WORK SESSION
Present: Supervisor Scott L. Harris (10:30 A.M. - attended a DARE Program at
Oysterponds School), Councilman George L. Penny IV (Deputy Supervisor),
Councilman Thomas H. Wickham, Councilman Joseph J. Lizewski, Councilwoman Alice
J. Hussie, Town Attorney Harvey A. Arnoff, Assistant Town Attorney Matthew G.
Kiernan, Town Clerk Judith T. Terry. Absent: Justice Raymond W. Edwards (out
of the country).
9:45 A.M. - Ed Siec~mann, representing Tax Pac and the Seniors, voiced his support
for the purchase of the North Fork Bank's computer center at Mattituck for a human
resource center.--On another subject, Mr. Siegmann stated he had heard the figure
of $40,000 for producing and mailing a questionnaire concerning the stewardship
concerning, and said he knows of volunteers who will do the job at no cost to the
Town.
9:50 A.M. - For Discussion Items: (1) Creation of a Shellfish Advisory Committee
was held until Supervisor Harris arrived, at which time it was placed on the agenda
as resolution no. 32. (2) Letter from General Code Publishers Corp. recommending
that the Town consider a recodification project, and acquiring their customized
computer software which includes the text of the Town of Southold Code, along with
all necessary programming. The Town Attorney will ask a representative of General
Code to meet with the Town Board to discuss a formal proposal. (3) Request from
the Planning Board for Mattituck Airbase, Inc. to provide them with a site plan
showing all proposed construction and uses of the land that is included in their
change of zone petition. Town Attorney Arnoff will schedule a meeting with
Mattituck Airbase representatives to discuss their proposal. (4) Proposed
resolution to rescind salary increases set by the Town Board at the January 3, 1992
organizational meeting was held until Supervisor Harris arrived, then it was placed
on the agenda as resolution no. 33. (5) Request from Walter Gaipa for a refund
of one half of the $200.00 fee paid in June, 1991 for his commercial disposal permit.
Board would not refund, but authorized Town Clerk to offer to transfer the permit
to another vehicle, or issue a permit for a lesser amount. (6) Councilwoman Hussie
brought to the Board's attention the number' of 350th Anniversary memorabilia items
that remain unsold. Once she has a report on the income from the items sold to date
she will bring it before the Town Board for further discussion. (7) Councilman
Wickham submitted his proposal for the creation of a Stewardship Task Force, to
advertise for candidates to serve on it, to do a direct mailing to the residents of
Southold Town, and the cost for same (see resolution no 30).
11:15 A.M. - Antonia Booth, Town Historian, met with the Town Board to make her
1991 Annual Report.
11:40 A.M. - For Discussion items (continued): (8) Proposed "Local Law in
.Relation to Zoning" concerning home occupation, home business office, and home
professional office was reviewed. The Town Attorney will meet with consultant
Bruce Anderson to begin the SEQR process on this proposed local law. (9)
Proposed resolution in support of a Suffolk County Legislature resolution to approve
certain parcels in the vicinity of Laurel Lake for inclusion in the Suffolk County
Drinking Water Protection Program was placed on the agenda (see resolution no. 31).
12:15 P.M. - Recess for lunch.
2:00 P.M. Work Session reconvened and the Board discuss~the creation of the
Southold'Stewardship Task Force (see resolution no. 30).
2:35 P.M. - The Town Board reviewed the resolutions to be voted upon at the 4:00
P:M. Regular Meeting.

2:50 P.M. On motion of Councilwoman Hussie, seconded by Supervisor Harris, it
was Resolved that the Town Board enter into Executive Session. Vote of the Board:

4, 1992, at the Southold Town Hall, Main Road, Southold, New York. Supervisor

SUPERVISOR HARRIS: Good afternoon, and welcome to the regularly scheduled
Southold Town Board meeting of February 4, 1992. I need a motion for the
audit of the bills February 4, 1992.

