Wickham, Councilman Joseph J. Lizewski, Councilwoman Alice J. Hussie, Town Attorney Harvey A. Arnoff, Assistant Town Attorney Matthew G. Kiernan, Town Clerk Judith T. Terry. Absent: Justice Raymond W. Edwards (out of town). 9:30 A.M. - The Town Board met with Insurance Consultant William F. Mullen, Jr. and Principal Account-Clerk John Cushman' to discuss the Public Officials Liability Insurance policy. Mr. Mullen advised that the policy is completely ineffective and is of no value, and asked permission to cancel it. The Board asked Mr. Muilen to research the possibility of obtaining an effective policy before cancellation.---Mr. Mullen informed the Board that the loss control people from the Town's general liability insurance carrier were here last week and assessed the Town's properties. 10:00 A.M. For Discussion Items: (1) Councilwoman Hussie, Chairperson of the Solid Waste Task Force, and Councilman Wickham, former Chairperson, reviewed the Task Force's summary report for 1990-1991 (copy on file in the Town Clerk's Office). 10:05 A.M. - Merlon Wiqgin, representing East End Seaport, met with the Board to bring to their attention the upcomin9 Sea Safety Expo to be held in Greenport on May 16th. He also presented the proposed plan for the Seaport Museum to be located at the Greenport railroad station, and asked the Town to consider contributing financially toward the salary of a part-time employee to work at the museum. The Board will take this into consideration at budget time. 10:20 A.M. For Discussion Items (continued): (2) Proposed budget modification to charge the Ordinance lh-spector's -salary to the Landfill (see resolution no. 35). (3) Proposal from Waiter A. McDermott to perform a telephone audit of the Town's telephone bills to obtain credits or refunds for overcharges (see resolution no. 27). (4) Councilwoman Hussie discussed the establishment of a policy with respect to compensation of Town employees who are members of committees. She feels the involvement in committee work should be limited as to compensation. Councilman Penny stated that attendance at committee meetings should be on a voluntary basis. This matter was referred to the Personnel Committee. (5) Councilwoman Hussie submitted a proposed Operations Policy for the Southold Town Recreation Department (see resolution no. 28). (6) Councilman Lizewski submitted a proposal to amend the Subdivision of Land regulations whereby determinations with respect to firewells would be made by the Town Board rather than the Planning Board. Inasmuch as the Planning Board must take the first step with respect to amending the Subdivision of Land, it was decided to refer this matter to the Planning and Zoning Committee. Councilman Wickham, Chairman of that committee, advised he would meet with the Planning Board to discuss the firewelis matter, and then arrange a meeting with the Fire Commissioners throughout the Town to hear their views. 11:05 A.M. John Halsey, Director of the Peconic Land Trust, and his associates, Andy Johnson, Consultant, Tim Caufield, Assistant Director, and Randy Parsons, Consultant, along with Mark McDonald, Planning Board member and the Town's Advocate for Suffolk County Preservation or Open Space Funds, met with the Board to discuss their proposals to assist the Town and carry out their goals for the Special Groundwater Protection Area in the ~aurel Lake area. On March 3rd the Suffolk County Legislature authorized the acquisition of 157 acres in that area.--- Mr. Halsey also made a presentation of the management plan for the 23 acre Plock property in Bayview, Southold. _3r 42 MARCU 10, 1992 EXECUTIVE SESSION 11:30 A.M. On motion of Councilman Penny, seconded by Councilman Wickham, it was Resolved that the Town Board enter into Executive Session. Vote of the Board: Ayes: Supervisor Harris, Councilman Penny, Councilman Wickham, Councilman Lizewski, Councilwoman Hussie. Also present: Town Attorney Arnoff, Assistant Town Attorney Kiernan, Town Clerk Terry, John Halsey, Andy Johnson, Tim Caufield, Randy Parsons, and Mark McDonald.---The Board discussed potential acquisition of property. 12:05 P.M. - For Discussion Items (continued): (7) Proposal to amend the Peddling and Soliciting regulations (see resolution no. 29). (8) Proposal to designate to Electrical Inspection firms as agents of the Town to make inspections and reinspections of all electrical installations (see resolutions 30 & 31). (9) Reappointment-of two members, Williams and Peters, of the Landmark Preservation Commission (see resolution no. 32). (10) Request from Recreation Supervisor Reeves to attend a New York State Recreation and Park Society Conference in April was rejected by the Board. (11) Proposal by Principal Account Clerk Cushman for the Town to participate in MBIA's Cooperative Liquid Assets Securities System in an effort to increase the Town's interest earnings (see resolution no. 42). (12) Proposal by Councilman Wickham for the adoption of a policy that representatives of relevant boards will be invited to attend those parts of Town Board meetings dealing with the relevant boards, including discussions of legal matters pertaining to those boards. It was decided this would be discussed at an upcoming joint of those various boards. (13) Memorandum from the Town Attorney transmitting a copy of a bill before the Suffolk County Legislature requiring annual reports of services actually provided by the Suffolk County Police Department to the East End Towns. Supervisor Harris will handle lobbying on the Town's behalf through Legislator Michael Caracciolo. (14) Accept the bid of Harbour Excavation for supplying soil for covering purposes at the Landfill (see resolution no. 33). [15) Proposed Local Law to add recyclables to the Garbage, Rubbish and Refuse regulations (see resolution no. 34). 