Oliva, Councilwoman Ellen M. Latson, Councilman Thomas H. Wickham, Town Attorney Harvey A. Arnoff (10:30 A.M.), Assistant Town Attorney Matthew G. Kiernan, Town Clerk Judith T. Terry. Absent: Justice Raymond W. Edwards (ill). 9:50 A.M. The Board discussed the 1991 resolutions reported by the Resoluton's Committee of the Association of Towns of the State of New York. Supervisor Harris, as the Town's official delegate, or Justice Edwards, as the alternate, will be voting on behalf of the Town of Southold at the Association of Towns conference being held in New York City on February 17, 18, 19, 20. All Board members agreed on a "yes' vote on the eleven proposed resolutions, with suggested changes to resolution number one by Councilman Wickham. 10:05 A.M. - Thomas Wowak met with the Board to request the approval of a trailer permit for a trailer to house two seasonal workers from May through October at his property on the north side of Main Road, Laurel (granted-see resolution no. 12). 10:30 A.M. - Unsafe Building public hearing with respect to the property of Frank and Sandra Cielatka, Middle Road, Cutchocjue, which was conducted by Town Attorney Arnoff, with Ordinance Inspector Wieczorek testifying as to what action he has take ---~with respect to this problem. .1:00 A.M. - Police Chief Droskoski, Public Safety Dispatcher Raynor, and three - representatives of NYNEX/New York Telephone - Mr. Ali Jermad, Don King, and Bill Hadel, met with the Town Board to discuss their recommendation for upgrading the existing communications system at Police Headquarters. Currently there are only three lines into headquarters, causing a severe communications handicap. The proposal calls for an 18 line Intellipath II Network to provide long term rate stability, central office flexibility with growth features. A resolution (no. 13) was placed on the agenda to implement the program. ~ EXECUTIVE SESSION 11:45 A.M. - Moved by Supervisor Harris, seconded by Councilman Penny, it was Resolved to enter into Executive Session. Vote of the Board: Ayes: Supervisor Harris, Councilman Penny, Councilwoman Oliva, Councilwoman Latson, Cour~cilman Wickham. Also present: Town Attorney Arnoff, Assistant Town Attorney Kiernan, Town Clerk Terry, Chief Droskoski, Public Safety Dispatcher Raynor.---The Board discussed Police and security matters. After Chief Droskoski and Public Safety Dispatcher Raynor let the room the board discussed personnel matters. ' 11:55 A.M. - Riverhead Town Councilman Victor Prusnowski met with the Board to ~xplore the possibility of utilizing Southold Town's landfill building as a transfer __,~tation by the Towns of Riverhead, Shelter Island and Southold, if the building is deemed suitable, should the Town be forced to close the landfill and ship garbage elsewhere. The Board advised Mr. Prusnowski they would be glad to sit down and discuss the proposal with Riverhead.---Councilman Prusnowski suggested that it would be in the best interests of the east end if all of the Towns' recycling programs were the same. Southold Board members did not agree with Mr. Prusnowski, as Riverhead does not have as an extensive recycling program as Southold, and Southold is more than satisfied with the cooperation they have received from the residents . 12:35 P.M. Recess for lunch. 2:30 P.M. - Work Session reconvened and the Board audited outstanding bills. 2:50 P.M. - Review of proposed resolutions for the regular meeting. EXECUTIVE SESSION 3:20 P.M. Moved by Councilman Penny, seconded by Councilman Wickham, it was Resolved to enter into Executive Session. REGULAR MEETING A Regular Meeting of the Southold Town Board was held on Tuesday, January 8, 1991, at the Southold Town Hall, Main Road, Southold, New York, Supervisor Harris opened the meeting at 4:00 P.M., with the Pledge of Allegiance to the Flag. Seeing none, we will 1.-Moved by Councilwoman Latson, seconded by Councilwoman Oliva, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes the followinc~ chanc, te for Ronald Smith: one (1) hour per day as a Food Service Worker in the Nutrition Program, effective December 3, 1990; salary to be paid throug.h the Nutrition Program budget. 1.-Vote of the Town Board: Ayes: Councilman Wickham Councilwoman Latson, Councilwoman Oliva, Councilman Penny, Supervisor Harris. This resolution was declared duly ADOPTED. 2.