IN WITNESS WHEREOF,the said Board of Trustees hereby causes its Corporate Seal to be affixed, and these presents to be subscribed by a majority of the said Board as of as of the 19'h day of September,2018. -3 TERMS AND CONDITIONS The Permittee Nitin P Desai &C Barsi LLC residing at 18915 Soundview Avenue, Southold, New York, as part of the consideration for the issuance of the Permit does understand and prescribe to the following: 1. That the said Board of Trustees and the Town of Southold are released from any and all damages, or claims for damages, of suits arising directly or indirectly as a result of any operation performed pursuant to this permit, and the said Permittee will, at his or her own expense, defend any and all such suits initiated by third parties, and the said Permittee assumes full liability with respect thereto,to the complete exclusion of the Board of Trustees of the Town of Southold. 2. That this Permit is valid for a period of 24 months,which is considered to be the estimated time required to complete the work involved, but should circumstances warrant, request for an extension may be made to the Board at a later date. 3. That this Permit should be retained indefinitely, or as long as the said Permittee wishes to maintain the structure or project involved,to provide evidence to anyone concerned that authorization was originally obtained. 4. That the work involved will be subject to the inspection and approval of the Board or its agents, and non-compliance with the provisions of the originating application may be cause for revocation of this Permit by resolution of the said Board. 5. That there will be no unreasonable interference with navigation as a result of the work herein authorized. 6. That there shall be no interference with the right of the public to pass and repass along the beach between high and low water marks. 7. That if future operations of the Town of Southold require the removal and/or alterations in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the work shall cause unreasonable obstruction to free navigation,the said Permittee will be required,upon due notice,to remove or alter this work project herein stated without expenses to the Town of Southold. 8. That the said Board will be notified by the Permittee of the completion of the work authorized. 9. That the Permittee will obtain all other permits and consents that may be required supplemental to this permit,which may be subject to revoke upon failure to obtain same. 10. No right to trespass or interfere with riparian rights. This permit does not convey to the permittee any right to trespass upon the lands or interfere with the riparian rights of others in order to perform the permitted work nor does it authorize the impairment of any rights, title, or interest in real or personal property held or vested in a person not a party to the permit. BARSI, LLC 18915 SOUNDVIEW AVENUE, SOUTHOLD SCTM# 1000-51-1-15 Dear Mr. Herrmann: The Board of Town Trustees took the following action during its regular meeting held on Wednesday, September 19, 2018 regarding the above matter: WHEREAS, En-Consultants on behalf of NITIN P. DESAI & C. BARSI, LLC, applied to the Southold Town Trustees for a permit under the provisions of Chapter 275 of the Southold Town Code, the Wetland Ordinance of the Town of Southold, application dated August 6, 2018, and, WHEREAS, said application was referred to the Southold Town Conservation Advisory Council and to the Local Waterfront Revitalization Program Coordinator for their findings and recommendations, and, WHEREAS, the LWRP Coordinator issued a recommendation that the application be found Consistent with the Local Waterfront Revitalization Program policy standards, and, WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on September 19, 2018, at which time all interested persons were given an opportunity to be heard, and, WHEREAS, the Board members have personally viewed and are familiar with the premises in question and the surrounding area, and, WHEREAS, the Board has considered all the testimony and documentation submitted concerning this application, and, 2 WHEREAS, the structure complies with the standards set forth in Chapter 275 of the Southold Town Code, WHEREAS, the Board has determined that the project as proposed will not affect the health, safety and general welfare of the people of the town, NOW THEREFORE BE IT, RESOLVED, that the Board of Trustees have found the application to be Consistent with the Local Waterfront Revitalization Program, and, RESOLVED, that the Board of Trustees APPROVE the application of NITIN P. DESAI & C. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my recommendation that the proposed action is CONSISTENT with the LWRP policies and therefore CONSISTENT with the LWRP. This recommendation is made with consideration of: a. Past Zoning Board of the Appeals and Board of Trustees decisions and mitigation. Pursuant to Chapter 268, the Board of Trustees shall consider this recommendation in preparing its written determination regarding the consistency of the proposed action. RELIEF REQUESTED: The applicant requests a variance to construct a proposed 16 foot by 32 foot in-ground swimming pool at 75 feet from the top of the bluff where the code requires a minimum setback of 100 feet from the top of the bluff, as shown on the Survey/Site Plan prepared by David Saskas, L.S., last revised April 9, 2014 to show building to be removed. ADDITIONAL INFORMATION: The existing one story dwelling and one story frame building exist within the 100 foot top of bluff setback and are proposed to be demolished and removed. