Terry. Absent: Justice Raymond W. Edwards (out-of-country). 1:00 P.M. - The Town Board met to review the proposed resolutions for the 4:00 P.M. Organizational Meeting. EXECUTIVE SESSION 1:35 P.M. On motion of Councilwoman Hussie, seconded by Councilman Penny, it was Resolved that the Town Board enter into Executive Session. ORGANIZATIONAL MEETING 4:00 P.M. The Organization Meeting of the Southold Town Board was held at 4:00 P.M. Friday, January 3, 1992 at the Southold Town Hall, Main .Road, Southold, New York. Edwards SUPERVISOR HARRIS: Welcome to'the Organizational Meeting of the Southold Town Board of January 3, 1992. I'd like to wish each, and everyone of you, a Happy New Year, and to the Board members, congratulations, and the start. JANUARY 3, 1992 255 of the next two years for you is going to be challenging one to say the least. I wish you the best of endeavors, and certainly I hope the people in Southold Town will continue in the fashion, and the mode, that we've had the cooperation and participation in the last;few years of entering in with this Board a partnership for the betterment of Southold Town. I need a reso ution approving the audit of the bills of January 3, 1992. Moved by Councilman Penny, seconded by Councilman Wickham, it was RESOLVED that the following audited bills be and hereby ordered paid: General Fund Whole Town bills in the amount of $13,133.33, General Fund Part Town bills in the amount of $286.10; Nutrition Fund bills in the amount of $900.00; Adult Day Care bills in the amount of $100.00; Southold Agency & Trust bills in the amount of $2,000.00. Vote of the Town Board: Ayes: Councilwoman Hussie, Councilman Lizewski, Councilman Wickham, Councilman Penny, Supervisor Harris. This resolution was declared duly ADOPTED. SUPERVISOR HARRIS: At this time I'd like to do a special presentation for an individual, who has served this Town deligently since 1967, and could I ask Margaret, fondly known "Whip" Thompson to come forth, please. .Whip, this resolution is on behalf of the people of the Town of Southold, and the Town Board, and we'd like to honor you at this time. ) Moved by Supervisor Harris, seconded by The Entire Town Board, WHEREAS, MARGERET "WHIP" THOMPSON, a most esteemed employee of the Town of Southold has retired from public service; and WHEREAS, MARGARET THOMPSON has given generously of her time in her faithful service to the residents of the Town of Southold as a member of the staff of the Receiver of Taxes since December 1, 1967; and WHEREAS, MARGARET THOMPSON'S record of fine service, diligence to duty and dedication to the Town of Southold deserves the sincere gratitude of those with whom and for whom she has served; now, therefore, be it RESOLVED, that the Town Board of the Town of Southold hereby exoresses their msot sincere appreciation to MARGARET THOMPSON for her unselfish and wholehearted cooperation and untiring efforts on behalf of the Town, and extends their best wishes for the years ahead; and be it further RESOLVED, that a copy of this resolution be presented to MARGARET "WHIP" THOMPSON, and entered in the permanent records of this Town Board meeting. SUPERVISOR HARRIS: I need a motion approving the next regularly scheduled Town Board meeting for January 7, 1992 at 4:00 P.M. Moved by Councilman Wickham, seconded by Councilwoman HuSsie, it was RESOLVED that the next regular meeting of the Southold Town Board'will be held at 4:00 P.M., Tuesday,- January 7, 1992, at the Southold Town Hall, Southold, New York. SUPERVISOR HARRIS: As I've said earlier this is our Organizational Meeting, and we shall start our resolutions. Most of these are pro former resolutions, that are done annually. The first appointment is appointing George L. Penny IV as Deputy Supervisor, as he has been for the last two years. George, congratulations. 1.-SUPERVISOR'S APPOINTMENT Supervisor Scott L. Harris hereby appoints George L. Penny IV as Deputy Supervisor of the Town of Southold for the term January 1, 1992 thorugh December 31, 1992. SUPERVISOR HARRIS: The second appointment is Ann Marie Soito as my Confidential Secretary, effective today, 1992. She's been invallu~ble as a staff member for the last two years, part of our administration. 2.-SUPERVISOR'S APPOINTMENT Supervisor Scott L. Harris hereby appoints Ann Marie Soito as Confidential Secretary to the Supervisor, effective January 1, 1992. SUPERVISOR HARRIS: The third appointment is John A. Cushman II as Bookkeeper. Again, an invaluable employee. His title should actually be comptroller, although he can't that. We would certainly love to give him that title. He does a great iob in that respect. 