12:45 P.M. - Recess for lunch. 1:40 P.M. ~ Work Session reconvened and the Board entered into Executive Session. EXECUTIVE SESSION 1:40 P.M. On motion of Councilman Lizewski, seconded by Councilman Penny, it was Resolved that the Town Board enter into Executive Session. Vote of the Board: Ayes: Supervisor Harris, Councilman Penny, Councilman Wickham, Councilman Lizewski, Councilwoman Hussie. Also present: Town Attorney Arnoff, Assistant Town Attorney Kiernan, Town Clerk Terry.---The Board met with Robert P. Yaccarino, the Town's Labor Relations Consultant, with respect to a Memorandum of Understanding between the Town and the PBA for semi-automatic pistol training (see resolution no. 40), and to review the draft new collective bargaining agreement between the Town and the CSEA.---Following their meeting with Mr. Yaccarino, the Board met with Town Trustee Henry Smith to discuss litigation with respect to the Andros Patent.---Also discussed as possible purchase of property. 3:05 P.M. Board discussed the possibility Of enacting a law allowing the hiring of Southold Town residents. The Personnel Committee will work on this with the Town Attorney.---Letter From Fishers Island Harbormaster Joh'n Clavin transmitting a letter from Pirate's Cove Marine attempting to obtain two commercial moorings in West Harbor for the upcoming season. They were denied commercial moorings in 1991 and placed them without a permit, and that led to a court case. He proposes to deny their 1992 applications because there are no commercial moorings in West Harbor. He had hoped the amendment to the code prepared by Assistant Town Attorney Kiernan would have been enacted by now to close the loophole. Supervisor Harris advised there are two civic associations in conflict over this question, and it was thought it would be in everyone's best interests if Mr. Clavin would meet with the Town Board to discuss the problem. 3:45 P.M. - Board reviewed proposed resolutions to be voted upon at the 4:00 P.M. Regular Meeting, and reviewed the audit of outstanding vouchers. 3:58 P.M. - Work Session adjourned. MARCH 10, 1992 343 REGULAR MEETING A Recjular M~eting of the Southold Town Board was held Tuesday, March 10, 1992, at the Southold Town Hall, Main Road, Southold, New York. Supervisor Harris opened the meeting at 4:00 P.M., with the Pledge of Allegiance to the Flag, Present: Absent: Supervisor Scott L. Harris Councilman George L. Penny IV Councilman Thomas H. Edwards (out of town) SUPERVISOR HARRIS: We'd like to recognize a couple of members of our audience this afternoon. We have three Boy Scouts, who are earning their Eagle badges from the troop in Southold. In~th~.back~.t, he¥ areTy Cochran, who is working on his Communications Badge, Chip Penny, who is working on his Communication, and Citizenship in the Community Badge, and Travis Schoen, who I don't see at this time, but was here..here he comes. Travis is working on his Communications, and Citizenship in the Community Badge, also. So, good afternoon, gentlemen. I hope you earn this badge, and enjoy the Work Session, and the Town Board meeting, which will now commence. I'd also, like to take this time to remind the people in Southold Town, that March is Red Cross Month, and to remember the Red Cross, and to donate freely items that are needed to that organization. We presented Charlotte Bianca with a proclamation this morning, and she in return presented the Town with a Red Cross flag, which we will be flying for the month of March in front of Town Hall. I need a motion to approve the audit of the bills of March 10, 1992. Moved by Councilman Penny, seconded by Councilman Wickham, it was RESOLVED that the next recjular meeting of the Southold Town Board will be held at 7:30 P,M., Tuesday, March 24, 1992, at the Southold Town Hall, Southold, New York. SUPERVISOR HARRIS: The meetings will be alternating again, between 4:00 o'clock and 7:30 P.M. We have heard many individuals, who said they would like to see some more night meetings, so in response to that the Board wi~i be setting night meetings on a current basis, especially with the amount o:,r v~,ork that the Town Board is incurring during it's Work Session, which is o~ ~._r~e same day as we have a Board. If not, Alice, would you like to start with the first resolution? 1.-Moved by Councilwoman Hussie, seconded by Councilman Lizewski, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes the following budget modification to the General Fund - Whole Town 1992 Budget to appropriate the grant from the Nassau-Suffolk Alzheimer's Association: To: Revenues: A2705 Gifts & Donations $ 500.00 Appropriations: A6772ol Programs for the Aging, Personal Services $ 500.00 1.-Vote of the Town Board: Ayes: Councilwoman Hussie, Councilman Lizewski, Councilman Wickham, Councilman Penny, Supervisor Harris. This resolution was declared duly ADOPTED. 2.-Moved by Councilman Lizewski, seconded by Councilman Penny, it was RESOLVED that the Twon Board of the Town of Southold hereby accepts the bid of Sam Allen's ~lodern Machinery Inc., Coram, New York, for supplying the Southold Town Highway Department with one (1) Used 1963 Steel Lyon Trailer at a bid price of $16,650.00, all in accordance with the bid specifications. 2.-Vote of the Town Board: Ayes: Councilwoman Hussie, Councilman Lizewski, Councilman Wickham, Councilman Penny, Supervisor Harris. This resolution was declared duly ADOPTED. 3.