RESOLVED that the following audited bills be and hereby ordered paid: General
Fund Whole Town bills in the amount of $361,340.76; General Fund Part Town

SUPERVISOR HARRIS: At this time, we'll go out to the public. Are there
any members of the public, that would like to speak on any resolution, that
we'll be enacting in the next few minutes? (No response.) Councilwoman Hussie,
will you start the resolutions?
1.-Moved by Councilwoman Hussie, seconded by Supervisor Harris, it was
RESOLVED that the application of Frank J. McBride to renew his single family
trailer permit, for trailer located on the north side of Oregon Road, Cutchogue,
and used as living quarters for his farm worker, which permit expires on
February 6, 1992, be and hereby is granted for a six (6) month period.

directs Supervisor Scott L. Harris to execute the required certifications as
required by the Federal Aviation Administration with respect to plans and specifi-
cations for the Elizabeth Field Airfield Lighting, Visual Aids and Electrical
Building Project (AlP No. 3-36-0029-04-91), all in accordance with the direction
of Calocerinos & Spina Engineers, P.C., the Town's engineers for the project.

advance fee check in the amount of $564.00 (47 tickets at $12.00 each) for the
June 6, 1992 bus trip to the Belmont Stakes: check made payable to the New
York Racing Association; charge to be made to A7320.4 Joint youth, Contractual
Expenses.

RESOLVED that the Town Board of the Town of Southold hereby restores Julia
Shelby to her position of Food Service Worker, under the Southold Town Nutrition
Program, effective immediately; Ms. Shelby acted as Assistant Cook during the
maternity leave of Assistant Cook Lisa Caltuna, and received her Food Service
Worker salary, which is currently $7.00 per hour.

RESQLVED that the Twon Board of the Town of Southold hereby reaffirms the
followinq policy decision which was adopted on February 26, 1991:
POLICY WITH RESPECT TO THE LOAN OF ENVIRONMENTAL IMPACT STATEMENTS
RESOLVED that the Town Board of the Town of Southold hereby grants permission
to the Town Clerk, Planning Board, Board of Appeals, and Town Trustees to
loan extra copies of Environmental Impact Statements to the public for a twenty-
four hour period per individual, provided they submit a $25.00 deposit for this
privilege; said deposit to be returned when the ElS is returned in good condition.

directs Supervisor Scott L. Harris to execute a Local Government Records Manage-
ment Improvement Fund Grants-ln-Aid Project Application for a requested grant
of $18,384.75, for the continuation of the 1991/1992 Inventory and Planning
Project for Town records through the Town Clerk's Office, for the period of
July 1, 1992 through June 30, 1993.

(more or less) of Screened Sand for the purpose of Ice Control and Highway
Maintenance; said sand to be delivered to the Highway Yard at Peconic, New York.

BOND RESOLUTION OF THE TOWN OF SOUTHOLD, NEW
YORK, ADOPTED FEBRUARY 4, 1992, AUTHORIZING
THE PURCHASE OF A CRAWLER/LOADER FOR THE
SOUTHOLD TOWN LANDFILL, IN CUTCHOGUE, IN THE
TOWN, STATING THE ESTIMATED MAXIMUM COST
THEREOF IS $~0,000, APPROPRIATING SAID AMOUNT
THEREFOR AND AUTHORIZING THE ISSUANCE OF
$70,000 SERIAL BONDS OF SAID TOWN TO FINANCE
SAID APPROPRIATION.
THE TOWN BOARD OF THE TOWN OF SOUTHOLD, IN THE COUNTY OF
SUFFOLK, NEW YORK, HEREBY RESOLVES (by the favorable vote of not
less than two-thirds of all the members of said Town Board) AS FOLLOWS:
Section 1. The Town of Southold, in the County of Suffolk, New York
(herein called "Town"), is hereby authorized to purchase a crawler/loader for
the Southold Town Landfill, in the Town. The estimated maximum cost of said
specific object or purpose, including preliminary costs and costs incidental thereto
and the financing thereof, is $70,000 and said amount is hereby appropriated
therefor. The plan of financing includes the issuance of $70,000 serial bonds
of the ToWn to finance said appropriation, and the levy and collection of taxes
on all the taxable real property in the Town to pay the principal of said bonds
and the interest thereon as the same shall become due and payable.
Section 2. Serial bonds of the Town in the principal amount of $70,000,
are hereby authorized to be issued pursuant to the provisions of the Local Finance
Law, constituting Chapter 33-a of the Consolidated Laws of the State of New
York (hereing call "Law"), to finance said appropriation.
Section 3. The following additional matters are hereby determined and declared:
(a) The period of probable usefulness of said specific object or purpose
for which said $70,000 serial bonds authorized pursuant to this resolution are
to be issued, with the limitations of Section 11.00 a. 28. of the Law, is fifteen
(15) years; provided, however, that the bonds authorized pursuant to this
resolution or bond anticipation notes issued in anticipation of the sale of such
bonds shall mature no later than five (5) years from the date of the original
issuance of bonds or notes heretofore or herein authorized for such object or
purpose.
(b) Current funds are not required by the Law to be provided as a down
payment prior to the issuance of the bonds authorized by this resolution or
any bond anticipation notes issued in anticipation thereof in accordance with
Section 107.00 d. 9.-of the Law.
(c) The proposed maturity of the bonds authorized by this resolution will
not exceed five (5) years.
Section 4. Each of the bonds authorized by this resolution and any bond
anticipation notes issued in anticipation of the sale of said bonds shall contain
the recital of validity as prescribed by Section 52,00 of the Law and said bonds
and any notes issued in anticipation of said bonds, shall be general obligations
of the Town, payable as to both principal and interest by general tax upon
all the taxable real property within the Town within limitation of rate or amount.
The faith and credit of the Town are hereby irrevocably pledged to the punctual
payment of the principal of and interest on said bonds and any notes issued
in anticipation of the sale of said bonds and provision shall be made annually
in the budget of the Town by appropriation for (a) the amortization and redemption
of the bonds and any notes in anticipation thereof to mature in such year and
(b) the payment of interest to be due and payable in such year.

