Bradford Burnham III PROPERTY LOCATION: 2464 Peninsula Road(Adj.to West Harbor), Fishers Island SCTM: 1000-10-3-4.1 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated April 20, 2018 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated July 17, 2018. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our recommendation that the proposed action is EXEMPT from Coastal Consistency Review. PROPERTY FACTS/DESCRIPTION: The subject, 29,950 square feet, .625 acre, irregular shaped, waterfront parcel located in the R40 Zoning District measures 234 feet along a private right of way known as Peninsula Road then runs west 90 feet along a residentially developed lot to the south, then runs north 305 feet along the coastline of West Harbor, then runs east 111 feet along a residentially developed lot to the north. The site is developed with a single- family residence and extensive decking with an elevation of approximately 15 feet above sea level, extensive stone retaining wall at the uneven coastline and a substantial fixed dock with float as shown on the site plan prepared by Richard H. Strouse, Licensed Professional Engineer / CME Associates Engineering, Land Surveying&Architecture,PLLC, and dated December 9, 2014. BASIS OF APPLICATION: Request for a Variance from Article III, Section 280-15 and the Building Inspector's February 15, 2018, Notice of Disapproval based on an application for a building permit to construct an accessory garage; at; 1) less than the code required minimum front yard setback of 40 feet; at: 2464 Peninsula Road, (Adj. to West Harbor)Fishers Island,NY. SCTM#1000-10-3-4.1. RELIEF REQUESTED: The applicant requests a variance to construct an accessory single car garage building measuring 16.5 feet by 30.3 feet, with a foundation elevation of 18 feet above sea level and a ridge height of 16.5 feet, in a compliant front yard location with a setback of 5.2 feet where the code requires such structures to be located with a minimum 40 feet front yard setback. Page 2, October 4,2018 #7181, Burnham SCTM No. 10-3-4.1 AMENDED APPLICATION: During the hearing, the applicant was asked to bring the plan into more conformity with the code. The applicant on September 19, 2019 submitted a plan increasing the setback to 12 feet and bringing the plan into more conformity with the codes. ADDITIONAL INFORMATION: No neighbor or member of the public spoke in favor of or against this application. The subject parcel is the beneficiary of a prior variance, file#1149, dated October 26, 1967, allowing road access to the site. The property is partially wooded, well screened by mature landscaping from the private right of way, and slopes precipitously towards West Harbor. Moreover, the Coastal Erosion Hazard Line bisects the property. The applicant submitted ZBA decision # 6393, issued November 18, 2010, permitting 21.6% lot coverage and maintenance of a 5 feet front yard setback, to allow for alterations and additions to a neighboring single-family residence on Peninsula Road, to support their application. The applicant indicated on the application that the proposed garage will be unheated with no plumbing and limited electrical service. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on September 6, 2018 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law §267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. While the lot remains partially wooded, with substantial distances to neighboring homes, there will be no immediate or adverse or visual impact on the general community resulting from mature landscaping along the road and the natural, rugged terrain of Fishers Island. Moreover,there are immediate homes in the general vicinity, built prior to zoning, that share similar hardship or have structures located in less than code conforming locations; such properties are characteristic of the development of Fishers Island, where a garage is a customary accessory structure to a residence. The proposed accessory garage is in keeping with the scale of the immediate waterfront neighborhood. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. Considering the sloping terrain of the subject property, the small size of the irregular-shaped parcel, the location of the residence, and the close proximity of both the Coastal Erosion Hazard Line and the Department of Environmental Conservation setback requirements, the applicant has limited possibility to place an accessory garage in a conforming location, without the loss of a small open lawn area. 3. Town Law §267-b(3)(b)(3). The variance granted herein is mathematically substantial, representing 70% relief from the code. However, the proposed structure is screened from the private right of way,with limited use by neighbors, by mature landscaping and is not visible from West Harbor, as a result of the natural terrain and woodlands to the south and southwest on the subject property. 4. Town Law §267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. Grant of the relief AS AMENDED, for a 12 feet front yard setback, is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an accessory garage structure measuring 16.5 feet by 30.3 feet, with a ridge height of 16.5 feet while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Planamento, seconded by Member Weisman (Chairperson), and duly carried, to GRANT the variance AS AMENDED and shown on the site plan prepared by Mary C. Burnham, R.A., and revised September 19, 2018. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3) years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1)year terms. