Wickham, Councilman Joseph J. Lizewski, Councilwoman Alice J. Hussie. Justice Raymond W. Edwards - 3:15 P.M. Also present: Town Attorney Harvey A. Arnoff, Assistant Town Attorney Matthew G. Kiernan, Town Clerk Judith T. Terry. 10:00 A.M. - For Discussion Items: (1) Request from Mary E. Kennedy for a letter of approval from the Town Board with respect to her application for a liquor license. Board does not wish to express an opinion for or against granting a liquor license. (2) Reappointment of Stephen T. Burns as a member of the Southold Town Water Advisory Committee. The WAC was discussed with Mark McDonald, Chairman of that committee, at 10:10 A.M., and following that discussion a resolution was placed on the agenda to reappoint Mr. Burns (resolution no. 13). (3) Set 4:00 P.M., Thursday, July 23, 1992 to interview the two applicants for the Land Preservation Committee. (4) Letter from the Village of Greenport requesting a credit for a tipping fee incurred on their behalf (see resolution no. 12). (5) Recycling compliance by carters was discussed later in the day (see 4:20 P.M.) by Councilwoman Hussie. 10:10 A.M. - Mark McDonald, Chairman of the Water Advisory Committee, met with the Board to discuss the direction of that committee. Mr. McDonald made several suggestions: abolish the committee, place it under the direction of Councilman Lizewski's Groundwater Resources Committee, or make it advisory to the Trustees. After considerable discussion it was agreed that the WAC and GRC would meet jointly and see how that works out. 10:45 A.M. - Frederick Ross and Gerald Dennehy, Chairman and Vice Chairman of the Southold Town Land Preservation Committee, met with the Board to discuss the property of Hiram F. Moody, Jr., a ten acre piece of property on Fishers Island which contains a residence as well as open pasture land for grazing of horses. In 1990 Mr. Moody contacted the Open Space' Committee and advised them he would like to protect a significant portion of his land from future potential development and asked the Committee the level of compensation and process necessary to do so under the Open Space program. Mr. Ross reviewed the Moody file with the Board, advising them that the question has arisen concerning the fact that the land is within the .area accessible only to members of the Fishers Island Development Corporation via private road. However, a letter from Town Justice Edwards to Mr. Ross states that access is only private to automobiles and bicycles that are not registered with FIDCO, but pedestrians pass by the property on their way to Isabella, which is open to all and is used by people who are not members of FIDCO nor live on Fishers Island. The Town Board asked Mr. Ross and Mr. Dennehy to explore with Mr. Moody the purchase of the development rights to the property rather than fee title. JULY 14, 1992 39 EXECUTIVE SESSION 11:45 A.M. On motion of Councilwoman Hussie, seconded by Councilman Lizewski, it was Resolved that the Town Board enter into Executive Session. Vote of. the Board: Ayes: Supervisor Harris, Councilman Penny, Councilman Wickham, Councilman Lizewski, Councilwoman Hussie. Absent: Justice Edwards. Also present: Town Attorney Arnoff, Assistant Town Attorney Kiernan, Town 'Clerk Terry.---The Town. Board met with John Halsey and Timothy Caufield, Director and Assistant Director of the Peconic Land Trust, along with Frederick Ross and Gerald Dennehy, Chairman and Vice Chairman of the Land Preservation Committee, to discuss the Cassidy property on Albertson Lane, Gr;eenport, which is in negotiations for possible purchase t-hrough the Land Preservation Program. 12:50 P.M. - Recess for lunch. EXECUTIVE SESSION 2:15 P.M. On motion of Councilman Wickham, seconded by Councilwoman Hussie, it was Resolved that the Town Board enter into Executive Session. Vote of the Board: Ayes: Supervisor Harris, Councilman Penny, C~)uncilman Wickham, Councilman Lizewski, Councilwoman Hussie, Justice Edwards arrived at 3:15 P.M.. Also present: Town Attorney Arnoff, Assistant Town Attorney Kiernan, Town Clerk Terry.---The Town Board met with Special Counsel Frank Yakaboski to discuss litigation. 4:20 P.M. For Discussion items continued: (5) Councilwoman Hussie reported recent meetings with garbage carters in an effort to begin recycling compliance in that area. Councilwoman Hussie advised that the Town will begin to spot check the loads being brought to the disposal area by the carters. (6) Letter from NYS Senator John R. Kuhl, Jr. advising he has introduced a legislative resolution calling upon Congress to allow New York State to be divided into two states, essentially by separating New York City and its surrounding region-f-rom the rest of the state. (7) Letter from the National Environmental Law Center, Ronkonkoma, New York, asking the Town Board to consider adopting a resolution urging President Bush to take action' aimed at fulfilling the promise of the Earth Summit. The Board will consider the proposal at their July 28th work session. 4:50 P.M. - Work Session adjourned. 