Section 5. Subject to the provisions of this resolution and of the Law and
pursuant to the provisions of Section 30.00 relative to the authorization of the
issuance of bond anticipation notes and of Section 50.00 and Sections 56.00 to
60.00 of the Law, the powers and duties of the Town Board relative to authorizing
bond anticipation notes and prescribing the terms, form and contents and as
to the sale and issuance of the bonds herein authorized and of any bond antici-
pation notes issued in anticipation of said bonds, and the renewals of said bond
anticipation notes, are hereby delegated to the Supervisor, the chief fiscal officer
of the Town.

provisions of the constitution.
Section 7. This bond resolution shall take effect immediately, and the Town
Clerk is hereby authroized and directed to publish the foregoing resolution,
in full, together with a Notice attached in substantially the form prescribed
by §81.00 of the Law in "THE LONG ISLAND TRAVELER-WATCHMAN," a newspaper
published in Southold, New York, and in "THE SUFFOLK TIMES," a newspaper
published in Mattituck, New York, each having a general circulation in the Town
and hereby designated the official newspapers of said Town for such publication.

RESOLVED that the Town Board of the Town of Southold hereby accepts the
bid of Randall's Auto Collision, Inc., Southampton,' New York, for the purchase
of one (1) used 1988 GMC 7000 Dump Truck, at a net delivered price of $12,000.00,
for the Southold Town Hic~hway Department, all in accordance with the bid specifi-
cations, and the recommendation of Superintendent of Highways Jacobs.

Councilman Wickham, Councilman Penny, Supervisor Harris.

14.-Moved by Councilman Penny, seconded by Supervisor Harris, it was
RESOLVED that the Town Board of the Town of Southold hereby authorizes and
directs Supervisor Scott L. Harris to execute an a~reement between the Town
of Southold and retiring Police Sergeant Theodore Bokina ~vhich provides for
compensation of accumulated vacation and sick days, all in accordance with the
agreement as prepared by the Town Attorney.

RESOLVED that the Town Board of the Town of Southold hereby withdraws
approval of Ron Diamond as an Instructor of Basic Magic, and :rrevor Davison
as a Piano Instructor for the 1992 Winter Recreation Program, due to lack of
enrollment.

RESOLVED that the Town Board of the Town of Southold hereby authorizes and
directs Supervisor Scott L. Harris to execute an agreement between the Town
of Southold and the Suffolk County Board of Elections for the use of the Southold
Town Recreation Center, Peconic Lane, Peconic, as an official Polling Place for
the Presidential Primary on April 7, 1992, Primary in September, 1992, General
Election on November 3, 1992, Primary in September, 1993, and General Election
on November 2, 1993.

18.-Moved by Councilman Lizewski, seconded by Supervisor Harris, it was
RESOLVED that the Town Board of the Town fo Southold hereby authorizes and
directs Supervisor Scott L. Harris to execute a "Bill of Sale and Agreement"
between LILCO and the Town of Southold covering the sale of the existing street
lighting facilities to the Town.

be a job that gives the chance for everybody in the town apply for. That's
what that resolution is about.

work proposed to be carried out by the Town pursuant to the report; now,
therefore, be it
RESOLVED that the Town Board of the Town of Southold hereby creates the
Southold Stewardship Task Force and authorizes and directs the Town Clerk to
advertise for candidates to be considered for membership on the said Task Force,
whose initial charge will be to assist the Town Board and Planning Board in
implementing a questionaire to residents of the Town and to screening possible
consultants to the stewardship planning activities, and whose detailed charge
will be provided by the Town Board after a series of meetings are held; and
be it futher
RESOLVED that the Town Board proposes to host five (5) meetingsin different
parts of the Town (Orient, Greenport, Southold, Cutchogue and Mattituck schools)
beginning on or about February 24, 1992, and one Town-wide meeting with the
Town Board at the conclusion of the abovementioned five meetings; and be it

