SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated July 6, 2018 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property is a non-conforming .588 acre rectangular lot located in the R-40 Zoning District consisting of 25,593 square feet. The residentially developed parcel measures 120.28 feet along New Suffolk Avenue then runs south 224.34 feet along agricultural lands to the east, with a southern lot line measuring 121.88 feet and a western lot line measuring 200.98 feet; the subject property is surrounded by three residentially zoned Agriculturally used properties owned by the same neighbor. The lot is improved with a two- story frame house with covered front and side porches, a brick patio, bluestone driveway and a detached barn/garage, as shown on the survey prepared by Nathan Taft Corwin 111, Land Surveyor and dated March 9, 2018 and amended June 1, 2018. BASIS OF APPLICATION: Request for a Variance from Article IV, Section 280-18 and the Building Inspector's June 13, 2018, Notice of Disapproval based on an application for a building permit to construct additions and alterations to an existing single family dwelling, at; 1)more than the code required maximum allowed two and one- half(2-1/2) stories; at: 2600 New Suffolk Avenue,Mattituck,NY. SCTM41000-115-9-3. RELIEF REQUESTED: The applicant requests a variance to reconstruct an octagonal third floor tower measuring 11.4 feet by 11.4 feet, with a mean roof height of 33.8 feet and consisting of approximately 105 square feet of area, to the existing residential structure's attic,where a tower once stood. ADDITIONAL INFORMATION: Included in the applicant's submission is a copy of the Certificate of Appropriateness, Resolution #5.15.18.2, dated May 15, 2018, issued by the Town of Southold Historic Page 2,October 18,2018 #7200, Harper SCTM No. 1000-115-9-3 Preservation Commission for the reconstruction of the dwelling's original tower and the restoration of the original front porch. , Twelve letters were received from various members of the community in support of this application; most notably, letters were received from the immediate neighbor, who owns the farm estate surrounding the subject property, the Chairman of the Town's Historic Preservation Commission, a well-regarded local historian and member of the Historic Preservation Commission, the President of the Mattituck-Laurel Civic Association, the President of the Mattituck-Laurel Historical Society and Museums, a former resident of the subject property and others. Additionally, at the hearing, the applicants' shared their passion to preserve the history and character of their home and to enhance and contribute to maintaining local historical buildings, the streetscape and the community at large. The applicants' wish to recreate a third-floor octagonal tower, which was original to the house when built in 1873. The tower was destroyed by fire in 1948 and while the roof was repaired afterwards,the tower was not rebuilt. The applicants' have spent the last two decades restoring the residence and voluntarily added the property to the Town's Register of Historic Landmarks. The applicant also cited several residential structures in Town with `towers', including 625 Calves Neck Road, 225 Harper Road both in Southold and a similar historic residence on Wickham Avenue in Mattituck. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on October 4,2018 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law X267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. New Suffolk Road is among the oldest streets in the community, running parallel and south of Main Road, between the hamlets of Mattituck and New Suffolk. While the road once passed through mainly agricultural lands and large residential properties, today, the streetscape is dotted with a variety of housing styles taking advantage of the unique coastal terrain, water views and remaining farm or estate properties. It is among the most beautiful of streets,featuring mature trees, open vistas, and a variety of housing styles, sizes and ages. The subject property is among the oldest residences in the area and sits on a knoll overlooking Lake Maratooka to the north and is surrounded by a large, farm estate. Visible from the road, the addition of a third floor tower will enhance the streetscape and reacquaint passersby with the community's architectural heritage and restore a structure built prior to current zoning and is in keeping with similar structures found in the Town built in the late 19th century. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The subject residence was constructed well before current zoning and requires a variance in order to rebuild part of a structure lost to fire nearly seventy years ago. 3. Town Law X267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 100% relief from the code. However, when the structure was originally built the tower existed and the applicant is requesting to recreate the structure with an area of approximately 105 square feet. Moreover, the applicant is not proposing to condition the added tower, labeled on the building plans as "non-habitable space" and indicated access to the tower via a narrow stairwell at the opposite end of the added space. 4. Town Law X267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. Page 3,October 18,2018 #7200,Harper SCTM No. 1000-115-9-3 5. Town Law X267-b(30)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law &267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of additions and alterations to a single-family residence consisting of a tower measuring 11.4 feet by 11.4 feet with a mean roof height of 33.8 feet while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Planamento, seconded by Member Weisman (Chairperson), and duly carried, to GRANT the variance as applied for, and shown on the survey prepared by Nathan Taft Corwin III, Land Surveyor, dated March 9, 2018 and amended June 1, 2018 and shown on the architect's plan labeled pages 1-7 prepared by Robert W. Brenner,AIA, dated May 19, 2018. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s)granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3) years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1) year terms. She asked us to consider their project and to write a letter in support if we deemed it appropriate. We discussed the matter and unanimously agreed that we could indeed write such a letter, and here it is. Z Our mission is to "preserve, protect, and promote the history of this special area of the North Fork and its people, from earliest times to the present day, for current and future generations." We have taken these words to heart in preserving the Jesse and Ira Tuthill House at 18200 Main Road. The Society has expended great effort over more than 50 years to ensure that this main museum, dating from 1799 and expanded in the mid-1800s, is maintained to look the way it was when it was originally constructed. We have used existing paintings and photographs to guide our preservation efforts, and we are proud to have been able to do this. Just last year,we replaced the roof with cedar shingles instead of using cheaper but longer-lasting materials. We have used the same concept in preserving the outbuildings (the carriage house and the milk house), and two one-room schoolhouses that were moved to our site,and reconstructed using as many of the original techniques and materials as possible. The Society carries fire insurance whose cost is nearly 50% of our annual expenditures. This past year, we worked with our insurance company to see if there were cost-effective ways to reduce the premiums, and we couldn't identify any. Yes, any of our structures could burn at any time, but this is a risk that has been mitigated in a uniquely American way since colonial times. If you look on the Internet (as I just did), you will find how Ben Franklin was involved in fire prevention or mitigation from 1730 on, first in founding America's first mutual fire company (1736), which in turn led to the founding of America's first mutual fire insurance company (1752). So it appears that insuring against the risk of fire and other calamities is part of the US historical fabric. Certainly Mattituck today has a fire company second to none, and the Harpers will surely seek to insure the tower as part of the house since they will have gone to great expense in the entire reconstruction. I_have been in the Harpers unfinished attic, which is accessed by a steep, narrow, winding stair, across the length of the house under low lying roof rafters to the proposed tower space that will be accessed by stooping down under the roof structure. My understanding is that this proposed addition has been determined to be a non-conforming 3`d floor habitable space. The proposed unfinished space, not being readily accessible from the 2nd floor, with non-complying access (stair and ceiling heights), suggests it could be considered a non-habitable attic addition. The Harpers speculate any original and alternate access to the tower might have been removed when the roof and the attic area around the tower were repaired. The resulting reconfigured attic renders the replaced tower non- habitable. Regarding this, and the notable (and appropriate) exterior design, that will be a welcome contribution to New Suffolk Avenue, I support the Harpers request for relief by the Board of Appeals. This road which stretches from the Main Road to the hamlet of New Suffolk is scenic for its entire length. I have been closely involved for more than 50 years with matters of historic architecture and his- toric preservation, including related issues of zoning and land use. While my interests lie gener- ally within New York City, the principles and precedents are as valid on the North Fork as they are in the crowded metropolis. I have addressed these issues before the City's Landmarks Preservation Commission and have submitted dozens of reports and provided much testimony in open matters as an architectural historian, adding my experience and knowledge as a registered architect and as an attorney at law. The work proposed by Catherine and Robert Harper presents the sort of contradiction that requires historical perspective to resolve. Here, the admirable goals of both the current zon- ing regulations and those governing historic preservation are in clashing conflict. If the Harper house were still in the condition as originally constructed, and they pro- posed to remove its third-story tower,they would properly be refused a permit to do so, despite the current bar to third stories on houses in Mattituck. Because the house was an exceptional work of historical architecture, it would be grandfathered and its tower preserved. Sadly, a fire in 1948 destroyed that third-story tower, leaving the house with a truncated appearance. Its octagonal corner clearly calls for a pyramidal tower,but a flat roof replaced the tower in the aftermath of the fire. Originally, there were three houses in the town with third- story towers,but now only one remains intact--the Tuthill house at Wolf Pit Lake. Such archi- tectural distinction is rare, with fewer than half a dozen such towers on the entire North Fork from Laurel to Orient. The Harpers propose to replicate the tower that the fire destroyed. Their architect has carefully prepared plans that meticulously reproduce the original size, shape,materials, and component parts of the original tower. If the Harpers had owned the house at the time of the fire and proposed to reconstruct it as soon as the firemen determined it was safe to do so, there would be no issue concerning their right to do so, despite any then-existing zoning regulation against third stories on houses. Their house would have been grandfathered, and the post-fire reconstruction would have been allowed. What we have here is really just a delay in effecting that reconstruction. But beyond that interpretation of the zoning regulation, the proposed recreation of the missing tower serves the equally-important goal of historic preservation of Mattituck's fine old buildings. The local Landmarks Commission goes to great lengths to preserve and protect original features of the his- toric architecture of the town, and to ensure that restoration work matches what had been origi- nally constructed. It guards against inappropriate changes and replacements, and encourages accurate reconstructions where original elements have deteriorated or been destroyed. Replacing the destroyed element of a third-story tower is especially important as only one of the original three such towers in town remains. Mattituck works hard to retain and maintain its existing stock of Victorian and Edwardi- an architecture. The Harpers propose to restore an important element of that architecture. They should be granted the right to do so. In New York City,where the ;fit_ 1 , �:• Landmarks Law clashes in a particular = = `" instance with the Zoning Resolution, re- peatedly the resolution of the conflict comes out on the side of preserving or restoring the historic building rather than adhering to zoning regulations de- - signed for new construction. The original architect designed a third-story tower for the Harper house that existed for half a century; the Harpers should be permitted to restore the existence of that tower. The tower requested in this application was an important architectural element of the house when originally designed and constructed,and would return the exterior of this registered historic landmark to it's original appearance— something that the Historic Preservation Commission felt strongly enough about to issue a Certificate of Appropriateness.