-Moved by Councilman Wickham, seconded by Councilwoman Hussie, it was RESOLVED that the Town Board of the Town of Southold hereby accepts the bid of Sound Shore Excavating Corp., East Marion, for supplying the Southold Town Highway Department with 3,000 yards (more or less as may be needed) of Screened Sand for ice Control and Highway Maintenance, at a bid price of $6.00 per yard, all in accordance with the bid specifications. 3.-Vote of the Town Board: Ayes: Councilwoman Hussie, Councilman Lizewski, Councilman Wickham, Councilman Penny, Supervisor Harris. This resolution was declared duly ADOPTED. 4.-Moved by Councilman Penny, seconded by Councilwoman Hussie, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes the following budget modification to the General Fund - Whole Town 1992 Budqet to appropriate Fark & Recreation funds for materials for the Mattituck Boat Ramp construction: To: Revenues: A2025 Special Recreation Facilities $ 538.00 Appropriations: A7110.2 Parks, Equipment $ 538.00 4.-Vote of the Town Board: Ayes: Councilwoman Hussie, Councilman Lizewski, Councilman Wickham, Councilman Penny, Supervisor Harris. This resolution was declared duly ADOPTED. SUPERVISOR HARRIS: We're particularly pleased with this boat ~'amp. This is the newest addition to the recreation, and part of the economy of Southold Town, providing for our residents, and also tourists, that frequent this area during the summer months. Access to Mattituck Inlet, this ramp was constructed and built by Superintendent of Highways Ray Jacobs' crew, and he's done a marvelous job, and I'd like to thank him on the record, right now, for the job that's he's done for the residents of the town. This area, also, is going to have lighting, in addition to a ramp, which will make it a facility that people can use at night, so we're looking forward to this dedication in the future sometime in the next few months. 5.-Moved by Supervisor Harris, seconded by Councilwoman Hussie, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes the encumbrances of 1991 General Fund - Whole Town Account A1620.2, Buildings & Grounds, Equipment, in the amount of $4,044.00, for Eastern Long Island Electronic's installation of the radio antenna at the Peconic site; completion of job pending completion of repairs by Metro-One. 5.-Vote of the Town Board: Ayes: Councilwoman Hussie, Councilman Lizewski, Councilman Wickham, Councilman Penny, Supervisor Harris. This resolution was declared duly ADOPTED. SUPERVISOR HARRIS: Again, this is furthering the communications system, and enhancing, making it a state of the art facility for the health and safety of the taxpayers of the Town of Southold. 6.-Moved by Councilman Wickham, seconded by CoUncilwoman Hussie, it was RESOLVED that the Town Board of the Town of $outhold hereby amends their resolution no. 64, adopted on March 13, 1990, determining the amount to be deposited in lieu of land for Park and Playground purposes in the subdivision of Mattituck Creek Estates, from $10,500.00 to $10,000.00, of which sum of $100.00, being the appraisal cost, shall be deducted and payable to the General Fund. 6.-Vote of the Town Board: Ayes: Councilwoman Hussie, Councilman Lizewski, Councilman Wickham, Councilman Penny, Supervisor Harris. This resolution was declared duly ADOPTED. 7.-Moved by Councilwoman Hussie, seconded by Councilman Lizewski, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes and directs Supervisor Scott L. Harris to execute a Pledge and Assignment Agreement and a Deposit Account Agreement between Chemical Bank and the Town of Southold, as Trustee for grant funds from the New York State Affordable Housing Corporation; said agreements to be approved by the Town Attorney. 7.-Vote of the Town Board: Ayes: Councilwoman Hussie, Councilman Lizewski, Councilman Wickham, Councilman Penny, Supervisor Harris. This resolution was declared duly ADOPTED. SUPERVISOR HARRIS: For the rest of you, who aren't familar with the New York State Affordable Housing Coporation Grant, these are grants that the Town helped obtain with the help of Ron Kuhen and others in the Southold Villas project. This amounts to about $25,000.00 per home reduction of the seventeen, which amounts to $450..000.00, I think, total. There's seventeen homes of which $25,000. is going to be applied to each of those as a reduction in the cost for affordable housing. This is a tremendous grant, that we received sometime ago, and we'd like to, again, thank those individuals, that helped make it possible. Resolution #8 we're putting on hold, which is in regard to supporting the Long Island Regional Planning Board plan for Special Groundwater Protection Areas. 9.-Moved by Councilman Lizewski, seconded by Councilwoman Hussie, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes and directs [he Town Clerk to advertise for bids for the construction of one (1) comfort station at the Southold Town Beach. 9.-Vote of the Town Board: Ayes: Councilwoman Hussie, Councilman Lizewski, Councilman Wickham, Councilman Penny, Supervisor Harris. This resolution was declared duly ADOPTED. 10.-Moved by Councilman Penny, seconded by Councilwoman Hussie, it was RESOLVED that the Town Board of the Town of $outhold hereby authorizes the following budget modification to the General Fund - Whole Town 1992 Budc~et to appropriate Park & Recreation funds for the Mattituck Boat Ramp electrical and building supplies: To .' This resolution was declared duly ADOPTED. 12.-Moved by Supervisor Harris, seconded by Councilwoman Hussie, it was RESOLVED that the application of Joseph F. Barszczewski, Jr. for renewal of his storage trailer permit, for trailer located at Kerwin Boulevard, Greenport, which permit expires on April 7, 1992, be and hereby is granted for a six (6) month period. 12.-Vote of the Town Board: Ayes: Councilwoman Hussie, Councilman Lizewski, Councilman Wickham, Councilman Penny, Supervisor Harris. This resolution was declared duly ADOPTED. 