40 REGULAR MEETING A Regular Meetinq of the Southold Town Board was held on Tuesday, July 14, 1992, at the Southold Town Hall, Main Road, Southold, New York. Supervisor Harris opened the meeting at 7:30 P.M., with the Pledge of Allegiance to the Flag. Present: Supervisor Scott L. Harris Justice Raymond W. Edwards Councilman George L. Kiernan SUPERVISOR HARRIS: Would you remain standing for one minute. Our past Town Clerk, Albert W. Richmond, passed on last night. If we could have a moment of silence in his behalf. Thank you. This meeting is being dedicated in the memory of Albert .Richmond, who was a Town Clerk in Southold for many, many years. Over fifteen years he was Town Clerk. A couple of years he was Receiver of Taxes. At the end of this meeting I have a proclamation, that I will read. As a matter of fact to dispense with that reading of the proclamation at the end, let me read this resolution right now to put it on to the record officially designating this meeting in his memory. Moved by Supervisor Harris, seconded by the Entire Town Board, WHEREAS, this Board has learned with deep sorrow of the death of ALBERT W. RICHMOND, former elected official of the Town of Southold; and WHEREAS, in his service to the people of the Town of Southold as TOWN CLERK from January I, 1960 to June 1, 1975, RECEIVER OF TAXES from December 1, 1943 to November 30, 1945, and Assistant to the Receiver of Taxes from December 1945 to June 1951, Mr. Richmond distinguished himself as a dedicated, conscientious, and concerned public servant; and WHEREAS, the Town of Southold is grateful to the family of ALBERT W'. RICHMOND for sharing him with the Town for those many years he gave of his time, talents and energy; and WHEREAS, ALBERT W. RICHMOND's record of outstanding public service, diligence to duty and dedication to the Town of Southold and its people deserves the sincere gratitude of those with whom and for whom he served; and WHEREAS, ALBERT W. RICHMOND exemplified the qualities of leadership and dedication, and was an individual of great integrity, who was esteemed by his associates and respected by all; now, therefore, be it RESOLVED, that the Town Board of the Town of Southold hereby expresses its grea~ loss in the passing of ALBERT W. RICHMOND, and when the Town Board adjourns this day it does so out of respect to his memory; and be it further RESOLVED r that a copy of this resolution be entered into the minutes of this Town Board meeting and a copy be presented to the family of ALBERT W. If not we'll start with the first resolution of the evening. 2 JULY 14, 1992 1.-Moved by Supervisor Harris, seconded by Councilman Penny, it was RESOLVED that the Town Baord of the Town of Southold hereby authorizes the following 1992 Budcjet modification to the General Fund - Part Town to provide additional appropriation for May 11, 1992 to June 12, 1992 legal expenses relating to the Zahra lawsuit; To: 131420.4 Town Attorney, Contractual Expenses ~ 6,900.00 From: B1910.4 Unallocated Insurance, Contractual Expenses $ 6,900.00 1.-Vote of the Town Board: Ayes: Councilwoman Hussie, Councilman Lizewski, Councilman Wickham, Councilman Penny, Justice Edwards, Supervisor Harris. This resolution was declared duly ADOPTED. 3.-Moved by Justice Edward, seconded by Councilwoman Hussie, it was RESOLVED that the Town Board of the Town of Southold hereby accepts the proposal of Elaine F. Kaldor, Certified Public Accountant, to examine the Statement of Expenses as prepared by the Village of Greenport for the Southold Wastewater Disposal District for the year ended December 31, 1991, at a fee of $2,500.00. 3.-Vote of the Town Board: Ayes: Councilwoman Hussie, Councilman I_izewski, Councilman Wickham, Councilman Penny, Justice Edwards, Supervisor Harris. This resolution was declared duly ADOPTED. 6.-Moved by Councilman Lizewski, seconded by Councilwoman Hussie, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes a refund of $19.60 to Kapell Real Estate, Which sum represents a credit on their Tipping Fee Account, and they no longer hold a commercial contractor disposal permit. 6.-Vote of the Town Board: Ayes: Councilwoman Hussie, Councilman Lizewski, Councilman Wickham, Councilman Penny, Justice Edwards, Supervisor Harris. This resolution was declared duly ADOPTED. 7.-Moved by Supervisor Harris, seconded by Councilman Penny, BOND RESOLUTION OF THE TOWN OF SOUTHOLD, NEW YORK YORK, ADOPTED JULY 14, 1992, AUTHORIZING THE PURCHASE OF AN EMERGENCY GENERATOR SYSTEM FOR USE BY SAID TOWN, STATING THE ESTIMATED MAXIMUM COST THEREOF IS $60,000, APPROPRIATING SAID AMOUNT THEREFOR, AND AUTHORIZING THE ISSUANCE OF $60,000 SERIAL BONDS OF SAID TOWN TO FINANCE SAID APPROPRIATION. JULY 14, 1992 THE TOWN BOARD OF THE TOWN OF SOUTHOLD, IN THE COUNTY OF SUFFOLK, NEW YORK, HEREBY RESOLVES (by the favorable vote of not less than two-thirds of all the members of said Town Board) AS FOLLOWS: Sectional. The Town of Southold, in the County of Suffolk, New York (herein called "Town"), is hereby authorized to purchase an emergency generator system for use by said Town. The estimated total cost of said specific object or purpose, including preliminary costs and costs incidental thereto and to the financing thereof, is $60,000 and said amount is hereby appropriated therefor. The plan of financing includes the issuance of $60,000 serial bonds of the Town to finance