COUNCILMAN GHOSIO: NOTICE IS HEREBY there has been presented to the Town
Board of the Town of Southold, Suffolk County,New York, on the 81h day of August,2018, a
Local Law entitled "A Local Law in relation to Amendments to Chapter 280, Hamlet
Density Residential District" and
NOTICE IS HEREBY FURTHER GIVEN that the Town Board of the Town of Southold will
hold a public hearing on the aforesaid Local Law at the Southold Town Hall, 53095 Main Road,
Southold,New York, on the 28th day of August, 2018 at 7:31 p.m. at which time all interested
persons will be given an opportunity to be heard.
The proposed Local Law entitled, "A Local Law in relation to Amendments to Chapter 280,
Hamlet Density Residential District" reads as follows:
LOCAL LAW NO. 2018
A Local Law entitled, "A Local Law in relation'to Amendments to Chapter 280,Hamlet
Density Residential District".
BE IT ENACTED by the Town Board of the Town of Southold as follows:
§ 280-20 Purpose.
The purpose of the Hamlet Density (HD) Residential District is to permit a mix of housing types
and level of residential density appropriate to the areas in and around the major hamlet centers,
particularly Mattituck, Cutchogue, Southold, Orient and the Village of Greenport

§ 280-21 Applicability.
The Hamlet Density (HD) Residential District may be designated on the Zoning Map by the
Town Board upon its own motion or by petition on parcels located on Fishers Island, or within
1/2 mile of a Hamlet Business (HB) District of Mattituck, Cutchogue and Southold Hamlet, or
and-within 1/4 mile of the Hamlet Business (HB) District of Orient, or and within 1/2 mile of the
boundary of the Village of Greenport.
§ 280-22 Use regulations.
In the HD District, no building or premises shall be used and no building or part of a building
shall be erected or altered which is arranged, intended or designed to be used, in whole or in part,
for any use except the following:
A. Permitted uses.
(1) One-family detached dwellings, subject to residential site plan approval for more
than one such structure per lot. [Amended 3-28-2006 by L.L. No. 5-20061
(2) Two-family dwellings, subject to residential site plan approval for more than one
such structure per lot. [Amended 3-28-2006 by L.L. No. 5-20061
(3) Multiple dwellings, townhouses, row or attached dwellings, subject to residential
site plan approval. [Added 3-28-2006 by L.L. No. 5-20061
III. SEVERABILITY
If any clause, sentence,paragraph, section, or part of this Local Law shall be adjudged by any
court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this law
as a whole or any part thereof other than the part so decided to be unconstitutional or invalid.
IV. EFFECTIVE DATE
This Local Law shall take effect immediately upon filing with the Secretary of State as provided
by law.
I do have here a copy and a notarized letter that this has been advertised on the Town Clerk's
bulletin board and the town website. I also have a notarized affidavit that this was advertised in
the Suffolk Times. I do have a letter here from the Fishers Island Utility Company that they
support this application. I have a memorandum from the members of the Planning Board also
supporting the code amendment. This is a letter on behalf of the Island Community Board on
Fishers Island, writing to support the change that would allow Southold Town Board to consider
designating parcels as HD based on petitions from Fishers Island and that's all I have.
SUPERVISOR RUSSELL: Would anybody like to address the Town Board on this local law?
JUSTICE EVANS: You don't want to speak on behalf of the utility company, Tom?
TOM STEVENS: I am Tom Stevens from the Fishers Island Utility Board, I am a director and
vice president. As already noted, we have submitted a formal letter just explaining our position,
we are very supportive of this and the only additional point I would like to make is that we look

forward to working with the Planning Board and the Town Board so that this option to create
hamlet density housing is used for primary residents of Fishers Island. We are not focused on
more seasonal housing, what we need is more year round housing and we look forward to
finding a way to make sure that this change is used for that purpose. Thank you.