13.-Moved by Councilman Penny, seconded bv Councilwoman Hussie, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes the Board of Commissioners of the Fishers Island Ferry District to extend the lease between Wilfred & Shirley Doucette and the Fishers Island Ferry District for a one (1) year period, under the terms and conditions that presently exist, for Building No. 240 (brick Cape Cod single family residence), located on the north side of Whistler Avenue, Fort H. G. Wright, Fishers Island, New York; said extension to be effective from June 1, 1991 to May 31, 1992. 13.-Vote of the Town Board: Ayes: Councilwoman Hussie, Councilman Lizewski, Councilman Wickham, Councilman Penny, Supervisor Harris. MARCH 10, 1992 347 14.-Moved by Councilman Penny, seconded by Councilman Wickham, it was RESOLVED that the Town Board of the Town of S~uthold hereby appoints EIIsworth H. Wilcox as a part-time Ferry Captain for the Fishers Island Ferry District, effective March 1, 1992, at a salary of $16.50 per hour, all in accordance with the recommendation of the Board of Commissioners of the Fishers Island Ferry District (Mr. Wilcox retired from his position as Ferry Captain, effective February 29, 1992). 14.-Vote of the Town Board: Ayes: Councilwoman Hussie, Councilman Lizewskir Councilman Wickham, Councilman Penny, Supervisor Harris. This resolution was declared duly ADOPTED. 15.-Moved by Councilman Penny, seconded by Councilman Lizewski, it was RESOLVED that the Town Board of the Town of Southold hereby increases the duties and responsibilities, including acting in the stead of the Marine Operation Manager when the latter is absent, of Senior Ferry Captain Stephen G. Burke, and sets the compensation of Mr. Burke at $16.50 per hour, effective March 5, 1992, all in accordance with the recommendation of the Board of Commissioners of the Fishers Island Ferry District. 15.-Vote of the Town Board: Ayes: Councilwoman Hussie, Councilman Lizewski, Councilman Wickham, Councilman Penny, Supervisor Harris. This resolution was declared duly ADOPTED. 16.-Moved by Councilman Lizewski, seconded by Councilman Wickham, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes and directs Supervisor Scott L. Harris to execute Partial Payment Request No. Four with respect to the Fishers Island - Elizabeth Field Airport Lighting (Design) construction program, all in accordance with the recommendation of the Town's engineers for this proiect, Calocerinos & Spina Engineers, P.C. 16.-Vote of the Town Board: Ayes: Councilwoman Hussie, Councilman Lizewski, Councilman Wickham, Councilman Penny, Supervisor Harris. This resolution was declared duly ADOPTED. 17.-Moved by Councilwoman Hussie, seconded by Councilman Lizewski, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes and directs the Town Clerk to advertise for bids for the purchase of one (1) Used Crawler Loader for use at the Southold Town Landfill. 17.-Vote of the Town Board: Ayes: Councilwoman Hussie, Councilman Lizewski, Councilman Wickham, Councilman Penny, Supervisor Harris. McDermott, a telephone auditing service, and the Town of Southold, whereby McDermott will audit the monthly service and equipment portion of the Town's telephone bills to obtain credits or refunds for overcharges; fee for said service is fifty percent of the credit or refund, and is payable only when the Town receives said credit or refund; if McDermott is not successful in obtaining a credit or refund, then McDermott will not earn a fee, nor is McDermott entitled to a fee for any prospective savings that may result from the audit. SUPERVISOR HARRIS: Mr. McDermott has been doing t,his for about thirty years, and his policy is one, that is if he's not successful in obtaining a credit or refund, Mr. McDermott will earn no money, and Mr. McDermott is entitled to a fee for any savings that may result from this audit. This was picked up from the New York State Association of Towns seminar we went to about a week and a half, or two weeks ago, and this individual is probably the first one ever doing audits for municipalities for telephone bills. He can go back some nine years, and look at telephone charges, and hopefully, he will continue in the mode, that was done some years ago, when the Town did an audit for cost savings for the taxpayers of this town. We hope that Mr. McDermott is successful, and look forward to seeing, again, a savings with his productive staff, as has been done in the past for this town, when an audit was done some two, or three years ago. No: Councilman Wickham. This resolution was declared duly ADOPTED. COUNCILMAN WICKHAM: I would just like to comment briefly, Scott. I am uncomfortable with the idea of introducing a lot more fire power in the Town. Although I think that the grant is quite generous in how it's contructed, I suspect that in a long term it will wind up costing the Town additional money. SUPERVISOR HARRIS: I think that the second resolution, that we're going to read now, should offset some of the concerns, that Councilman Wickham has in reference to this. 40.