McBride Dev Rights Easement Acquisition, SEQRA
WHEREAS, the Town Board of the Town of Southold held a public hearing on the question of
the purchase of a development rights easement on a certain parcel of property owned by Richard
James McBride and James Michael McBride on the 11th day of September, 2018, at which time
all interested parties were given the opportunity to be heard; and
WHEREAS, said property is identified as part of SCTM #1000-83.-2-16. The address is 10725
Oregon Road in Cutchogue. The property is located in the Agricultural-Conservation (A-C)
Zoning District and is situated on the northerly side of Oregon Road approximately 1200 west of
Cox's Lane in Cutchogue,New York; and
WHEREAS, the proposed acquisition is for a development rights easement on a part of the
property consisting of approximately 24.51 acres (subject to survey) of the 31± acre parcel. The
exact area of the acquisition is subject to a Town-provided survey acceptable to the Land
Preservation Committee and the property owners; and
WHEREAS, the easement will be acquired using Community Preservation Funds. The purchase
price is $67,500 (sixty-seven thousand five hundred dollars) per buildable acre, estimated at
$1,653,750 (one million six hundred fifty-three thousand seven hundred fifty dollars) for the
24.5± acre easement. Purchase price will be adjusted at time of closing based on final survey
acreage determination, plus acquisition costs.
WHEREAS, the property is listed on the Town's Community Preservation Project Plan List of
Eligible Parcels as property that should be preserved due to its agricultural value; and
WHEREAS, the purchase of the development rights on this property is in conformance with the
provisions of Chapter 17 (Community Preservation Fund) and Chapter 70 (Agricultural Lands
Preservation) of the Town Code, and
WHEREAS, the proposed action has been reviewed pursuant to Chapter 268 (Waterfront
Consistency Review) of the Town Code and Local Waterfront Revitalization Program
("LWRP") and the LWRP Coordinator has recommended that this action is consistent with the
LWRP; and
WHEREAS, the Land Preservation Committee has reviewed the application for the acquisition,
and recommends that the Town Board acquire the development rights easement; and
WHEREAS, the Town Board deems it in the best public interest that the Town of Southold
purchase the development rights on this agricultural land; and,

WHEREAS, the Town Board of the Town of Southold classifies this action as an Unlisted
Action pursuant to the SEQRA Rules and Regulations, 6NYCRR 617.1 et. Seq.; and,
WHEREAS, the Town of Southold is the only involved agency pursuant to SEQRA Rules and
Regulations; and,
WHEREAS, the Town Board of the Town of Southold accepted the Short Environmental Form
for this project that is attached hereto; now, therefore, be it
RESOLVED that the Town Board of the Town of Southold hereby finds no significant impact
on the environment and declares a negative declaration pursuant to SEQRA Rules and
Regulations for this action; and, be it further
RESOLVED that the Town Board of the Town of Southold hereby elects to purchase a
development rights easement on agricultural land owned by Richard James McBride and James
Michael McBride, identified as part of SCTM #1000-83.-2-16. The proposed action has been

COUNCILMAN RULAND: As some of you know, I am going to have to recuse myself on this
because there is a conflict of interest between myself and this project.
SUPERVISOR RUSSELL: I have just a quick comment, a lot of time people ask me how much
land has the Town preserved? A lot of references to town preserved, the reality is, the Town is
not preserving this land, the land owners are. And I want to thank Jim and Richie for
participating in this process and ensuring that this prime farmland is preserved in perpetuity.

COUNCILMAN GHOSIO: NOTICE IS HEREBY RESOLVED that pursuant to the provisions
of Chapter 17 (Community Preservation Fund) and Chapter 70 (Agricultural Lands) of the Town
Code, the Town Board of the Town of Southold hereby sets Tuesday, September 11, 2018, at
4:31 p.m., Southold Town Hall, 53095 Main Road, Southold, New York as the time and
place for a public hearing for the purchase of a development rights easement on property
owned by Richard James McBride and James Michael McBride. Said property is identified
as part of SCTM #1000-83.-2-16. The address is 10725 Oregon Road in Cutchogue. The
property is located in the Agricultural-Conservation (A-C) Zoning District and is situated on the
northerly side of Oregon Road approximately 1200 feet west of Cox's Lane in Cutchogue, New
York. The proposed acquisition is for a development rights easement on a part of the property
consisting of approximately 24.5± acres (subject to survey) of the 31± acre parcel.

The exact area of the acquisition is subject to a Town-provided survey acceptable to the Land
Preservation Committee and the property owners. The easement will be acquired using
Community Preservation Funds. The purchase price is $67,500 (sixty-seven thousand five
hundred dollars) per buildable acre, estimated at $1,653,750.00 (one million six hundred fifty-
three thousand seven hundred fifty dollars) for the 24.5± acre easement. Purchase price will be
adjusted at time of closing based on final survey acreage determination, plus acquisition costs.
The property is listed on the Town's Community Preservation Project Plan as property that
should be preserved due to its agricultural value.
FURTHER NOTICE is hereby given that a more detailed description of the above mentioned
parcel of land is on file in Land Preservation Department, Southold Town Hall Annex, 54375
Route 25, Southold, New York, and may be examined by any interested person during business
hours.
I have here a signed affidavit that this has been noticed on the Town Clerk's bulletin board and
on the town's website. Also it has been noticed in the Suffolk Times. I have a memorandum
from the Local Waterfront Revitalization Program stating that this has been issued a negative
declaration from SEQRA and that's it.

MELISSA SPIRO: Melissa Spiro, Land Preservation Coordinator. Hi, good afternoon. I won't
repeat all the information but I would just like to point out about the farm, the farm is shown in
red on the map in front. The excluded areas shown by the white broken line. The Land
Preservation Committee makes recommendations to the Town Board regarding agricultural
property for preservation. Once the landowners decided to offer this easement area shown on the
map, the committee had no hesitation in recommending preservation of this particular farm. The
farm includes over 95% prime agricultural soils, it expands an existing block of 100 acres
directly to the east of other preserved farmland, active farmland. The white labels on the map
are indicating other properties that are preserved through the county or town agricultural
preservation programs. And within one mile of this farm, there are over 20 protected farms
totaling over 400 acres, so it is a really important piece to expand that preserved block. The
McBride's and I have talked on and off about preserving their farmland for many years and I
would really like to express my thanks to the McBride family members for allowing the town to
work with them to preserve their farm. Preservation of this farm is supported by the Land
Preservation Committee and it is recommended that the Town Board proceed with this
important project. Thank you.

COUNCILMAN RULAND: Yes. Since the project is over, Melissa spirited the map away so I
will adlib. Scott had touched on some of the things and Melissa touched on some, I had the
privilege very recently to travel to another part of this country, to be in the farmland and to talk
to the people and understand how much they value their farmland and their way of life. Even
though North Dakota is a tremendously different area than the Town of Southold, the principal is
very much the same, that all those preserved parcels and the one that the McBride family has
graciously participated in to add to that, form the very fabric of our community and sometimes,
as the Supervisor just said,people just say you are preserving it, well, no, the landowners have
decided that they feel that the best use of this is going to be farming from now thereafter. And as
a farmer, I find that very heartwarming. We all know and we have discussed very recently, how
agriculture is changing but one of the things that we must never forget that whether we live here
or somewhere else,that the production of food and fiber is something this country needs
tremendously. And with that I offer my thanks to Jimmy who is in the audience and your family
