Tuthill PROPERTY LOCATION: 350 Sylvan Drive, East Marion NY SCTM#1000-37-3-19.1 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type Il category of the State's List of Actions, without further steps under SEQRA. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property is 16,000 square foot non-conforming lot located in a R-40 Zoning District. The northerly property is adjacent to Locust Court and measures 100.00 feet, the easterly property is adjacent to Sylvan Drive and measures 160.00 feet, the southerly property measures 100.00 feet and the westerly property measures 160.00 feet. Currently there is a single family one story dwelling on the property which the applicant wishes to demolish. There is also an 8.2' by 8.2' shed in the rear of the property as shown on the survey map by Kenneth M. Woychuk,LS, dated November 20, 2017. BASIS OF APPLICATION: Request for Variance from Article XXXIII, Sections 280 -124 and the Building Inspector's June 6. 2018, Amended June 15, 2018 Notice of Disapproval based on an application for building permit to demolish an existing dwelling and construct a new single family dwelling; located less than the code required minimum front yard setback of 35 feet; at: 350 Sylvan Drive, East Marion NY. SCTM#1000-37-3-19.1 RELIEF REQUESTED: The applicant request a variance to demolish an existing dwelling and construct a new single-family dwelling at 350 Sylvan Drive, East Marion NY. The proposed construction, on this nonconforming 16,000 square foot lot with two front yards in the Residential R-40 District, is not permitted pursuant to Article XXIII Section 280-124 which states; lots measuring less than 20,000 square feet in total size require a minimum front yard setback of 35 feet. A revised site plan, dated September 27, 2018, notes a front yard setback of 17 feet (Locust Court) which was amended from the June 15, 2018 site plan which had a 15 feet setback (Locust Court). In addition, the survey shows a 14 foot setback from the front entry to the street line, where the code requires a 15 foot minimum setback. ADDITIONAL INFORMATION: After receiving a revised portion of a site plan, dated September 27, 2018, the Notice of Disapproval was amended by the Building Department on October 1, 2018 to reflect additional variance Page 2,October 18,2018 #7204,Tuthill SCTM No. 1000-37-3-19.1 relief required pursuant to Section 280-104 C which requires paved terraces, steps and walks not to project within 15 feet of a street line or four feet from a property line. The proposed front entry measures 14 feet from the street line. In addition, the revised site plan depicts an increased setback for the front of house (Locust Court) of 17 feet instead of 15 feet, as prepared by Edward Brunner, P.E. The proposed new dwelling will be larger than the existing one story dwelling with an addition of a second story and an attached one car garage proposed to be built in the same approximate footprint of the existing home. The property is located in the community of Gardiners Bay Estates which is part of the Gardiners Bay Homeowners Association which has small lots, modest homes and private dirt roads. At the Public Hearing held on October 4, 2018 the applicant was asked why he could not move the proposed dwelling further back to meet the 35 feet front yard setback, since the property has ample room for all setbacks to be code conforming. The applicant's response was that he would need to remove some large trees and did not wish to do so. The homeowner across the street on Locust Court wrote a letter to the ZBA and also spoke at the public hearing to object to the placement of the proposed new dwelling. She stated that the size and closeness to the road would block all sunlight to her home. The subject parcel is one of the larger lots in the community of Gardiners Bay Estates. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on October 4,2018 at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance, as amended, will produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The Gardner's Bay subdivision consists of seasonal cottages and some year round dwellings, most of which are one story in height. Locust Court is a narrow unpaved private road and, in addition to the subject property, only one other dwelling has road frontage on that street. The construction of a new two story dwelling only 17 feet from Locust court would alter the visual scale of the street and reduce the natural light available to the one story dwelling directly across the street. 2. Town Law 4267-b(3)(b)(2). The benefit sought by the applicant, as amended, can be achieved by some method, feasible for the applicant to pursue, other than an area variance. Although the subject property is a corner lot with two front yards, a variance would not be required if the applicant built his proposed new home with a conforming setback 35 feet from the front yard property line along Locust Court, and a conforming 35 foot setback from Sylvan Lane, as proposed, since the property is 160 feet in length and 100 feet wide and there is ample area to do so. 3. Town Law 4267-b(3)(b)(3). The variance requested herein is mathematically substantial, representing 51% relief from the code for the front yard setback, and is not substantial for the proposed setback of the front entry from the street line,which represents 6%relief from the code. 4. Town Law &267-b(3)(b)(4). Evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The neighbor directly across from the subject property on Locust Court testified at the hearing and submitted a letter of objection to a proposed new two story dwelling being built so close to her own one story dwelling, when the applicant can conform to the code without hardship. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law &267-b. Grant of the requested relief is NOT the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a newly built dwelling while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Acampora, seconded by Member Planamento, and duly carried,to DENY the variances as amended Vote of the Board: Ayes: Members Weisman (Chairperson),Dantes, Acampora,Planamento and Lehnert. Where my lot is now, it is the oldest part of the association. The lots here are small lots. The average size of a single lot is 40' x 115'. In other areas, the lots are bigger. The variance I am seeking will not affect the character of the neighborhood. If I were to build going back 35 feet from Locust, as the zoning is now, it would affect the neighborhood. My neighbors on Old Orchard would be looking at the'side of my house which is now an open area with trees. I would have to take down 6 —8 big,trees which would also have an affect on the neighborhood view point from their back yards..There are houses in this area that were built on 40' by 115' lots. I would say the setbacks in the Gardeners Bay area are from 10' to 20'. Locust Court is only 215' long. There are only two houses on this street, the Shan house across the street from me and my house. Locust Court looks only about 8' wide but in reality it is a 30' wide road. If you were to look at the corner post on my lot and you were to measure off 30', it goes in Shans' lot about 15' to 20' and there are two large trees growing on the road. Most of the roads in the Gardeners Bay area are 30' wide except for. Sylvan which is only 20' wide. Some of the neighbors on Sylvan are 10' off the road. I have several concerns with the proposed new build across the street from my home. My home is a 1 story, less than 900 sq. foot, and at the highest point 15''6" high. The proposed new house is to be over 29' feet tall. Allowing a front setback of 15' on a very narrow road would effectively block the sun from my year, certainly affect my privacy and I believe would also affect the value of my home. These are quality of life issues that once done can never be changed. The adjoining homes to the new build are 1 story, small homes. This is a large, tall house for the neighborhood. The lot for the proposed new build is 100' wide and 160' deep, more than adequate to set the house back on the lot the required 35' and have no hardship. I also have concerns with the site plan and house plans I was sent. The blueprints don't show the front steps and columned portico, which extend 5' from the house. This would bring the steps to 10' from the road. Also, the plan states that the entire house is to be demolished and taken away. Then a notation states that a 10' x 10' section of the old house will remain, which contradicts the legal notice in the Suffolk Times.