RESOLVED that the Town Board authorizes an expenditure of not more than
$3,500.00 to both publicize and send out a direct mailing regarding these

Water Protection Program have been expended in the Town of Southold to acquire
parcels which have been determined to be eligible for acquisition pursuant to
the criteria of the Program; and
WHEREAS, Suffolk County LeGislature introductory Resolution No. 1074-92 has
been laid on the table by Legislators Jones and Caracciolo, which resolution
authorizes Peconic Land Trust to acquire, on behalf of Suffolk County, some
of these parcels which the Town of Southold has recommended for acquisition;

creating a new Shellfish Committee in Southold Town.

SUPERVISOR HARRIS: In enacting this resolution on January 3rd, the Town
Board did what it had in the past twenty years, do a resolution for n~anagement
employees. However, it's obvious to the Board, after listening to the public,
that the Board made a mistake, and certainly in these tough economic times we
are here representing the taxpayers. Out of respect to what their wishes:are,
and listening to the. ir needs, and their concerns, this Board has responded to
that, has rescinded those increases for those employees at this time, based on
the economy, and based on what your needs, and what we feel you want, as
representatives to you. With that we unanimously supported this resolution,
and we have put it away, and we will move on. It's obvious, as I said, that
no' Board is going to be .perfect, and it's obvious that when a mistake is made
this Board has enough integrity, and enough class and polish to recognize that
fact, and with that we're sending a message out, that these are tough times,
and that we are listening, and we are concerned, and that we do react when
the public tells us a message, we will definitely answer it, and we have done
so with this rescinding of this resolution.

in writing to the Building Inspectors. whose duty it shall
be to enforce all provisions of this chapter, all

electrical provisions of the Building Code applicable to
the Town of Southold and all local laws. ordinances and the
Building Code as referred to in this chapter insofar as any
of the same apply to electrical wiring. The Inspector
shall make inspections and reinspections of electrical
installations in and on properties in the Town of Southold
upon the written request a Building Inspector of the Town
of Southold or as herein provided. The Inspector is
authorized to make inspections and reinspections leading to
the issuance of a certificate of compliance of the New York
Board of Fire Underwriters or any other or~lanization duly
designated by the Town Board of electrical wiring.

permit has been issued by the Building Department of the

SUPERVISOR HARRIS: Are there any members of the audience, that would like
to address this Board on any issue, that you may feel is pertinent at this time?
FRANK CARLIN: I've been here for awhile. Frank Carlin. For the new members
of the Board, I've lived in Laurel for thirty-eight years, married thirty-seven.
The reason I've been married for thirty-seven years, my wife and I have formula.
I tell my wife what to do, and she tells me where to go. I have two issues I'd
like to speak on. I won't take too long. I'd like to close my chapter in my book
on the McDonald issue by saying a few things on it. In Speonk, Handy Pantry
tried to open up a Handy Pantry store in 1990 on the corner of Pulpit, no I'm
sorry, Clappitt and Montauk Highway, and was met by high opposition on the
local residents, and the people, for two reasons. It would create traffic, and
it would be a hangout for teenagers. The Board rejected them. I see now
they're over here in Mattituck. They're going to open up on the corner of
New Suffolk Avenue, and Route 25. It seems to me that one of the issues was
with McDonald's, was McDonald's would create a lot of traffic here. That was
one of the issues. What's going to happen with this, on the corner of New Suffolk
and Route 25? I think we have another double standard here. One more thing
-on this, it's too bad it wasn't put on a proposal on Election Day, so all the
people in'the town could have voted on this issue, like they did the Farm Preser-
vation Proposal One, and let everybody's opinion be known, not just a chosen-
organization. (tape change) We've got problems. I feel when you are elected
by the people, and being paid by the people, that your responsibility to see
that here enough to make the Board meetings. Everybody is entitled to a
vacation, but we should spend more time here, than worry about what's going
on in other countries like Africa, or India. I feel if you can't do this to be
honest to the people, who elected you, than next time don't run. Give somebody
else a chance, who would put enough time on the Board to make the required
meetings. I want to ask you one question, Scott. Judge Edwards, he's a
Councilman, and he's a Judge?
SUPERVISOR HARRIS: He's a Judge.
FRANK CARLIN: He's a Judge. Okay. He's over in Australia, and Hawaii for
two and a half months. Who's minding the store on Fishers Island?
SUPERVISOR HARRIS: There a lot of people over there who mind the store,
believe me.
FRANK CARLIN: Yeah, but he was elected for the job.
SUPERVISOR HARRIS: There's a member of the Zoning Board of Appeals over
there, a member of Planning Board over there, a member of the Bay Constables-
over there, a member of the Highway Department over there.
FRANK CARLIN: He's been elected as a specific elected official, as a Judge.
Everybody's entitled to a vacation. Food for thought. On this talk show of
yours on channel 25, who's sponsoring that?
SUPERVISOR HARRIS: It's paid for by public television channel 25 Cablevision.
FRANK CARLIN: One more thing before I leave. You know, a professional
singer, and I used to be one believe it, or not, has a old standby when you
forget your lyrics, they start to hum. I believe the Town Board, and the
school officials here in this town should start to hum, because they forgot the
lyrics to the taxpayers song, that they're learning here, and the name of that
song is, less taxes, and read my lips for the future. Thank you.

