SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 25, and the Suffolk County Department of Planning issued its reply dated July 6, 2018 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject, 20,609.92 square feet parcel, located in the R-40 Residential Zoning District, measures 169.57 feet along the northerly side, 79.28 feet along the easterly side measures, 152.52 along the westerly property lines fronting Lesters Road, a narrow dirt road, and 225.24 feet along the southerly property lines. The site is improved with an existing single-family wood frame residence with a basement level garage with an existing 16.3 foot by 16.3 foot shed located in rear yard. The subject residence has access to the creek across the street as shown on the survey map dated September 27, 2017 prepared by Laurence M. Haynes, L.S. of Island Wide Land Surveyors. BASIS OF APPLICATION: Request for Variance from Sections 280-124 and the Building Inspector's April 19, 2018 Notice of Disapproval based on an application for a building permit to construct additions and alterations to existing single-family dwelling, at; 1) located less than the code required minimum front yard setback of 40 feet; at: 230 Lesters Road,Mattituck,NY. SCTM#1000-114-7-5.1. RELIEF REQUESTED: The applicant requests variance relief to construct additions and alterations to an existing single-family dwelling located at 230 Lesters Road, Mattituck. The proposed construction is for a covered open porch having a front yard setback of 27.5 feet. The site plan by Neal Hoffman of Hoffman Grayson Architects, LLP notes a front yard setback of 27ft. 6 in (26.5 ft.) The applicant wishes to add a 327 square feet wrap-around porch in the front of the home and also build a 112 square feet Side Porch totaling 439 square feet to be added to the existing dwelling. The remainder of alterations will remain within the existing footprint of the residence. The porches are shown to be covered and open. Page 2, October 18, 2018 #7201, Melan, LLC SCTM No. 1000-114-7-5.1 ADDITIONAL INFORMATION: There have been no written communications or testimony received by the Board objecting to this application. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on October 4, 2018 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law &267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The other homes along Lesters Road have non-conforming front yard setbacks with homes and driveways located close to the road. There are not many homes along Lesters Road, which is private, narrow, and unpaved (gravel and dirt). Three homes to the north are on creek front property. The subject dwelling and property are in need of repair and the proposed improvements will enhance the home and the neighborhood. The existing basement level garage will be eliminated for more living space and there are no plans to build a garage at this time. 2. Town Law &267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The existing dwelling has a non-conforming front yard setback of 35.5 feet, where the code requires a minimum of 40 feet; so any addition in the front yard area will require a variance. 3. Town Law §267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 31.25% relief from the code. However, due to the house being sited at an angle to the road, the southerly end of the proposed open porch addition is set back at a more conforming 34.2 feet, and the dwelling is set back a conforming 44.5 feet at the southerly corner. Moreover the proposed addition wills have no visible impact on the neighbors properties due to the distance and various angles at which other homes are sited from the subject property and the existence of fencing and heavy vegetation along the side yards. 4. Town Law X267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law §267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a covered wrap-around front porch and a covered side porch while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Acampora, seconded by Member Dantes, and duly carried, to GRANT the variance as applied for, and shown on the site plan prepared by Neil Hoffinan,Architect of Hoffman Grayson Architects, LLP, and dated June 19,2018. Page 3, October 18, 2018 #7201, Melan, LLC SCTM No. 1000-114-7-5.1 SUBJECT TO THE FOLLOWING CONDITIONS: 1. The proposed front and side covered open porches shall remain unenclosed. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3)years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1) year terms.