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated May 14, 2010.stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. . LWRP: This application was referred for reviewed under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued his reply dated July 26, 2010, based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our recommendation that the proposed action is CONSISTENT with LWRP policy standards and therefore is CONSISTENT with the LWRP. PROPERTY FACTS/DESCRIPTION: The Applicant's property is an 11,278 sq. ft. non-conforming waterfront parcel in the R-40 District. The northerly lot line measures 117+/- feet along adjacent residential property. The Easterly lot line measures 100+/- feet along a salt water bay known as Darby's Cove. The Southerly lot line measures 104+/-feet along adjacent residential property, and the Westerly lot line measures 100 +/- feet along a private right of way. The property is improved with two [2] existing seasonal single family dwellings, two [2] accessory sheds, and two [2] docks which provide watercraft access to Darby's Cove. The existing improvements and the Applicant's proposed improvements, including an"as built"shed, are shown on the site survey prepared by CME Associates Engineering,Land Surveying&Architecture,PLLC, and dated May 2,2009. BASIS OF APPLICATION: Request for Variances from Code Sections 280 Code Sections 280-122A and 280- 124, based on an application for building permit and the Building Inspector's March 18,2010 Notice of Disapproval,Amended July 20,2010, concerning additions to one of two existing seasonal dwellings, 1)proposed addition is not permitted, it shall create new nonconformance or increase the degree of nonconformance,2)lot coverage at more than the code required maximum of 20%. The proposed new lot coverage is 21.6%. In addition,the"as built" 12ft.x8ft. shed is not permitted pursuant to 280-15[F] which permits a front yard location on waterfront parcels with a front yard principal setback. The existing shed is setback 5+/-feet when 35 feet is required. Page 2—November 16,2010 ZBA File46393-McNamara CTM- 1000-104-12 3 RELIEF REQUESTED: The applicant originally requested the variance relief necessary to create new nonconformance and increase the degree of nonconformance, by proposing to construct additions to one of two existing seasonal residential dwellings on the property. The proposed new construction included a 14.5 ft. x 8 ft. bedroom addition and a proposed 20.5 ft x 8 ft enclosed porch which would increase the lot coverage to 21.6% where the code allows a maximum of 20% lot coverage. Further, the Applicant is requesting a 5+/- front yard setback for an existing an"as built"shed where the code requires 35 feet. AMENDED APPLICATION: During the July 29,2010 hearing,the applicant was asked to bring the site plan into more conformity with the Code and to address the concerns noted in a neighbor's letter dated July 22, 2010. The Applicant subsequently submitted a letter dated Oct. 4, 2010, stating their intention to not pursue a variance for construction of additions but to only pursue the variance relief for the existing shed. The Applicant appeared at the continuation of the Public Hearing held on Oct. 21, 2010, and formally withdrew the request for any and all variance relief with regard to the proposed additions, which the Applicant had decided not to construct. The Applicant retained the request for variance relief with regard to the location of the "as built" shed with a non- conforming 5 foot front yard setback,therefore bringing the revised site plan into more conformity with the code. ADDITIONAL INFORMATION: An adjacent neighbor submitted a letter dated July 22, 2010 which stated their objections to the Applicant's proposed new construction. At the Public Hearing held on Oct. 21, 2010, the Applicant told the ZBA that because of a change in the family members situation they no longer needed to construct the proposed additions. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on July 29,2010,and continued the public hearing ori Oct.21,2010,at which time written and oral evidence were presented. Based upon all testimony, documentation,personal inspection of the property,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: On the basis of testimony presented, materials submitted and personal inspections, the Board makes the following findings: 1. Town Law 4267-b(3)(b)(1). Grant of the variance for the 5 foot front yard setback for the"as built"shed will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The shed is located adjacent to a dead end private right of way utilized by the Applicant and several neighbors. It is well screened from public view by natural vegetation 2. Town Law§267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method,feasible for the applicant to pursue, other than an area variance. Considering the sloping terrain on the property, the small size of the parcel, the location of the other structures, and the close proximity to the driveway, the Applicant needed to situate the shed within a very confined area,and therefore with such a non-conforming front yard setback in relation to the private right of way. 3. Town Law §267-b(3)(b)(3). The variance granted herein is substantial, and is an 85+% reduction from the code required 35 foot setback. However,due to the topography and existing setback of the houses to the water,the current location of the shed which is landward of the existing houses causes the least impact on the cove. 4. Town Law §267-b(3)(b)(4). No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood.The shed is screened from the private right of way by landscape plantings and natural vegetation. The private right of way has limited use by a small number of residents. 5. Town Law &267-b(3)(b)(5). The difficulty has been self-created since the Applicant built the shed without applying for a building permit or a variance for the reduced setback prior to the construction, Page 3—November 16,2010 ^ ZBA File#6393-McNamara CTM 1000-104-123 6. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of an "as built" shed with a nonconforming front yard setback,while preserving and protecting the character of the neighborhood and the health,safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Dinizio, seconded by Member Weisman (Chairperson),and duly carried,to GRANT,the variance for the as built shed(ONLY)as applied for, and shown on the site survey prepared by CME Associates Engineering,Land Surveying&Architecture, PLLC, and dated May 2,2009. Conditions: The shed shall be used for storage only. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey,site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit,and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance given such as extensions,or demolitions which are not shown on the applicant's diagrams or survey site maps,are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code,other than such uses,setbacks and other features as are expressly addressed in this action. He suggests that the overhang be reduced by two feet, since the code allows a two feet overhang as conforming.
