For a Variance to the New York State Uniform Fire Prevention & Building Code DECISION PETITION NO 2001-1139 Upon the application of Richard Lear - Lear Design Associates, filed pursuant to 19 NYCRR 450 on December 6, 2001, and upon all other papers in this matter, the Department makes the following determination: NATURE OF GRIEVANCE AND RELIEF SOUGHT The petition pertains to the construction of a new building of A1 (single family) occupancy, two stories in height, of type 5 (wood frame) construction, approximately 2,348 square feet in area, located at 910 New Suffolk Avenue, Mattituck, Town of Southold, Suffolk County, State of New York. The petitioner is seeking relief from: 9 NYCRR 711.2(b), which requires that bathrooms, toilet rooms, kitchenettes, corridors and recreation rooms shall have a minimum height of seven feet. [The petitioner requests relief to allow a bathroom built into the roof area of the second story with a horizontal ceiling height of approximately 7 feet 2 inches sloping down to 5 feet 6% inches on the opposite wall.] FINDINGS OF FACT 1. A proposed new bathroom is to be constructed into the roof area of the second floor of the building that is the subject of this petition. The horizontal ceiling height in the bathroom is approximately 7 feet 2 inches sloping down to 5 feet 6% inches on the opposite wall. With the placement of the fixtures, the ceiling height is adequate for normal usage. The petitioner has proposed to install a fire and smoke detecting devices throughout the new building as required by the Uniform Code. CONCLUSIONS OF LAW Strict compliance with the provisions of the Uniform Fire Prevention and Building Code would produce a negligible additional health, safety and security benefit to the occupants of the building. DETERMINATION WHEREFORE IT IS DETERMINED that the application for a variance from 9 NYCRR 711.2(b), to allow a bathroom built into the roof area of the second story with a horizontal ceiling height of approximately 7 feet 2 inches sloping down to 5 feet 6¼ inches on the opposite wall, be and is hereby PROPOSED TO BE GRANTED with the following conditions: 1. That the petitioner installs fire and smoke detecting alarm devices throughout the entire building in conformance with the Uniform Code. 2. That the building conform to all other applicable sections of the Uniform Code This DECISION is issued under 19 NYCRR 450.6. Unless objected to by the petitioner in a writinq received by the Department, the decision shall become FINAL after fifteen days of receipt of the decision by the parties. This decision is limited to the specific building and application before it, as contained within the petition, and should not be interpreted to give implied approval of any general plans or specifications presented in support of this application. No. 4730 - CAROLE DONLIN 1000-114-12-8 STREET & LOCATION: 910 New Suffolk Ave, Mattituck DATE OF PUBLIC HEARING: August 18, 1999 FINDINGS OF FACT PROPERTY FACTS/DESCRIPTION: The applicant's property consists of 20,587 sq. ft. in area with 60 ft. frontage along the southerly side of New Suffolk Avenue, Mattituck. The lot is improved with a single-family dwelling situated 38 feet from the front property line and 12 ft. setbacks on each side, for an existing total (combined sides) at 24 feet. BASIS OF APPLICATION: Building Inspector's May 6, 1999 Notice of Disapproval citing Article III- A, Section 100-30A.3 and 100-244B of the Zoning Code with respect to a proposed 12 ft. by 20 ft. carport at the west side of the existing dwelling with a setback of one foot instead of the Code- required 15 feet, and total combined sides at 13 feet instead of 35 feet. AREA VARIANCE RELIEF REOUESTED: Applicant requests a Variance for a 12 ft. carport at the west side of the existing dwelling with a setback of one foot and a combined setback of 13 feet. (No other areas are noted in the Notice of Disapproval, which is the basis of applicant's request.) REASONS FOR BOARD ACTION, DESCRIBED BELOW: Based on the testimony and record before the Board and personal inspection, the Board makes the following findings: 1. Grant of the alternative relief in this area variance will not produce an undesirable change in the cinaracter of the neighborhood or a detriment to nearby properties the setbacks at the very least would be three ft. from any property line when locating a detached structure for parking or storing of owner's vehicle. A setback of one ft. is virtually at the property line and would not be in keeping with other~buildings located in the immediately vicinity. 2. The benefit Sc/ught by applicant can be achieved by some method, feasible for appellant to pursue, other thanlthe setback of one ft. An alternative minimum setback of three feet may be achieved for a carport for owner's vehicle. 3. The requested area variance at a one-ft, setback from property line is substantial and represents a 93 percent reduction from the code requirement from 15 feet. The combined total is substantial with a 37% reduction from the code requirement. 4. No evidence has been submitted to show that the proposed carport would have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district.
