SCTM# 1000-78-8-2 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the action is INCONSISTENT with the Policy Standards and therefore is INCONSISTENT with the LWRP. 6.3 Protect and restore tidal and freshwater wetlands. The applicant has not demonstrated that the following dock standards pursuant to § 275-11. Construction and operation standards have been met. (d) Review and approval of dock applications. Before issuing a permit for a dock structure, the Trustees shall consider whether the dock will have any of the following harmful effects: [1] Whether the dock will impair navigation or be located in areas of high vessel traffic or vessel congestion; The proposed dock extension would extend into the public waters. The water depth in the vicinity of the proposed dock is extremely shallow and the channel is narrow. Low, low water depth is 11" at the terminus of the dock. The area is not conducive to permanent dock structures. A mulched path to access public waters for small watercraft launching is a less impactful option. Alternatives such as a seasonal mooring in pre-established areas with adequate water depth is a better option for larger vessels. Further the proposal does not meet Chapter 275 standards which state: In determining the permitted length of a proposed residential dock, the Board shall seek to maintain lengths consistent with the other docks (i.e.,pier line) in the waterway. [2] Whether the dock will unduly interfere with the public use of waterways for swimming, boating, fishing, shellfishing, waterskiing and other water-dependent activities; Private dock structures extending into public waters decreases the public use of bottomlands and the nearshore area. [5] Whether the dock will cause degradation of surface water quality and natural resources; Goose Creek is a New York State Significant Coastal Fish and Wildlife Habitat and New 'York State Department of Environmental Conservation Critical Environmental Area. Water depths are extremely shallow in this area. [11] Whether the cumulative impacts of a residential and commercial dock will change the waterway or the environment and whether alternate design, construction, and location of the dock will minimize cumulative impacts; All species of fish and wildlife are affected by water pollution, such as chemical contamination (including food chain effects as a result of bioaccumulation), oil spills, sedimentation, excessive turbidity, stormwater runoff, and waste disposal (including boat wastes). Cumulative impacts from an increase in docks in Goose Creek may include adverse impacts to water quality. As indicated above, a non-structural natural, untreated mulch path would be a better option. [12] Whether adequate facilities are available to boat owners and/or operators for fueling, discharge of waste and rubbish, electrical service and water service. 9.3 Preserve the public interest in and use of lands and waters held in public trust by the state and the Town of Southold. A. Limit grants, leases, easements, permits or lesser interest in lands underwater in accordance with an assessment of potential adverse impacts of the proposed use, structure, or facility on public interest in public lands under water. The private dock structure will extend into public waters resulting in a net decrease in public access to public underwater lands and the nearshore area. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. Without such a structure,the same location on the site could still be used for access,but watercraft would have to be dragged through the marsh,which together with the associated foot traffic would create the potential damage and loss of wetland vegetation along the shoreline. In order to minimize and mitigate any potential impact of the project on the adjacent vegetated tidal marsh and surface water quality,the proposed catwalk has been designed with the minimal scope necessary to reach a depth of almost one foot during mean lower low tide and would be constructed with open-grate decking and elevated a minimum of 4 feet above the grade of vegetated marsh. See LWRP Section III - Policies Pages 3 through 6 for evaluation criteria ❑ Yes ❑ No ® Not Applicable LWRP CONSISTENCY ASSESSMENT FORM ADDENDUM FOR PIPES COVE MANAGEMENT ASSOCIATION 6TH STREET GREENPORT,NY SCTM#1000-49-1-25.58 &#1001-7-116.6 Policy 6 The project seeks to replace and raise the height of historically existing and previously permitted timber bulkheading with vinyl bulkheading to maintain the property's historical method of protection against erosion and flooding. Because of the bulkhead's close proximity to the substantial concrete retaining wall located behind it and the relatively narrow distance between the two structures,however, it is not practicable to remove and replace the existing bulkheading in place, as doing so would create a serious risk of undermining the retaining wall and adjacent soil material,which could collapse avulsively into the bay. Therefore,the new vinyl bulkhead is proposed to be constructed immediately seaward/within 18 inches of the existing timber bulkhead to remain. However, as mitigation for the approximately 462 sf area of open waterway located within Town Trustees jurisdiction(and additional waterway located on the portion of the property located in the Village of Greenport) that would be filled as a result of the proposed seaward bulkhead encroachment,an approximately 832 sf area of vegetated tidal marsh will be created in place of an upland, fertilized lawn area located on the property within the Village of Greenport. In addition,the project will provide the benefit of replacing treated timber bulkheading with untreated vinyl sheathing in the surface waters of the bay; maintaining existing non-turf buffer areas for increased absorption and filtering of runoff adjacent to the bay; and expansion of the non-turf buffer area through replacement of existing impervious patio area with pervious crushed stone. Therefore,with its incorporated mitigation, consistent with Policy 6, the project will result in an increase in the area of vegetated tidal wetlands located in the Town of Southold and will not have a significant adverse on the adjacent tidal waters. l 1 Attach additional sheets if necessary Policy 3.
