County approval was not sought and one by one'they are getting"caught" in the discrepancy as applications come into the County on those parcels. The 1980's was a boom time for development so it happened with some significance. 8/17/2011 Page 2 of 2 While Mrs. Sepenoski sold the development rights to most of the farm to the Town of Southold, she retained the right to full rights on a two acre portion of the property. She also has the right, subject to the appropriate Land Preservation approvals, to build ag structures on the development rights. She will not get through the Health Dept. approval process without a realty subdivision application, and I cannot allow her to change this lot line now unless the Health Dept. matter is addressed. I will speak to the applicant's attorney on this matter'as well.