-Moved by Councilwoman Oliva, seconded by Councilman Penny, it was RESOLVED that the Town Board of the Town of Southold hereby cjrants permission to two (2) staff members and one (1) Planning Board member to attend two (2) one- day conferences ~ponsored by the New York Land Institute at Islip, New York, on February 7, 1991 and February 8, 1991, and the use of a Town vehicle, and the total registration cost of $650.00 for the three individuals, and $15.00 per person lunch cost per conferencer as well as permission to purchase a book at a cost of $47.50, which will be reimbursed to the Town, shall be a' legal charge against the Planning Board's 1991 Budget. 2.-Vote of the Town Board: Ayes: Councilman Wickham Councilwoman Latson, Councilwoman Oliva, Councilman Penny, Supervisor Harris. Dobriner to work under the supervision of Cashin Associates on the completion of the Local Waterfront Revitalization document, effective January 1, 1991 through December 31, 1991, at a sum not to exceed $2,000.00. 3.-Vote of the Town Board: Ayes: Councilman Wickham Councilwoman Latson, Councilwoman Oliva, Councilman Penny, Supervisor Harris. This resolution was declared duly ADOPTED. 5.-Moved by Councilman Penny, seconded by Councilwoman Oliva, it was RESOLVED that pursuant to Article 8 of the Environmental Conservation Law, State Environmental Quality Review Act, and 6NYCRR Part 617.10, and Chapter 44 of the Code of the Town of Southold, notice is hereby given that the Southold Town Board, in conducting an uncoordinated review of this unlisted action, has determined that there will be no sicjnificant effect on the environment. DESCRIPTION OF ACTION: Amendment to Chapter 100 (Zoning) of the Code of the Town of Southold in relation to accessory building setbacks. The project has been determined not to have a significant effect on the environment because an Environ- mental Assessment Form has been submitted and reviewed and the Town Board has concluded that no significant adverse effect to the environment is likely to occur should the project be implemented as planned. 5.-Vote of the Town Board: Ayes: Councilman Wickham Councilwoman Lats0n, Councilwoman Oliva, Councilman Penny, Supervisor Harris. This resolution was declared duly ADOPTED. 7.-Moved by Supervisor Harris, seconded by Councilwoman Oliva, it was RESOLVED that the Town Board of the Town of Southold hereby cjrants permission to Police Officer Beth Wilson to attend a Child Protective Services Training Institue of Cornell University, at Hauppauge, New York, on February 6, 7, 8, 1991, and the registration fee of $60.00 (made payable to New York State Department of Social Services), and use of a Town vehicle shall be a legal charge against the Police Depart- ment's 1991 Budget. 6.-Moved by Councilman Penny, seconded by Supervisor Harris, WHEREAS, there has been presented to the Town Board of the Town of Southold a proposed Local Law entitled, "A Local Law in Relation to Accessory Buitdincl Setbacks"; now, therefore, be it RESOLVED that the Town Clerk be and she hereby is authorized and directed to transmit this proposed Local Law to the Southold Town Planning Board and the Suffolk County Department of Plannin~l in accordance with the Code of the Town of Southold and the Suffolk County Charter. Said proposed Local Law reads as follows, to wit: A Local Law in Relation to Accessory Building Setbacks BE IT ENACTED, by the Town Board of the~Town of Southold as follows: I. Chapter 100 (Zoning) of the Code of the Town of Southold is hereby amended as follows: 1. Section 100-33[B) (Setbacks) is hereby amended to read as follows: 1.On lots containing up to twenty thousand (20,000) square feet, such buildings shall be set back no less than three (3) feet from any lot line. 2. On lots containing more than twenty thousand-(20,000) square feet up to thirty-nine thousand nine hundred ninety-nine (39,999) square feet, such buildings shall be set back no less than five (5) feet from any lot line. 3. On lots containing in excess of thirty-nine thousand nine hundred ninety-nine (39,999) square feet up to seventy-nine thousand nine hundred ninety-nine (79,999) square feet, such buildings shall be set back no less than ten (10) feet from any lot line. 4, On Its containing in excess of seventy-nine thousand nine~ hundred i ninety-nine (79,999) square feet, such buildings shall be set back L no less than twenty (20) feet from any lot line. II. This Local Law shall take effect upon its filing with the Secretary of State. 6.-Vote of the Town Board: Ayes: Councilman Wickham Councilwoman Latson, Councilwoman Oliva, Councilman Penny, Supervisor Harris. This resolution was declared duly ADOPTED. 