WITNESSETH,that the party of the first part, without consideration paid by the party of the second part, does
hereby grant and release unto the party of the second part,the heirs or successors and assigns of the party of the
second part forever, her respective undivided thirty-three and one third percent(33 1!3%)interests in and to
ALL those certain plots,pieces or parcels of land,with the buildings and improvements thereon erected,situate,
lying and being at Fishers Island, Town of Southold, County of Suffolk and State of New York, being more
particularly bounded and described as Parcel I and Parcel II as set forth on Schedule A hereto.
BEING AND INTENDED TO BE (i) in the case of Parcel I described on Schedule A hereto,the same premises
in which an undivided twenty-five percent interest was conveyed to the party of the first part(then known as Martha
Anne Fell) by deed,dated November 21,1997 and recorded in the Office of the Suffolk County Clerk on December
23,1997 in Liber 11869 page 146 and an undivided eight and one-third percent interest was conveyed to the party
of the first part(as an undivided one-third interest in an undivided twenty-five percent interest), by deed dated
March zo ,2018 and intended to be recorded immediately prior to the recording of this deed,and(ii)in the case
of Parcel II described on Schedule A hereto,the same premises in which an undivided twenty-five percent interest
was conveyed to the.party of the first part(then known as Martha Anne Fell)by deed,dated November 21, 1997
and recorded in the Office of the Suffolk County Clerk on December 23, 1997 in Liber 11869 page 147, and an
undivided eight and one-third percent interest was conveyed to the party of the first part(as an undivided one-third
interest in an undivided twenty-five percent interest),by deed dated March 2o,2018 and intended to be recorded
immediately prior to the recording of this deed,this deed being intended to convey the respective undivided thirty-
three and one-third percent interests of the party of the first part in Parcel I and Parcel II described on Schedule
A hereto.
TOGETHER with all right, title and interest, if any,of the party of the first part in and to any streets and roads
abutting the above described premises to the center lines thereof;TOGETHER with the appurtenances and all the
estate and rights of the party of the first part in and to said premises;TO HAVE AND TO HOLD the premises herein
granted unto the party of the second part, the heirs or successors and assigns of the party of the second part
forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything whereby
the said premises have been encumbered in any way whatever,except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law,covenants that the party of the first
partwill receive the consideration forthis conveyance and will hold the right to receive such consideration as a trust
fund to be applied first for the purpose of paying the cost of the improvement and will apply the same first to the
payment of the cast of the improvement before using any part of the total of the same for any other purpose.The
word"party"shall be construed as if it read"parties"whenever the sense of this indenture so requires.