-Moved by Supervisor Harris, seconded by Councilman Penny, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes and directs Supervisor Scott L. Harris to execute a Memorandum of Understanding between the Town of Southold and the Southold Town Police Benevolent Association, Inc. which temporarily changes the terms and conditions of employment as they relate to certain scheduled days off and the compensation for travel time to and from the place designated for firearms training solely for the purpose of enabling the Town to provide the initial training for new 9mm semi-automatic weapons. SUPERVISOR HARRIS: In effect, what this has done s negate any additional training days, that the Town would incur by the purchase of these weapons in protection of our citizens, in giving our Polcie Officers additional protection them- selves in these times, considering what is transpiring to the west of us, considering what could happen on the East End. We are immune to none at this point of drugs, and the like, that have infiltrating this town. This, I feel, is very important for the safety of the citizens of this town, not to mention the safety and welfare of the officers. Without this training, and without the PBA, and the Town agreeing, that there would be no additional cost for additional training days, which is required with these new weapons, there probably wouldn't have been an agreement. But in this case, both sides have agreed to the mutual concerns of our community, and such have agreed by this memorandum. 40.-Vote of the Town Board: Ayes: Councilwoman Hussie, Councilman Lizewski, Councilman Penny, Supervisor Harris. Abstain: Councilman.Wickham. This resolution was declared duly ADOPTED. COUNCILMAN PENNY: I'd like to add at this time, that I was originally against some of the hidden costs, that were..I felt was not fully presented to us when we were receiving this grant from the State. That although we were receiving, I believe it's $8,500.00 in funds, there were hidden costs of between $20,000.00, and $30,000.00 worth of overtime. When we brought this to the attention of the Police Committee, the Police Committee was able to negotiate with the PBA, and work out the agreement that we're dealing with right now, so that there are no hidden costs to the taxpayers of the Town of Southold. We wind up with a Police Force, that is better armed, and we all hope that they never need to use these weapons. 41 .-Moved by Councilman Wickham, seconded by Supervisor Harris, it was RESOLVED that the Town Board of the Town of Southold hereby adopts the following amendments to Chapter A107, Article IX (Police Department Rules and Regulations) Section A107-43.1 (Communicable/Infectious Disease) of the Code of the Town of Southold is hereby adopted to read as follows: I. PURPOSE The purpose of this policy is to provide guidelines for members of this Department in preventing the contraction of communicable diseases. II. POLICY It is the responsibility of this Department to ensure that its members are able to perform their duties in a safe and effective manner. The safe performance of daily operations has recently become threatened by life-endangering communicable diseases. Therefore, it shall be the policy of this Department to continuously provide employees with up-to-date safety procedures and communicable disease information that will assist in minimizing potential exposure while increasing their understanding of the nature and potential risks of communicable diseases. 111. DEFINITIONS A. BODY FLUIDS: Liquid secretions including blood, semen and vaginal or other secretions that might contain these fluids such as saliva, vomit, urine or feces. B. COMMUNICABLE DISEASE: Those infections illnesses that are transmitted through contact with the body fluids of an infected individual. IV. PROCEDURES A. Communicable Disease Prevention. 1. In order to minimize potential exposure to communicable diseases, officers should assume that all persons are potential carriers of a communicable disease. 2.Disposable gloves shall be worn when handling any persons, clothing or equipment with body fluids on them. 3.Masks, protective eyewear and coveralls shall be worn where body fluids may be splashed on the officer. 4. Plastic mouthpieces or other authorized barrier resuscitation devices shall be used whenever an officer performs CPR or mouth-to-mouth resuscitation. 5. All sharp instruments such as knives, scalpels and needles shall be handled with extraordinary care and should be considered contaminated items. a. Leather gloves shall be worn when searching for or handling sharp instruments. b. Officers shall not place their hands in areas sharp instru-nents might be hidden. An initial visual search of the area should be conducted with a flashlight when necessary. The suspect may also be asked to remove such objects from his person. c. Needles shall not be recapped, bent, broken, removed from a disposable syringe or otherwise munipulated by had. d. Needles shall be placed in a puncture-resistant container when being collected for evidentiary or disposal purposes. 6. Officers shall not smoke, eat, drink or apply makeup around body fluid spills. 7. Any evidence contaminated with body fluids will be dried, double bagged in plastic bags and marked to identify potential or known communicable disease contamination. B. Transport and Custody 1. Where appropriate protective equipment is available, no officer shall refuse to arrest or otherwise physically handle any person who may have a communicable disease. 2. Officers shall not put their fingers in or near any person's mouth. 3. Individuals with body fluids on their persons shall be transported in separate vehicles from other individuals. The individual may. be required to wear a suitable protective covering if he is bleeding or other wise emitting body fluids. 4. Officers have an obligation to notify relevant support personnel during a transfer of custody when the suspect has stated that he has a communicable disease. 5. Suspects taken into custody with body fluids on their person shall be directly placed into a cell for processing. All subsequent questioning or processing will be conducted in this area as to minimize potential threat to fellow of_ficers or_public. 