8.-Moved by Councilwoman Latson, seconded by Councilwoman Oliva, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes an advance fee check in the amount of $515.00 (47 tickets at $11.00 each, plus a $2.00 postage and handling fee), for the July 21st New York Mets game; said charge to be made to A7320.4, Joint Youth, Contractual Expenses; check made payable to New York Mets. 8.-Vote of the Town Board: Ayes: Councilman Wickham Councilwoman Latson, Councilwoman Oliva, Councilman Penny, Supervisor Harris. This resolution was declared duly ADOPTED. 9.-Moved by Councilwoman Oliva, seconded by Councilman Penny, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes and directs the Town Clerk to advertise for bids for the Superintendent of Hicjhways for Screened Sand for Snow and Ice Control for 1991. 9.-Vote of the Town Board: Ayes: Councilman Wickham Councilwoman Latson, Councilwoman Oliva, Councilman Penny, Supervisor Harris. This resolution was declared duly ADOPTED. 10.-Moved by Supervisor Harris, seconded by Councilwoman Oliva, it was RESOLVED that the Town Board of the Town of Southold hereby 9rants permission to Curtis Horton and Gary Fish to attend the Buildinq Officials Conference at Rochester, New York,. on April 15, 16, 17, 1991, and use of a Town vehicle, and necessary expenses for registration, meals, and lodging shall be a legal charge against the Building Department's 1991 Budget. 10.-Vote of the Town Board: Ayes: Councilman Wickham Councilwoman Latson, Councilwoman Oliva, Councilman Penny, Supervisor Harris. This resolution was declared duly ADOPTED. 12.-Moved by Councilwoman Oliva, seconded by Councilwoman Latson, it was RESOLVED the the application of Thomas Wowak to locate a single family house trailer on his property on the north side of Main Road, Laurel, said trailer to be used to house two seasonal wo~'~ers from May through October, be and hereby is granted for a six (6) month period. 12.-Vote of the Town Board: Ayes: Councilman Wickham Councilwoman Latson, Councilwoman Oliva, Councilman Penny, Supervisor Harris. Harris to execute a Letter of Election which will allow the Town of Southold Police Department to subscibe to Intellipath II Digital Centrex Service, and to execute the Sales/Maintenance Agreement and/or Lease Agreement, all in accordance with the approval of the Town Attorney. 13.-Vote of the Town Board: Ayes: Councilman Wickham Councilwoman Latson, Councilwoman Oliva, Councilman Penny, Supervisor Harris. This resolution was declared duly'ADOPTED. 14.-Moved by Councilwoman Oliva, seconded by Councilman Wickham, WHEREAS, there has been presented to the Town Beard of the Town of Southold a proposed Local Law entitled, "A Local Law in Relation to Residential Recycling"; now, therefore, be it RESOLVED that the Town Board hereby sets 8:07 P.M., Tuesday, January 22, 1991, Southold Town Hall, Main Road, Southold, New York, as time and place for a public hearing on the aforesaid proposed Local Law which reads as follows, to wit: A Local Law in Relation to Residential Recycling BE IT ENACTED by the Town Board of th~ Town of Southold as follows: I. Chpater 48 (Garbage, Rubbish and Refuse) of the Code of the Town of Southold is hereby amended as follows: Section 48-1 (Definitions) is hereby amended to read as follows: REFUSE - Any human, animal or vegetable refuse, offal, swill, cesspool and/or septic waste, sewage, garbage, paper, ashes, junk, trash, rubbish, waste, or whatever material composed, discarded machinery or parts thereof, discarded vehicles or parts thereof and an unlicensed motor vehicle parked; stored or standing outside an enclosed building in an inoperative condition for more than thirty (30) days. REFUSE shall not include cans, glass, plastics or newspaper as further defined herein. Section 48-1 (Definitions) is hereby amended by adding thereto the following; CANS - Shal be a recyclable and shall mean rinsed clean containers with or without labels comprised of aluminum, tin, steel, or a combination thereof, which contain or formerly contained only food and/or beverage substances. CANS shall not mean oil, paint, pesticide or aerosol cans. GLASS - Shall be a recyclable and shall mean all clear (flint), green and brown (amber) colored glass containers rinsed clean. GLASS shall not mean wired §lass, crystal, ceramics, plate, window, laminated, mirrored glass, or light bulbs. PLASTICS - Shall be a recyclable and shall mean all food, beverage