AGREEMENT to RELOCATE RIGHT OF WAY
Agreement made this6r—day of April, 2018 by and between Peter Ross Stoutenburgh,
Individually and as Trustee of the Paul Stoutenburgh Irrevocable Trust and, as the Trustee of The
Barbara Stoutenburgh Irrevocable Trust, whose address is 2885 Indian Neck Lane, Peconic, New
York (hereinafter, "Stoutenburgh") and Robert P. Dickerson and Erin P. Dickerson, 1600
Alvah's Lane Cutchogue, New York 11935 (hereinafter"Dickerson").
RECITALS:
WHEREAS, Stoutenburgh is the owner of a certain parcel of land located in the Town of
Southold, County of Suffolk, State of New York, designated as SCTM number: District -1000,
Section - 98, Block - 1, Lot - 6 as more particularly described on Schedule "A" hereto
(hereinafter referred to as "Parcel A"), and
WHEREAS, Dickerson is the owner of a certain parcel of land located in the Town of
Southold, County of Suffolk, State of New York, designated as SCTM number: District -1000,
Section - 98, Block - 1, Lot - 25 and more particularly described on Schedule "B" hereto
(hereinafter referred to as "Parcel B"), and
WHEREAS, Dickerson's predecessors in title, as the owners of Parcel B, granted
Stoutenburgh, as the owner of Parcel A, an Easement upon a portion of Parcel B for ingress,
egress, vehicular access and utility line installation from Billard Road to Parcel A which
Easement as granted is described in an Agreement, dated April 9, 2008, (hereinafter"Easement
Agreement, April 9th, 2008") which was recorded in the Office of the Suffolk County Clerk at
Deed Liber D00012548, Page 368, on April 22, 2008, and
WHEREAS, the parties desire to change the location of the Easement,
NOW THEREFORE, in consideration often dollars ($10.00) Dollars and other good and
valuable consideration, the receipt of which is hereby acknowledged, the parties agree as
follows:
1. That the terms and conditions of the Easement Agreement, dated April 9, 2008, are
confirmed except the physical placement of the Easement is amended and Schedule
C of the Easement Agreement, dated April 9, 2008, is struck and abandoned and the
new"Amended Schedule C", which is attached hereto, is agreed upon and adopted.
Said Easement as described on "Amended Schedule C" is shown on the "Survey of
Property at East Cutchogue, Town of Southold, Suffolk County, N.Y. , dated
January 20, 2005, February 6, 2017, February 21, 2017 (Revisions)".
IN WITNESS WHEREOF, the parties have signed their names hereto on the
date and year above written.

thereon erected, situate, lying and being near Peconic, in the Town of Southold, County of
Suffolk and State of New York, bounded and described as follows:
BEGINNING at a monument at the southeasterly corner of land of Peter Ross
Stoutenburgh,said point of beginning being the northeasterly corner of Lot 4 as shown on "Map
of Hickory Acres" filed in the Suffolk County Clerk's Office as Map No_ 3325, from said point
of beginning running along said land of Peter Ross Stoutenburgh North 33 degrees 31 minutes
50 seconds West, a distance of 247.50 feet to a monument, thence along land of Paulding
Stoutenburgh,Jr. and Barbara Stoutenburgh, two courses,as follows-

Suffolk and State of New York, bounded and described as follows:
BEGINNING at a point on the northerly line of Lupen Drive, 642.38 feet easterly along
said northerly line from Bay Avenue, said point of beginning being the southeasterly corner of
lot 4, "Map of Hickory Acres", filed in the Suffolk County Clerk's Office as Map 43325, from
said point of beginning running along said lot 4,North 17 degrees 58 minutes 40 seconds West—
151.55 feet to a monument and land of The Paul Stoutenburgh Irrevocable Trust, North 58
degrees 42 minutes 10 seconds East -- 411.0 feet to an iron pipe; thence along land of Paul
Stoutenburgh and Barbara Stoutenburgh, two courses:
(1) South 31 degrees 17 minutes 50 seconds East— 166.78 feet; thence
(2) South 58 degrees 42 minutes 10 seconds West — 396.97 feet to a monument at the
intersection of the easterly line of Billard Road with said northerly line of Lupen Drive; thence

BEGINNING at a point along the northerly line of Lupen Drive, 667.64 (642.38 + 25.26) feet
easterly along said northerly line from Bay Avenue and said point also being 25.26 feet easterly
along said northerly line from the southeasterly corner of Lot 4 "Map of Hickory Acres" filed in
the Suffolk County Clerk's Office as Map 43325, and from said point of beginning;
RUNNING THENCE North 17 degreees 58 minutes 44 seconds West, 161.07 feet to land of
Peter Ross Stoutenburgh;
THENCE along the boundary between and the land of Peter Ross Stoutenburgh and the land of
Robert P. Dickerson and Erin P. Dickerson, North 58 degrees 42 minutes 10 seconds East 25.69