County,New York, on the 81h day of August, 2018, a Local Law entitled "A Local Law in
relation to Amendments to Chapter 280, Hamlet Density Residential District" and
WHEREAS the Town Board of the Town of Southold held a public hearing on the aforesaid
Local Law at which time all interested persons were given an opportunity to be heard, now
therefor be it
RESOLVED that the Town Board of the Town of Southold hereby ENACTS the proposed Local
Law entitled, "A Local Law in relation to Amendments to Chapter 280, Hamlet Density
Residential District" reads as follows:
LOCAL LAW NO.11 2018
A Local Law entitled, "A Local Law in relation to Amendments to Chapter 280, Hamlet
Density Residential District".
BE IT ENACTED by the Town Board of the Town of Southold as follows:
§ 280-20 Purpose.
The purpose of the Hamlet Density (HD) Residential District is to permit a mix of housing types
and level of residential density appropriate to the areas in and around the major hamlet centers,
particularly Mattituck, Cutchogue, Southold, Orient and the Village of Greenport
§ 280-21 Applicability.
The Hamlet Density (HD) Residential District may be designated on the Zoning Map by the
Town Board upon its own motion or by petition on parcels located on Fishers Island, or within
1/2 mile of a Hamlet Business (HB) District of Mattituck, Cutchogue and Southold Hamlet, or
and-within 1/4 mile of the Hamlet Business (HB) District of Orient, or and within 1/2 mile of the
boundary of the Village of Greenport.
§ 280-22 Use regulations.
In the HD District, no building or premises shall be used and no building or part of a building
shall be erected or altered which is arranged, intended or designed to be used, in whole or in part,
for any use except the following:

A. Permitted uses.
(1) One-family detached dwellings, subject to residential site plan approval for more
than one such structure per lot. [Amended 3-28-2006 by L.L. No. 5-20061
(2) Two-family dwellings, subject to residential site plan approval for more than one
such structure per lot. [Amended 3-28-2006 by L.L. No. 5-20061
(3) Multiple dwellings, townhouses, row or attached dwellings, subject to residential
site plan approval. [Added 3-28-2006 by L.L. No. 5-2006]
III. SEVERABILITY
If any clause, sentence, paragraph, section, or part of this Local Law shall be adjudged by any
court of competent jurisdiction to be invalid, the judgment shall not affect the validity of this law
as a whole or any pari thereof other than the part so decided to be unconstitutional or invalid.
IV. EFFECTIVE DATE
This Local Law shall take effect immediately upon filing with the Secretary of State as provided
by law.

Dear Town Board,
On behalf of the Island Community Board, I am writing in support of the change to 2018-
737/280-21 that would allow the Southold Town Board to consider designating parcels as
HD (Hamlet Density) based on petitions from Fishers Island.
Our community needs additional housing in order to strengthen our winter population
and its work force. To this end, the ICB has been facilitating a thoughtful exploration of
every available option for expanding housing on island - including apartments and
multiple-dwelling units - in ways that would most benefit our community as a whole. As
a representative body, we aim to work closely and collaboratively with all island entities
considering development so that the best outcome for all Islanders is reached.
The ICB believes that 280/21 - and the possibilities it would open for us -- would be a
step toward fulfilling our overall strategy for renewal on Fishers.

We greatly appreciate the Town Board's understanding or our need to build more year-
round housing for utility operations staff and to do so as cost-effectively as possible for
the sake of our ratepayers. Our thanks go to Scott Russell, the other members of the
Board and Bill Duffy for working with us to develop a route to multi-family housing
through the proposed amendment to the Zoning Code, Chapter 280, Hamlet Density
Residential District. We expect to be the first to take advantage of the amendment, if it
passes, by petitioning for a change of zoning to HD on the lot known as the Briar Patch.
Success will enable us to build a two-family dwelling, a major step forward for us since
our hiring practices are constrained by a lack of any spare housing for staff with families.
We note that the broader goal of this amendment is to help promote a sustainable year-
round community on Fishers Island by enabling the creation of housing that,compared to
single-family houses, is more affordable to build and operate and uses land, a precious
commodity on an island, more efficiently. In order to achieve this policy goal, which is
very strongly supported on Fishers Island, it will be critical to protect any multi-family
dwellings in a new HD zone from the press of demand for seasonal housing.
Accordingly, we look forward to working with the Town Board and the Planning Board
on devising a procedure to ensure that any future grant of HD re-zoning for a lot on
Fishers Island comes with the condition that multi-family housing on that lot is restricted
to primary residents of Fishers Island.
Again, thank you for your thoughtful and timely support in this important housing
initiative.

§280-21 Applicability

ject to residential site plan approval for more
than one such structure per lot.

HI. SEVERABILITY
If any clause,sentence,paragraph,section,or
pan of this Local Law shall be adjudged by
any court of competent jurisdiction to be in-
valid,the judgment shall not affect the valid-
ity of this law as a whole or any part thereof
other than the part so decided to be unconsti-
tutional or invalid
IV. EFFECTIVE DATE
This Local Law shall take effect immediately
upon filing with the Secretary of State as
provided by law.

BE IT ENACTED by the Town Board of the Town of Southold as follows:
§ 280-20 Purpose.
The purpose of the Hamlet Density (HD) Residential District is to permit a mix of housing types
and level of residential density appropriate to the areas in and around the major hamlet centers,
particularly Mattituck, Cutchogue, Southold, Orient and the Village of Greenport