or household containers, such as: Soda, detergent, bleach, milk, juice, shampoo bottles, cooking oil bottles, rinsed clean. PLASTICS shall not mean caps, applian~ces, plastic with metal parts, six pack rings, biodegradable bags, disposable diapers, pens, razors, flower pots or bags, fiberglass, waxed cardboard containers, vinyl or styrofoam. NEWSPAPER - Shall be a recyclable and shall include unsoiled newsprint and all newspaper advertisement. NEWSPAPER shall not include phone books, junk mail, plastic bags, cardboard boxes, brown paper bags, magazines, catalogs or glossies. RECYCLABLE - Shall be any can, glass or plastic container or newspaper as defined in this section. RECYCLABLE WOOD - Shall be: 1. Clean untreated finished lumber products or remnants containing no nails or other metals; or, 2. logs, not greater than four-feet in length and six inches in diameter. Section 48-3 (A) (Town Refuse Disposal Area) is hereby amended by adding thereto the following: A. RESIDENTIAL SELF-HAULERS 1. No cans as defined herein shall be deposited at any Town of Southold disposal area'unless such cans are separated from any and all solid waste, trash, rubbish, vegetative yard Waste, cardboard, glass, metal or paper. Such cans are to be deposited only at designated areas within such Town disposal area. 2. No glass as defined herein shall be deposited at any Town of Southold disposal area unless such glass is separated from any and all solid waste, trash, rubbish, vegetative yard' waste, cans., carboard, metal or paper. Such glass is to be deposited only at designated areas within such Town disposal area and in the area designated for the particular color of glass (i.e. clear, amber or green). 3. No plastic as defined herein shall be deposited at any Town of Southold disposal area unless such plastic is separated from any and all solid waste, trash, rubbish, vegetative yard waste, cans, cardboard, glass or paper. Such plastic is to be deposited only at designated areas within such Town disposal area or transfer station. 4. No newspaper as defined herein shall be deposited at any Town of Southotd disposal area unless such newspaper is separated from any and all solid waste, trash, rubbish, vegetative yard waste, cans, cardboard, glass or plastic. Such newspaper is to be deposited only at designated areas within such Town disposal area. JANUARY 8, 1991 B. PRIVATE RESIDENTIAL REFUSE HAULERS/CARTERS I. The owners or occupants of all residences within the Town which utilize collection services provided by persons licensed to collect refuse, pursuant to the provisions of this chapter, shall place recyclables in separate, rigid containers at curbside for collection on such day or days as the licensee serving such residence shall designate. 2. It shall be unlawful for any person to place out for collection any container in which refuse is mixed with recyclables. 3. It shall be unlawful for any person to collect refuse from a residence which is mixed with recyclabes or thereafter to commingle different types of recyclables or to mix recyclables with refuse. 4. Recyclables collected by private residential refuse haulers/carters and transported to the landfill/collection center shall be deposited in areas designated by appropriate landfill personnel. Section 48-4 (B)(3) (Fees) is hereby amended to read as follows: 3. Wood, including but not limited to timber, logs, boards and the like, unless such wood, is designated by the landfill attendant as recyclable wood. 5. Section 48-6 (A) and (B)(Penalties for Offenses) is hereby amended as follows: A. lllegat Dumping - Any person committing an offense of illegal dumping under this chapter shall, upon conviction thereof, be guilty of a violation punishable as follows: 1. For a first offense: a. A fine of not less than one thousand dollars ($1,000.) and not more than fifteen hundred dollars ($1,500), or b. Imprisonment for a term not exceeding ten days (10), or c. Community service of forty hours (40) to be performed within thirty days (30) of date of sentencing. 