REV .RS . APPROV£D
~~p~$ ~ Marjor'~ McDermott, Secretary
After investigation and inspection the Board finds that
applicant requests permission to construct accessory building
(stable) on existing foundation which is not in required rear
yard area on property located on the east side of Billard Road,
Cutchogue. The findings of the Board are that applicant
has a substantial hardship because of the slope of the land
and a thick hedgerow. The Board agrees with the reasoning of
the applicant.
The Board finds that strict application of the Ordinance
would produce practical difficulties or unnecessary hardship;
the hardship created is unique and would not be shared by all
properties alike in the immediate vicinity of this property
and in the same use district; and the variance will not
change the character of the neighborhood, and will observe
the spirit of the Ordinance.
THEREFORE IT WAS RESOLVED, LeRoy and Martha Paul, 240
Billard Road, Cutchogue, New York be GRANTED permission to
construct accessory building (stable) on existing foundation,
as applied for, subject to the following condition:
That if a future owner of the adjoining property
should object to the location of the stable, the
Board of Appeals shall reconsider a new location
for this building.
Vote of the Board: Ayes:- Messrs: Gillispie, Bergen,
Grigonis, Hulse, Doyen.

REASON FOR APPEAL
A Variance to Section 280A Subsection 3
A Variance to the Zoning Ordinance

The barn foundatien wa~ in place before it wa~ ~nown that the
distance back from the lines was to be 50 feet. Also tn~ horse
was arrivirg and we had to have some place to put him.

REASON FOR APPEAL
Con Hnued
1. STRICT APPLICATION OF THE ORDINANCE would produce practicaldifficulti~ orunneces-
:sory HARDSHIP because
The foundation wau!d have 3o be moved and another section of
heS~erow cleared, Also it would mean that the barn would have
to be placed on low ground creating a f!oodim~ problem.
2 The hardship created is UNIQUE and is not s bared by all properties alike in the immediate
vicinity of this property and in this use district because
of the slope of the la~d and the thick hedgerow,
3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because
each lot affected is an acre or ~ore so that 20 feet one way
or another would not make that ~uoh difference.

Dear Mr. Paul:
As per our telephone conversation this morning, I am
semding you necessary applications for a variance for
a reduction of setback for lot lines as required for the
housing of horses. Since you can not meet the fifty feet
as required under Chapter 100 of Zoning Ordinance, a
variance is required before a Certificate of Occupancy
can be issued for building under Building Permit #7658Z
issued December 10, 1974.
The section of Ordinance you will be applying for
variance of is Article III, Sec. 100-30 (C) (5)~ enter
this in Item #2 on application. The next Board of Appeals
hearing will take place in the first half of January, 1975.
To be scheduled for this hearing you must have your applica-
tion into our office before December 19th, next Thursday.
A fee of $15.00 is required for appeal on applying. If I
can be of any further assistance, do not hesitate to call
me.
Yours truly,