6. Officers shall document on the appropriate arrest or central complaint (CC) when a suspect taken into custody has body fluids on his person or has stated that he has communicable disease. C. Disinfection 1. Any unprotected skin surface that comes into contact with body fluids shall be immediately and thoroughly washed with hot running water and soap for 15 seconds before rinsing and drying. a. Alcohol or antiseptic towelette~ may be used where soap and water are unavailable. bo Disposable gloves should be rinsed before removal. The hands and forearms should then be washed. c. Hand lotion should be applied after disinfection to prevent chapping and to seal cracks and cuts on the skin. 'd. All open cuts and abrasions shall be covered with waterproof bandages before reporting for duty. 2. Officers should remove clothing that has been contaminated with body fluids as soon as practical. Any contacted skin area should then be cleansed in the prescribed fashion. Contaminated clothing should be handled carefully and laudered in the normal fashion. 3. Disinfection procedures shall be initiated whenever body fluids are soiled or an individual with body fluids on his person is transported in a departmental vehicle. a, A supervisor shall be notified and the vehicle put out of service to be properly cleaned and disinfected. b, If due to manpower constraints, the contaminated vehicle can not be cleaned immediately, the supervisor will direct that the vehicle be locked and sectored to prevent accidental contamina- tion by the public or other members of the department. MARCH 10, 1992 355 c. Service personnel (Tidy Car) shall remove any excess body fluids from the vehicle with an absorbent cloth, paying special attention to any cracks, crevices or seams that my be holding excess fluid. d. The affected area should be disinfected using hot water and detergent or alcohol, and allow to air dry. e. After completing the above procedure, the vehicle will then be taken to the car wash as a final precaution. 4. Nondisposable equipment and areas upon which body fluids have been spilled shal be disinfected as follows. a. Any excess of body fluids should first be wiped up with approved disposable absorbent materials. b. A freshly prepared solution of one part bleach to ten Darts water or a fungicidal/mycr0bactericidal disinfectant shill be used to clean the area or equipment. 5. All disposable equipment, cleaning material or evidence contaminated with body fluids shall be bagged and disposed of at Eastern I~ong Island Hospital in compliance with New York State Law for disposal of biologically hazardous waste material. C. SUPPLIES 1. The Department will be responsible for continuously maintaining and storing adequate amounts of communicable disease control' supplies. 2. Protective §loves, other first aid supplies and disinfecting materials will be made readily available at all times, by the Department. 3. All departmental vehicles shall be continuously stocked with the following communicable disease control supplies. a. Clean robes in appropriate sizes. b. Disposable gloves and leather gloves. c. Pucture-resistant containers and sealable plastic bags. -d. Barrier resuscitation equipment, goggles and masks. e. Liquid germicidal cleaner. f. Disposable towelettes (709 percent isopropyl alcohol). g. Waterproof bandages. h. Absorbent cleaning materials. 4. Officers using supplies stored in police vehicles are responsible for their immediate replacement. 5. Officers are required to keep disposable gloves in their possession. E. LINE OF DUTY EXPOSURES TO COMMUNICA13LE DISEASES 1. Any officer who has been bitten by a person or who has had physical contact with body fluids of another person while in the line of duty shall be considered to have been exposed to a communicable disease. 2. A supervisor shall be contacted, and all appropriate duty injury and medical forms shall be completed. 3. Immediately after exposure, the officer shall be transported to the appropriate health care facility (Eastern Long Island Hospital) for clinical and serological testing for evidence of infection. a. The department shall ensure continued testing of the officer for evidence of infection and provide psyclological counseling as determined by the health care official. b. The department may require an employee to be examined by a physician to determine if he is able to perform his duties without hazard to himself or others. 6.All personnel shall treat employees who have contracted a communicable disease fairly, courteously and with dignity. F. RECORD KEEPING The department shall maintain written records of all incidents involving employees who have potentially been exposed to a communidable disease while acting in the line of duty. The records shall be stored in a secured area with limited access, and maintained in conformance with applicable privacy laws. SUPERVISOR HARRIS: l'd like to take a minute to explain to you. The Southold Town Police Department enacted this policy, because some time ago, unbeknown to the Town of Southold, us as elected officials, and not to mention those who have prepared a budget, the State mandated that alt first time responders, being those who are involved either in Fire Departments, or those involved in the Police Departments, have to have a shot, which is for Hepatitis 13. Those shots amount to over $5,000.00, which this town had not budgeted, however due to the safety and welfare of our employees, being that of our Police Officers, this had to be enacted very quickly. The shots have been given to the best of my knowledge at this time, and hopefully our officers are now better protected against exactly what this'l~olic¥ has stated, and that is communicable diseases. 356 MARCH 10, 1992 41.