SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated June 22, 2018 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property is a non-conforming 10,003 square foot parcel located in an R-40 Zoning District. The parcel measures 50.00 feet fronting Young's Avenue, along the westerly property line, measures 200.00 feet along the southerly property line, measures 50.00 feet along the easterly property line, and 200.00 feet along the northerly property line. The parcel is improved with a one story frame house, a frame garage, a blue stone patio, an asphalt driveway and an outdoor shower. All is shown on a survey by John T Metzger dated April 26, 2018 and last revised May 25, 2018. BASIS OF APPLICATION: Request for Variance(s) from Sections 280- 124 and the Building Inspector's May 18, 2018 Notice of Disapproval based on an application for a building permit to construct additions and alterations to an existing single family dwelling at; 1) located less than the code required minimum front yard setback of 35 feet; 2) located less than the code required minimum side yard setback of 10 feet; 3) located less than the code required minimum combined side yard setback of 25 feet at 560 Youngs Avenue, Southold,NY, SCTM No. 1000- 64-1-3. RELIEF REQUESTED: The applicant requests variances to make additions and alterations, which include a second story addition that will result in a front yard setback of 20.7 feet where code requires 35 feet, a single side yard setback of 5.8 feet where code requires 10 feet and a combined side yard setback of 18.5 feet where code requires 25 feet. The proposed addition of the second story will maintain the 5.8 feet single side yard setback. ADDITIONAL INFORMATION: The applicant's representative presented a survey showing other non- conforming front yard setbacks in the neighborhood, and later submitted a letter describing comparison research Page 2,October 18,2018 #7198, Skoblicki SCTM No. 1000-64-1-3 conducted indicating front yard setback relief granted to surrounding properties. A prior variance was granted to the owners of 125 Youngs Avenue for front yard setback of 19 feet on February 26, 2004, in Appeal No. 5454. The neighbors to the north spoke against the application. Other neighbors and community members spoke in favor of approving the application. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on October 4, 2018 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law §267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood consists of single family properties. The neighborhood is an older neighborhood that was developed before the zoning code was in effect and consists of pre-existing non-conforming structures. Other homes on Young's Avenue have non-conforming front yard setbacks and most of the homes are two stories in height and have front porches. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant's non-conforming single and combined side yard setbacks pre-existing, non-conforming, and therefore, any proposed additions and alterations will require an area variance for a single and combined side yard setback. The applicant's existing front yard setback is also non- conforming so any addition in the front yard will also require a variance. 3. Town Law §267-b(3)(b)(3). The variances granted herein for the front yard setback is mathematically substantial, representing 41% relief from the code. The variance granted for the single side yard setback is mathematically substantial, representing 42% relief from the code. The variance granted for the combined side yard setback is also mathematically substantial, representing 36% relief from the code. However, although the southerly side yard setback is proposed to be reduced from 17.7 feet to 12.7 feet, it will only do so for a length of 10 feet along the property line in order to add a one story 10 foot x 5 foot mud room entry. And although the proposed covered porch will increase the degree of non-conformity of the front yard setback, the proposed porch will remain open,will not be conditioned space, is only one story in height, and is characteristic of the other homes in the neighborhood. Finally, the applicant's architect has limited the height of the proposed second story addition to reduce the scale to mitigate the impacts on the character of the community and the non- conforming setbacks. 4. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code and install leaders and gutters on the home and the garage. 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel with a single story single family dwelling after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law &267-b. Grant the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a renovated home with a second story addition while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. SUBJECT TO THE FOLLOWING CONDITIONS: 1) The covered porch shall remain open and not be enclosed as conditioned space. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3)years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1) year terms. The Distasi segmented porch setback is 24, 20 and 19 feet at the closet point to Youngs Avenue. The proposed setback for the Skoblicki property at 207, which would be 17 further back than what was previously approved for the 2004 Distasi variance. I have attached a copy of the findings and determination for your review. On another note, I found it very disconcerting at the hearing when Richard Gendron started to discuss the how the underground sprinkler system pipes were severed. He failed to mention that the incident occurred during the tenure of the former owner. By implication one would think that he was pointing the finger at the Skoblici family. When I sent out the cover letter to the Gendrons it included my phone number. Nancy knows who I am and that I live across the street. They had every opportunity to contact me before the hearing but did not. They prejudged the project without even looking at the plans and elevations before the hearing. The neighborhood has many homes with similar nonconforming sized lots, improved with buildings at similar setbacks. The uniqueness of this parcel is created by frontage along streets at three different angles. Although the easterly front setback of the house was for many years at 24 feet, the proposed setback for the open, roofed porch addition will be 53 feet from the most southerly measurement and at 24 feet measured from the easterly lot line. The proposed six-sided, roofed open porch addition at the southeast comer of the addition will be 19 feet from the front lot line, designed with a lower roof. The porch addition is designed with a low-profile, one-story roof as shown on the 2-12-04 elevation diagrams, which minimizes visual concems. 2. The. benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The 24 ft.setback of the dwelling existed for many years. 3. The variance granted herein is substantial. The code requirement is 35 feet from the front property lines, and the applicants' request is for setbacks at 19 feet and 24 feet. 4. The difficulty was self created in that the dwelling and addition are on a substandard lot with nonconforming front yard setback. 5. No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. Many homes in the neighborhood are developed with similar front porches. 6. Grant of relief is the minimum action necessary and adequate to enable the applicants to enjoy the benefit of a porch addition, while preserving and protecting the character of the neighborhood and the health,safety and welfare of the community.
