SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated June 18, 2018 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property is an nonconforming 30,157 sq. ft. parcel located on the northwest corner of Shipyard Lane and Gus Drive, in East Marion. The property has a frontage of approximately 152.50 feet on Shipyard Lane, turning 200.00 feet onto Gus drive, then turning north 152.50 feet along the rear yard, then finally returning 200.00 feet back to Shipyard Lane. There is an existing two story residence on the site, with a rear deck. There is also an in-ground swimming pool in the rear yard and a six foot fence around the entire rear yard, and front yard facing Gus Drive, all shown on a survey prepared by John C. Ehlers, L.S., dated May 15, 2018. BASIS OF APPLICATION: Request for Variance(s) from Sections 280-15; Article XXII, Section 280-105 (A) and the Building Inspector's May 7, 2018, Amended May 21, 2018 Notice of Disapproval based on an application for a building permit to legalize "as built" six(6) feet high fence in the front yard of a single family dwelling, and to demolish an "as built" accessory garage, and to construct a new accessory garage; at 1) proposed garage is located in other than the code required rear yard; 2) "as built" fence more than the code required maximum four (4) feet in height when located in the front yard; at: 1250 Shipyard Lane, East Marion, NY. SCTM#1000-38-7- 10.12. RELIEF REQUESTED: The applicant requests variances to legalize an existing "as-built" six-foot-high fence in the front yard, where only 4 feet high is allowed. In addition, a proposed accessory garage is to be in the side yard, where only the rear yard is allowed. Page 2, October 18,2018 #7199,Agosta SCTM No. 1000-38-7-10.12 ADDITIONAL INFORMATION: At the hearing, the applicant testified that the six-foot-high fence in the front yard along Gus Drive has been there for approximately 10 years without any complaints from neighbors. No one spoke in favor or opposition to the application; the Board received a letter of support from a neighbor. The fence does not block the sightlines from either Shipyard Lane, or Gus drive while driving. There is an existing shed on the site which will be removed from the property in order to locate a proposed detached garage in the same place. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on October 4, 2018 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The as built fence does not block any sightlines from the corner of Shipyard Lane, or Gus Drive while driving a car. There are no neighbors to the south of the property where the fence is located. The existing 6 foot high white vinyl fence encloses the entire large rear and side yards of the property and an existing in ground swimming pool and large accessory shed. There are many two car garages in the neighborhood, and the proposed accessory garage would not be out of character. As the house is on a corner lot, the garage would be most practically located by the existing driveway off of Shipyard Lane, in the proposed side yard location where it will replace an existing large shed that is to be removed from the property. 2. Town Law $267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The property is on a corner,which creates two front yards. If the proposed garage were to be located in the required rear yard, it would be in the same approximate location as the existing pool. As for the as built six foot high section of fencing along Gus Drive that is non-conforming in height,there are no neighbors to the south, and the fence does not block the sightlines to the road at the corner. 3. Town Law 4267-b(3)(b)(3). The variances granted herein are mathematically substantial, representing 100% relief from the code for the proposed garage in the side yard, and 33% relief for the 6 foot high fence in the front yard along Gus Drive where the code permits a maximum of 4 feet. However, the proposed location of the garage is the logical place on the property in relation to the existing driveway and is proposed to be only 14.4 feet high. The applicant must have perimeter fencing on the property per code because of the existing swimming pool in the rear yard, and has agreed to screen the non-conforming section of the as built fencing with evergreens. The existing structures plus the proposed garage would only constitute 17% of the allowable lot coverage. 4. Town Law 4267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. Fences are typical around pools, and the condition imposed herein for the installation of evergreen screening along Gus Drive will mitigate the visual impact of the non-conforming fence height. The applicant must comply with Chapter 23 6 of the Town's Storm Water Management Code and the conditions of the board spelled out below. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law 4267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a two car accessory garage, and a fenced in yard while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. Page 3, October 18,2018 97199,Agosta SCTM No. 1000-38-7-10.12 RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Lehnert, seconded by Member Acampora, and duly carried, to GRANT the variances as applied for, and shown on the survey prepared by John C. Ehlers, L.S., dated May 15, 2018, and building floor plans and elevations, Pages A.I to A.4, prepared by James A. Koppenhaver, P.E., dated May 24, 2018. SUBJECT TO THE FOLLOWING CONDITIONS: 1. The applicant must plant and continuously maintain deer-resistant evergreen trees (green giant arborvitae or equivalent) of a minimum height of five (5) feet and no less than three (3) feet apart on center, adjacent to and running the full length of the fencing along the Gus Drive side of the property to screen the fencing along the street. 2. There shall be no habitable space in the accessory garage 3. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 4. The applicant must apply to the Building Department for a building permit for the "as built" improvement(s)within 30 days of the date of this decision and submit same to the Office of the Zoning Board of Appeals, or submit a written request for an extension to the Board of Appeals setting forth the reason(s)why the applicant was unable to obtain a building permit in the time allotted. 5. The applicant must obtain a Certificate of Occupancy from the Building Department for the "as built" improvement(s) and submit same to the Office of the Zoning Board of Appeals within 2 months of this decision or submit a written request for an extension to the Board of Appeals setting forth the reason(s) why the applicant was unable to obtain a Certificate of occupancy in the time allotted. 6. At the discretion of the Board of Appeals, failure to comply with the above conditions may render this decision null and void. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s)granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been Page 4, October 18,2018 #7199,Agosta SCTM No. 1000-38-7-10.12 procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3) years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1)year terms.