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on June 5,2014 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood,and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. _Town Law $267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. In-ground swimming pools are characteristic to this residential neighborhood and the two adjoining parcels each have an in-ground swimming pool with non- conforming top of bluff setbacks. 2. Town Law &267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The new dwelling is proposed at a code conforming 100 foot top of bluff setback, therefore any proposed construction between the new dwelling and the top of bluff will require a top of bluff setback variance. If the applicant were to move the proposed pool,new dwelling and garage to the south so that the proposed pool could have a conforming top of bluff setback, then the proposed garage would require a front yard setback variance relief of approximately 25 feet or 62%, which would be more substantial than the requested top of bluff setback variance for the proposed in-ground swimming pool. 3. Town Law§267-b(3)(b)(3). The variance granted herein is mathematically substantial,representing 25%relief from the code.However, the design of the overall site redevelopment will provide an improvement to the physical and environmental conditions through a net reduction in the property's existing degree of nonconformance with respect to the top of bluff setbacks of the existing dwelling and frame building. 4. Town Law &267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law §267-b(3)(b)(5). The difficulty has been self-created. Because the property could be redeveloped without the benefit of an in-ground swimming pool, the variance relief necessitated by the proposed pool is self- created. 6. Town Law &267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of constructing an in-ground swimming pool having a 75 foot top of bluff setback, while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. The proposed swimming pool, which was previously approved in 2014 pursuant to recently expired Wetlands Permit No. 8468, is part of a larger site redevelopment design that will provide an improvement to the environmental condition of the site, including the adjacent bluff,beach, and tidal waters,through an increase in the property's bluff setbacks and the project's incorporated mitigation measures. Specifically, the site is presently characterized by a single family dwelling located 48 feet from the bluff crest with no drainage system to collect roof runoff, an antiquated septic system located 36 feet from the bluff, and a lawn that extends to the edge of the bluff. The proposed redevelopment plan seeks to remove these existing structures and situate all new construction except for the proposed swimming pool at or beyond the limit of Chapter 275 jurisdiction, as recently approved pursuant to Administrative Wetlands Permit No. 9222A. The proposed pool, which has been authorized by the ZBA pursuant to Decision No. 6750, would be located 75' from the bluff crest and more than 150 feet from the surface waters and littoral zone tidal wetlands of Long Island Sound. As mitigation for the project, a temporary project limiting fence and staked haybales would be set in place to control and contain site disturbance during construction; a permanent, dedicated drywell would be installed to contain pool backwash; and a 15'wide, approximately 1,500 sf non-turf buffer adjacent to the bluff crest, which can serve both as a sink and filter for stormwater runoff and contaminants, was already covenanted in connection with prior Wetland Permit No. 8468 for the proposed pool. Such authorization was originally granted in the_form of two approvals: Administrative Wetlands Permit No. 8417A, which was issued f6r the demolition and new dwelling construction on May 21, 2014, and extended twice through May 21, 2018; and Wetlands Permit 8468, which was issued for the swimming pool on July 23, 2014, and extended twice through July 23, 2018. As I explained when I wrote to you a few months ago in connection with our application for a new administrative wetlands permit for the proposed dwelling, we had hoped to complete work on the swimming pool before Wetlands Permit 8468 expired in late July. However, since the Building Department would not issue a building permit for the proposed pool without simultaneously issuing demolition and building permits for the new dwelling, the applicants unfortunately did not have enough time to secure those approvals and commence construction of the pool before July 23 rd Therefore, since the previously issued wetlands permit for the proposed swimming pool cannot be extended further, we are attaching herewith an application for a new wetlands permit for the same proposed swimming pool that was previously approved. Please note that both the application and site plan make reference to the proposed dwelling and its authorization pursuant to recently issued Wetlands Permit No. 9222A. The site plan also depicts and labels the covenanted 15' non-turf buffer adjacent to the bluff crest, which was required as a condition of issuance Wetlands Permit No 8468. A copy of ZBA Decision No. 6750, which grants the necessary variance relief for the pool, is also attached to our application.