3.-SUPERVISOR'S APPOINTMENT Supervisor Scott L. Harris hereby appoints ~;ohn A. Cushman II as Bookkeeper, effective January 1, 1992. SUPERVISOR HARRIS: The fourth resolution is designating a bank as depositories, and amount of securities. Alice, would you like to lead us off on that. 4.-Moved by Councilwoman Hussie, seconded by Councilman Wickham, WHEREAS, Section 64 of the Town Law requires the Town Board to desiclnate, by resolution, banks in the State in which the Supervisor or other offices of the Town shall deposit all moneys cominq into their hands by virtue of their office; and WHEREAS, the Town Board may require any bank, so designated, to deposit with such Board bonds or certificates of the United States, of the State of New York, or any county, town, city, village or school district of the State of New York, as security for such funds so deposited, but such bond or certificate shall be subject to the approval of the town Board and shall-be deposited in suc~q place and held under such conditions as the Town Board may determine; now therefore, be it RESOLVED that the followinq banks are hereby designated as depostiories, and the following securities are hereby required as collateral for such cash balances in said banks: Norstar Suffolk COunty National Bank Suffolk County National Bank (Tax Receiver's Account only) The North Fork Bank & Trust Company Bridgehampton National Bank Connecticut National Bank $5,000,000.00 $5,000,000.00 $5,000,000.00 $5,000,000.00 $5,000,000.00 $1,000,000.00 AND BE IT FURTHER RESOLVED that authorization for increase and decrease of securities shall be subject to the approval of the Supervisor. 4.-Vote of the Town Board: Ayes: Councilwoman Hussie, Councilman Lizewski, Councilman Wickham, Councilman Penny, Supervisor Harris. This resolution was declared duly ADOPTED. 5.-Moved by Councilman Lizewski, seconded by Supervisor Harris, WHEREAS, Section 11 of the General Municpal Law requires that the Town Board may authorize the Supervisor, the chief fiscal officer of the Town, to invest moneys not required for immediate expenditure; now, therefore, be it RESOLVED that the Supervisor is hereby authorized to deposit or invest moneys not required for immediate expenditure in special time deposit accounts, or certificates of deposit issued by a bank or trust company located and authorized to do business in this State, provided, however, that such time deposit accounts or certificates of deposit shall be payable within such time as the proceeds shall be needed to meet expenditures for which such moneys were obtained, and provided further that such time deposit accounts or certificates of deposit be secured in the manner provided in Section 11 of the General Municipal Law. 5.-Vote of the Tbwn Board: Ayes: Councilwoman Hussie, Councilman [_izewski, Councilman Wickham, Councilman Penny, Supervisor Barris. This resolution was declared duly ADOPTED. 6.-Moved by Councilman Penny, seconded by Supervisor; Harris, it was RESOLVED that the Town Board of the Town of Southold hereby author'zes the use of afac~imile signature to pay all checks, drafts and other nstruments for payment of money drawn upon the accounts of the Town of Southold by SuperVisor Scott L, Harris, except those third party checks, drafts or other instruments in amounts in excess of $5,000.00, drawn on the following banks: Norstar Bank Suffolk County National Bank The North Fork Bank & Trust Company Bridgehampton National Bank Connecticut. National Bank 6.-Vote of the Town Board: Ayes: Councilwoman Hussie, Councilman Lizewski, Councilman Wickham, Councilman Penny, Supervisor Harris. This resolution was declared duly ADOPTED. JANUARY 3, 1992 257 7.-Moved by Councilman Wickhar~, seconded by Supervisor Harris, it was RESOLVED that the Town Board of the Town of Southold hereby grants permission to Supervisor Scott L. Harris to travel to Albany on Town business, as required, throughout the year, and th.e necessary expenses for travel, meals and lodging shall be a legal charge again'st the 1992 Budget. 7.-Vote of the Town Board: Ayes: Councilwoman Hussie, Councilman Lizewski, Councilman Wickham, Councilman Penny, Supervisor Harris. This resolution was declared duly ADOPTED. SUPERVISOR HARRIS: I would like to thank the Board for this resolution. This will help me to continue to fight for the taxpayers of this Town on every front, envi~omentally, as well as economically, to get the most out of the taxpayers' dollars that we are certainlly entitled to in the Town of Southold from the State of New York. 8.