-Vote of the Town Board: Ayes: Councilwoman Hussie, Councilman Lizewski, Councilman Wickham, Councilman Penny, Supervisor Harris. Come up, and state your name, please. PHILIP VANBOURGONDIEN: I'd just like clarification. My name is Philip VanBourcjondien. Clarification on why is it necessary to have two separate sets of electrical inspectors for the Town? SUPERVISOR HARRIS: Some time ago, it was brought to our attention, and I don't know if you were at one of our meetings, when this was discussed. Our Code basically had a monopoly, right now, for one organization called the New York Board of Underwriters. They are a private organization. They have nothing to do with the New York State government. It was brought to our attention, that there are other bodies, other organizations out there, who have been certified by the State of New York, that would like to do business 'n the Town of Southold. Our Code prohibited any other private company from doing business with electrical inspections in reference to Building Department, and inspections with the New York State _guilding Codes. Because this was brought to our attention, we had to change the Code, and open it up to whoever was now certified by the State of New York. Since that time, we made that modifica- tion to the Code, a second company has come along, and that's what we acted upon tonight, to authorize them to do business in the Town of Southold. There may be more in the future. There"s no cost to the Town. We don't pay them. It's strictly us authorizing them what with the certifications, insurance, that they have, that they're authorized to do business in the town. MARCH 10, 1992 3 5 9 PHILIP VANBOURGONDIEN: The thought occurred to me in looking at Resolution 36, 37, and possibly some of the other through there, these young men here, }~ou Llse capital letters for man'./ programs, like CSEA, and SNAP, that doesn't mean anything to them. It doesn't mean anything to me. I don't understand. what these are for. SUPERVISOR HARRIS: SNAP is Supplemental Nutrition Asssistance Program, which is, we use that rather than go through that SNAP is a short term for that. PHILIP VANBOURGONDIE['~: I realize why it's done, but I just thought people, these young men might say, what the beck is all these initials, what is all this mean? SUPERVISOR HARRIS: Absolutely. The Town Board has one full-time Attorney, Mr, Arnoff? SUPERVISOR HARRIS: Mr. Arnoff is part-time. PHILIP VANBOURGONDIEN: He's part-time? Then we have a part-time..? SUPERVISOR HARRIS: We have a full-time Assistant Town Attorney. PHILIP VANBOURGONDIEN: Okay. So, I never see the full-time Town Attorney here. I only see the part-time Town Attorney. SUPERVISOR HARRIS: Let me clarify that. Mr. Arnoff is the Town Attorney, but he's a part-time employee. The-Assistant Town Attorney, his name is Matthew Kierr~an, who is a full-time employee, does not come to the night meetings, because his hours are basically eight to four, or whenever the Town needs him, and the Town Attorney's hours are also flexible. He's here all during the day, many days late in the afternoon, or ver~,, earl'./ in the morning, because he does have another place of work besides in the Town of Southold, and Mr. Kiernan, who is the Assistant Town Attorney is full-time, and is in the office on a full-time basis. TOWN CLERK TERRY: He was at the Work Session all day. PHILIP VANBOURGONDIEN: As a part-time attorney, and not on the Town payroll, is Mr. Arnoff paid by the hour? SUPERVISOR HARRIS: He is on the Town payroll. He is paid $30,000.00 a year. PHILIP VANBOURGONDIEN: And what does the full-time attorney receive? SUPERVISOR HARRIS: $40,000.00. PHILI'P VANBOURGONDIEN: ,The reason t ask that I seriously question the necessity for two attorneys on a town of this size. It isn't fair to make comparisons in many cases, but I happen know the Town Attorney for the Village of Babylon, it's not the Town of Babylon, it's the Village of Babylon, that has about the same amount of people as our town, about 30,000 in the village. They have one attorney part-time, so I find that this is pretty steep. The time when we're in recession, why we should spend over $70,000 on attorneys. SUPERVISOR HARRIS: Mr. VanBourgondien, I thing that's easily explainable. If you look at other townships, which have far more attorneys, such as Southampton, has far more attorneys than we have, in order to not supplement outside firms, of which you have to do. For instance, we could probably spend $200,000.00 a year easily in outside litigation, on hiring firms to represent us in all the law- suits. As you know, this town has many, many lawsuits. Probably on a monthly basis, there is at least one or two suits, that have been enacted. This town's thinking years ago was that by having two employees, one part-time, one full- time, they would offset those tremendous cost, that outside legal counsel was costing this town at that time, not to mention other towns around us. It has been a tremendous cost savings to this town not to engage outside counsel, except and where necessary. Only in special cases, do we engage outside counsel. Otherwise most of it is all handled in house. To give you an example, in the Town of Easthampton, Tony Bullock, the Supervisor, has one case over there, which has been committed to an outside firm, which has cost them to date over $700,000.00. One firm for one case, and it was a civil rights case similar to what this town has in front of it right now. We do have an outside counsel representing us, because of the time frames involved, and don't need to mention the name, because... PHILIP VANBOURGONDIEN: I know who you're talking about. I know himvery well. SUPERVISOR HARRIS: Is there any other members of the