2. For a second offense: a. A fine of~,not less than two thousand five hundred dollars ($2,500.) and not more than five thousand dollars ($5,000), or b. Imprisonment for a term not exceeding thirty days (30), or c. Community service of one hundred and twenty hours (120) to be performed within ninety days (90) of the date of sentencing. Recycling Offenses and aother offenses - Any person committing a recycling offense or any other offense against this chapter other than an offense of illegal dumping shall be subject to a civil penalty enforceable and collectible by the Town in the amount of one hundred dollars ($100.) for each offense. Any person comitting a second and/or subsequent offense within twelve (12) months of the date of the first offense shall be subject to a civil penalty enforceable and collectible by the Town in the amount of two hundred dollars ($200.). Such penalty shall be collectible by and in the name of the Town for each day that such offense shall continue. II. This Local Law shall take effect upon its filing with the Secretary of State. ~4.-Vote of the Town Board: Ayes: Councilman Wickham Councilwoman Latson, Councilwoman Oliva, Councilman Penny, Supervisor Harris. This resolution was declared duly ADOPTED. JANUARY 8, 1991 285 SUPERVISOR HARRIS: At this time, I'd like to go out to members of the audience. If there's anything you'd like to address, please tell us, to inform us. We'd certainly be interested to hear from you at this time. Come forward and state your name, please. PETER WEYMOUTH: I'm a taxpayer of Southold. I'd to know the exact status of the development of the site of the Animal Shelter, and, also, would it envolve costs required from the people, who are doing the developing work. SUPERVISOR HARRIS: The Dog Pound Shelter Alternate Location Committee has met twice. We're proceeding ahead with finding alternate locations, if available right now. Members of the committee are bringing back those properties, that they feel may be appropriate for us to deliberate on, and us being the Location Committee, to deliberate on, and once we have made a recommendation, if any is' found, we will proceed to the Town Board with our information. PETER WEYMOUTH: There is no current update at all? SUPERVISOR HARRIS: There was originally a date set up, but due to the holidays and so on, the Board felt it would better to put it off until after, which we just passed, and now we are going to have a meeting set up for this week. PETER WEYMOUTH: This was started three months ago. SUPERVISOR HARRIS: It's been only a little over a month, that the Board has been working. We started in November, and it's only been the month of December, that we've been working. PETER WEYMOUTH: When will the report be in? SUPERVISOR HARRIS: We'll know at the next meeting, which has been scheduled. I haven't got that in front of me, what the next meeting is, but it has been scheduled. PETER WEYMOUTH: It's not weatherproof. There are people working in there. We have animals in there. SUPERVISOR HARRIS: Well, this recommendation, this committee was set up for, if there was another direction to move in, there were members of the public, that wanted to go and explore, and certainly formed that committee on their behalf, so that we could helpfully, a~nd h6pefully, look for a location, that would be approved by both sides, 'and at this time, ike I say, we still are deliberating on that. I would hope by the end of this month, we will have a final determination. PETER WEYMOUTH: That would be the beginning of February? SUPERVISOR HARRIS: That's what we're shooting for right now. PETER WEYMOUTH: Thank you. SUPERVISOR HARRIS: Is there any other member of the audience, that would like to address on any subject, that may be of importance? JOHANNA NORTHAM: Johanna Northam. On January 17, the Assembly Envionmental Conservation Commission is going to have a public hearing on Solid Waste Management Pact of 1988. Unfortunately, it's by invitation only, and I'm under the impression that the Town of Southold did not receive an invitation. It's a very important hearing, because they want to review the specifics of recycling, waste reduction, and how they can help. Although we haven't bee'n 'invited, I do recommend to the Town Board, send a letter with their concerns. Thank you very much. SUPERVISOR HARRIS: Johanna, that was brought to our attention by you, and the members of The Task Force. As a matter of fact, last night it was brought up at a Task Force meeting, and the Town Board joint meeting. We will w~'ite a letter, and certainly on behalf of the Town, which will express our concerns, and I would hope, that you would help us draft that. If ~you like, if the Town Bbard so deems at this time, we could direct you right now. If you would like to do a draft letter, which we could put on my stationery, I'd be glad to send it on behalf of the Town Board, and the Task Force.