-Moved by Councilwoman Hussie, seconded by Councilman Penny, it was RESOLVED that pursuant to Section 24 of the Town Law, the Town Board of the Town of Southold hereby appoints Harvey A. Arnoff as Southotd Town Attorney, effective January 1, 1992, he to hold such office until the first day of January next succeeding the first biennial town election. 8.-Vote of the Town Board: Ayes: Councilwoman Hussie, Councilman Lizewski, Councilman Wickham, Councilman Penny, Supervisor Harris. This resolution was declared duly ADOPTED. 9.-Moved by Councilman Lizewski, seconded by Councilman Penny, it was : RESOLVED that The Long Island Traveler-Watchman, Southold, New York, a news- paper regularly published in the Town of Southold, which has been entered as a second class mail matter, be and the same is hereby designated, effective February 1, 1992, as the official newspaper of the Town of Southold, for the publication of all notices, resolutions, ordinances and other matter required t~ be published. 9.-Vote of the Town Board: Ayes: Councilwoman Hussie, Councilman Lizewski, Councilman Wickham, Councilman Penny, Supervisor Harris. This resolution was declared duly ADOPTED. 3.-Moved by Councilman Penny, seconded by Councilman Wickham, it was RESOLVED that The Suffolk Times, Mattituck, New York, a newspaper regularly published in the Town of Southold, which has been entered as a second class mail matter, be and the same is hereby desi.gnated, effective February 1, 1992, as an addidtion newspaper of the Town of Southold for the publication of all notices, resolutions, ordinances and other matter required to be published. 10.-Vote of the Town Board: Ayes: Councilwoman Hussie, Councilman Lizewski, Councilman Wickham, Councilman Penny, Supervisor Harris. Lizewski, 12.-Moved by Councilman Penny, seconded by Supervisor Harris, it was RESOLVED;that Supervisor Scott L. Harris be and hereby is designated to represent the Town of Southold at the annual meeting of the Association of Towns of the State of New York, to be held in New York City on February. 16, 17, 18, 19, 1992, and to cast the vote of the Town of Southold-'pursuant to Section 6 of Article III of the Constitutio'n and By-Laws of the Association of Towns; and be it further RESOLVED that Alice J. Hussie be and hereby is designated to act as the alternate delegate, to cast the vote of the Town of Southold at the annual meeting of the Association of Towns in the' absence of Supervisor Scott L. Harris. 12.-Vote of the Town Board: Ayes: Councilwoman Hussie, Councilman Lizewski, Councilman Wickham, Councilman Penny, Supervisor Harris. This resolution was declared duly ADOPTED. 258 JANUARY 3, 1992 13.-Moved by Supervisor Harris, seconded by Councilman Penny, it was RESOLVED that those officers and employees of the Town of Southold attending the annual meetinq of the Association of Towns of the State of New York be and hereby are allowed a maximum of $650.00 per officer and employee for the actual and necessary expenses for. registration, travel, meals and lodging incurred while attending said meeting. SUPERVISOR HARRIS: The 1991 allowance was $700.00. This is a reduction in the amount of money that is allowed. This includes the hotel, and the registration fees, which is about 70% of the total funding, and because of these tough fiscal times the Board has gone along with my request to reduce this amount, and I think it's only prudent, although there are only a few employees that do attend t. his conference for the benefit, obviously, of the people they represent, this still should be cost saving measure. 13.-Vote of the Town Board: Ayes: Councilwoman Hussie, Councilman Lizewski, Councilman Wickham, Councilman Penny, Supervisor Harris. This resolution was declared duly ADOPTED. 14.~Moved by Councilwoman Hussie, seconded Councilman Hussie, it was RESOLVED that any Town official, elected or appointed, who is required to use his own automobile in the performance of his duty, shall be compensated for travel expenses necessarily and actually incurred 'n carrying out the duties of his office, at a rate not to exceed twenty cents ($.20) per mile. 14.-Vote of the Town Board: Ayes: Councilwoman Hussie, Councilman Lizeytski, Councilman Wickham, Councilman Penny, Supervisor Harris. This resolution was declared duly ADOPTED. 15.