audience, that would like to address this Board? Harvey, would you like to make some comment? TOWN ATTORNEY ARNOFF: Mr. VanBourgondien, we have handled 1983 actions in-house, so depending on the nature of the action, many times we have handled them in-house, and we're going to save the municipality money, and done so successfully, so that those are dramatic savings to the town. SUPERIVSOR HARRIS: Is there anyone else in the audience? GREG SULLIVAN: My name is Greg Sullivan. I'm with George's East End Recycling. I'm not 100% sure irm .inorder with the pr~ogram. I just wanted to mention, we had placed a bid in reference to landfill cover. We placed an alternate bid, which was for material that construction and demolition transfer station develops. It can be used for landfill cover. I just wanted to bring to the Board's attention, that we had been in touch with the DEC, who I know you work with them. We do, also. I know you already resolved it, but just as a note, on a monthly basis we have a lab company called Eco Test. They're out of Babylon, and what we would be willing to if necessary, if you..the bid that. you already accepted falls short of your needs, if you did go with our bid we could have this company on a monthly basis send one of their representatives, either to our facility, or to Cutchogue Landfill, where we were to deliver the material, and they could pick it up, and sample it on a monthly basis, if required. I just wanted to note that to the Board. SUPERVISOR HARRIS: The Town Board is looking into exactly this material right now. The Task Force as a matter of fact, is doing some further investiga- tion. Our Superintendent of Highways Ray Jacobs has done a tremendous amount of investigation with this. We have a number of forms. First of all, the Code does not allow us to take any material in from outside the town. Number two, we are not an approved landfill by the DEC, and that's the only sort that can use this cover material, according to the Regional Director who I just spoke to the other day in reference to another matter, and the third is, that this was for soil, and that is categoried as not considered to be soil. It's actually ground wood, and so on like that. So it really is being looked into, and a lot of changes would have to be made in the town, if we were to endeavor in that direction. There have been many problems, as you know, with this material in the west end towns with contamination, and the testing of such, and resulting cleanup after contamination has been discovered, so the town right now is very leery of moving in that direction, although the cost savings may, result at some point in the future, the Task Force is looking right now into that to get some further information on it, if the Town may desire to move in that direction sometime, like I said, maybe next year or sometime after that. GREG SULLIVAN: Thank you, very much, and I understand your precautions. SUPERVISOR HARRIS: I also spoke to Mr. Matheson on this issue about a week ago. He called up, and also for clarrification I explained that to him, also. Is there any other member of the audience, that would like to ask this Board any question? (No response.) If not, is there any member of the Board, that would move to adiourn? COUNCILMAN WICKHAM: I would just like to make a brief comment. We've held two meeting so far of the Stewardship Initiative, one in Cutchogue, one in Southold last week. I think both meetings were quite well attended. There were a series of vigorous questions, that were put. This week there are no further meetings, but the following week there will be, and the week after that, there will be meetings 'n Mattituck, Orient, Greenport, and Fishers Island. Various members of the Town Board have indicated an interest in playing a part in these meetings, and I think we're getting a very good exchange, and an assor~men[ of views from the people out there about the planning horizon for the town. I should also point out that the Task Force, which has been created by the Town Board, the applications of interested people are still open until the first of April. So, those people who have an interest in planning questions, who would like to participate in a Task Force looking at the long term stewardship concerns of the town, in a well rounded manner. Qualifications are basically a willingness to work long hours, and put in some pretty tough hard work on matter relating to the water, and planning, on business, economic growth and development, affordable housing. There's a whole range of subjects that's important to the town. Those of you, who are interested I hope that you apply, and express an interest, to the Town Clerk Office. SUPERVISOR HARRIS: Is there any other member of the Board? (No response.) In closing, I'd just like to reiteriate one thing, there was a headline in The Suffolk Times, one of our local papers, last week about the Rec Department being abolished. Never could anything be further from the truth. This Town Board has never endeavored upon abolishing the Rec Department, nor will it ever talk about abolishing. What this Board is talking about is improving, and expanding those facilities, and making more programs available to the needs of Southold Town. I'd just like to get that message out, that despite what you read, I think at one time it was said, my death has been greatly exaggerated, and I think the reports of such, and I think that is an example of what has happened here with Rec Department, and what you've been reading about. This Town has endeavored to improve that facility, and will do so in years to come, and I just want to put that in as point of clarification before we close. Thank you. I motion to adjourn.