to see what goes on in the town, because I've read so much in the papers, and
I've heard comments from my fellow residents, that I thought it best I come down
here and get it first hand what happens. First of all, what happened here today,
is the money appropriated for the increases that you've now rescinded. That
will go back into the General Fund I assume?
SUPERVISOR HARRIS: Yes, it was always in the General Fund.
JOHN DOHT: The people, who in your process of work scheduled, you've
discontinued certain programs because of insufficient enrollment, and therefore
the money, I guess, e×pend~d for those also?
SUPERVISOR HARRIS: There was no money expended. There was monies
appropriated for instructors of those programs, which we provide as a recreational
service. However, you heard the resolutions where there were no attendance
at these programs, that we're offering by the Town, so we were left with no
choice other that to cancel that program, obviously, .and the instructor that was
set aside for lundin9, obviously, was removed with th'at program. Yes. I'll
turn you over to Joe Lizewski, who chairs the Recreational Department. He'll
explain that to you.
COUNCILMAN LIZEWSKI: In some of those areas you have to make enough money
to keep the program going. The?re self-sufficient. In other words, if you're
getting so much an hour for an instructor, you must have enough people to cover
the cost of the instructor. If you don't have enough people to cover the cost
of the instructor, or it's way under, we don't fund it.
JOHN DOHT: I see, so it's not funded by the Town?
COUNCILMAN LIZEWSKI: No.
JOHN DOHT: Fine. Thank you, very much.
CARL VAIL: I'm Carl Vail. I hold the dubious honor of being the last World
War I veteran in the Town, and I'd like to talk about the safety of this town.
Now, I have a feeling that when I get n a car, that I'm just about endangering
my life, the same as I would be walking down the street in New York City at
night. Now, when you have the highest paid Police Department in the country,
and I believe over 51% of our population are senior citizens, and I think we
deserve the protection, and we're liable to get in so much trouble ourselves,
I think we should have the traffic laws obeyed. Now, our Policemen, everytime
you go out you see them hobnobbing together. It simply shows that they don't
even have enough to do. Now, the biggest complaints on traffic is the guys
that pull up in back of you, tailgating, disregard the double lines, and pass
you on the turns. Life is very uncertain, and there are very few people that
are getting tickets for not putting their lights on during the rain, and making
a left signal. I think our Police should get on the job, and make this a safer
place for us senior citizens to live. As far as drunk drivers, I guess you've
all read the papers about a fellow, who was let off as a drunk driver, and
nineteen hours later he went out and killed somebody. Now, I feel .that we should
have a law, that when a fellow is caught driving drunk, his license and his car
should be confiscated, and when he's up for trial, if there's any damage to the
other person's car, or their lives, his car should be sold to pay the damage for
that. A lot of states have this law, and I think it's time that we had it. Thank
you, very much.
SUPERVISOR HARRIS: Thank you, Mr. Vail, and I'll pass along a copy of these
minutes to the Chief of Police. Is there any member of the audience, that would
like to address this Board? (No response.) If not, I need a motion.
Moved by Councilwoman Hussied, seconded by Councilman Penny, it was
RESOLVED that the Town Board meeting be and hereby is adjourned at 5:00 P.M.
Vote of the Town Board: Ayes: Councilwoman Hussie, Councilman Lizewski,
Councilman Wickham, Councilman Penny, Supervisor Harris.