-Moved by Councilman Lizewski, seconded by Councilman Penny, it was RESOLVED that the Town Board of the Town of Southold hereby appoints Richard Noncarrow, bank officer, Suffolk County National Bank, as Deputy Receiver of Taxes for the Town of Southold, effective January 1, 1992 through December 31, 1992, he to serve in said position without compensation. 15.-Vote of the Town Board: Ayes: Councilwoman Hussie, Councilman Lizewski, Councilman Wickham, Councilman Penny, Supervisor Harris. This resolution was declared duly ADOPTED. 16.-Moved by Councilman Penny, seconded by Supervisor Harris, WHEREAS, it is required by Section 27, Subdivision 1 of the Town Law that the Town Board fix, from time to time, the salaries of all officers and employees of the Town, whether elected or appointed, and determine when the same shall be payable and that the salaries of the members of the Town Board, the elected Town Clerk and the elected Superintendent of Highways shall not be fixed in an amount in excess of the amounts respectively specified in the notice of hearing on the preliminary budget published pursuant to Section 108 of the Town Law; now, therefore, be it RESOLVED that the annual salaries of the following elected town officials shall be as follows, to wit: Supervisor Scott L. This resolution was declared duly ADOPTED. 7.-Moved by Supervisor Harris, seconded by Councilman Penny, it was RESOLVED that pursuant to Section 142(1-A) of the Highway Law, the Southold Town Superintendent of Hi.ghways be and he hereby is authorized to ourchase equipment, tools, snow plows and other implements and devices without prior approval of the Town Board in an amount not to exceed $10,000.00 for any one item during the period from January 1, 1992 through December 31, 1992. SUPERVISOR HARRIS: This is in accord, or in a parallel, with the bid specs, that are now required as of January 1, 1992, which are $10,000.00 and less, you don't have to go out to bid for various items. It's obvious why, because the expense on these items now is such that $10,000.00 is still not very much money, when it comes to purchasing equipment of this caliber. Certainly, the Town Board is notified on all purchases in advance whenever a purchase is made for any component for the Town of Southold. 17.-Vote of the Town Board: Ayes: Councilwoman Hussie, Councilman Lize~ski, Councilman Wickham, Councilman Penny, Supervisor Harris. This resolution was declared duly ADOPTED. 18.-Moved by Supervisor Harris, seconded by Councilwoman Hussie, it was RESOLVED by the Town Board of the Town of Southold that the (~ommissioner of Public Works be and he hereby is authorized to purchase necessary supplies and equipment, without prior resolution of the Town Board, in an amount not to exceed $10,000.00 for any item during the period from January 1, 1992 through December 31, 1992. SUPERVISOR HARRIS: Again, this is the same procedure. The bids are $10,000.00 without. Anything above you have to go out to bid, and this allows the Commissioner of Public Works to do so without prior approval. 18.-Vote of the Town Board: Ayes: Councilwoman Hussie, Councilman Lizewski, Councilman Wickham, Councilman Penny, Supervisor Harris. This resolution was declared duly ADOPTED. TOWN CLERK TERRY: As Registrar of Vital Statistics, I hereby appoint Linda J. This resolution was declared duly ADOPTED. 23.-Moved by Councilwoman Hussie, seconded by Councilman Penny, WHEREAS, Section 22B of the Town Law allows the Town Board of any town having more than one Assessor to establish the office of C~airman of the Town Assessors, who, in addition to his regular duties, shall perform such services in connection with assessment and taxation of property for state, county and town purposes as the Board shall direct; now, therefore, be it RESOLVED that Assessor Scott A. Russell be and hereby is designated to hold the office of Chairman of the Board of Assessors until the 31st of December, 1992, at the pleasure of the Town Board, all in accordance with SectiOn 22B of the Town Law; and be it further RESOLVED that the con~pensation for such ~ppointment be fixed at $2,000.00 per annum, payable in regular bi-weekly payments. 23.-Vote of the Town Board: Ayes: Councilwoman Hussie, Councilman Lizewski, Councilman Wickham, Councilman Penny, Supervisor Harris. I feel that with this Groundwater Resources Committee working closely with the Water Advisory Committee, that already exists, that a water policy will be formulated for the future of Southold Town to use and put into effect, that at one point will certainly lead us into decades to come, as far as our groundwater management; and the last resolution is ~50.