said' appropriation, and the levy and collection of taxes on all the taxable real property in the Town to pay the principal of said bonds and the interest thereon as the same shall become due and payable. Section 2. Serial bonds of the Town in the principal amount of $60,000, are hereby authorized to be issued pursuant to the provisions of the Local Finance Law, constituting Chapter 33- a of the Consolidated Laws of the State of New York (herein called "Law") to finance said appropriation. Section 3. The following additional matters are hereby determined and declared: (a) The period of probable usefulness of said specific object or purpose for which said $60,000 serial bonds authorized pursuant to this resolution are to be issued, within the limitations of Section 11.00 a. 32 of the Law, is five (5) years. (b) The proceeds of the bonds herein authorized and any bond anticipation notes issued in anticipation of said bonds may be applied to reimburse the Town for expenditures made after the effective date of this resolution for the purpose or purposes for which said bonds are authorized. The foregoing statement of intent with respect to reimbursement is made in conformity with Treasury Regulation Section 1.103-18 of the United States Treasury Department. 4 JULY 14, 1992 (c) The proposed maturity of the bonds.authorized by this resolution will not exceed five (5) years. Section 4. Each of the bonds authorized by this resolution and any bond anticipation notes issued in anticipation of the sale of said bonds shall contain the recital of validity as prescribed by Section 52.00 of the Law and said bonds and any notes issued in anticipation of said bonds, shall be general obligations of the Town, payable as to both principal and interest by general tax upon all the taxable real property within the Town without ~imitation of rate or amount. The faith and credit of the Town are hereby irrevocably pledged to the punctual payment of the principal of and interest on said bonds and any notes issued in anticipation of the sale of said bonds and provision shall be made annually in the budget of the Town by appropriation for (a) the amortization and redemption of the bonds and any notes in anticipation thereof to mature in such year and (b) the payment of interest to be due and payable in such year. Section 5. Subject to the provisions of this resolution and of the Law and pursuant to the provisions of Section 30.00 relative to the authorization of the issuance of bond an{icipation notes and of Section 50.00 and Sections 56.00 to 60.00 of the Law, the powers and duties of the Town Board relative to authorizing bond anticipation notes and prescribing the terms, form and contents and as to the sale and issuance of the bonds herein authorized and of any bond anticipation notes issued in anticipation of said bonds, and the renewals of said bond anticipation notes, are hereby delegated to the Supervisor, the chief fiscal officer of the Town. Section 6. The validity of the bonds authorized by this resolution and of any notes issued in anticipation of the sale of said bonds, may be contested only if: (a) such obligations are authorized for an object or purpose for which the Town is not authorized to expend money, or (b) the provisions of law which should be complied with at the date of the publication of such resolution are not substantially complied with, JULY 14, 1992 45 and an action, suit or proceeding contesting such validity, is commenced within twenty days after the date of such publication, or (c) such obligations are authorized in violation of the provisions of the constitution. Section 7. This bond resolution shall take effect immediately, and the Town Clerk is hereby authorized and directed to publish the foregoing resolution, in full, together with a Notice attached in substantially the form prescribed by §81.00 of the Law in "THE LONG ISLAND TRAVELER-WATC~AN,,, a newspaper published in Southold, New York, and in "THE SUFFOLK TIMES," a newspaper published in Mattituck, New York, each having a general circulation in the Town and hereby designated the official newspapers of said Town for such publication. 7,- Vote of the Town Board: Ayes: Councilwoman Hussie, Councilman Lizewski, Councilman Penny, Justice Edwards, Supervisor Harris. No: Councilman Wickham. This resolution was declared duly ADOPTED. 8.-Moved by Supervisor Harris, seconded by Councilman Penny, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes and directs the Town Clerk to advertise for bids for the purchase and installation of one (1) new Emergency Operations Generator for the Southold Town Police Headquarters, and the relocation of the existing generator at headquarters to another Town building. 8.-Vote of the Town Board: Ayes: Councilwoman Hussie, Councilman Lizewski, Councilman Penny, Justice Edwards, Supervisor Harris. No: Councilman Wickham. This resolution was declared duly ADOPTED. 9.-Moved by Councilman Penny, seconded by Justice Edwards~ it was RESOLVED that the Town Board of the Town of Southold hereby authorizes the following budget modification to the General Fund - Whole' Town 1992 Budc~et to appropriate Park & Recreation funds for the following items at the Norman E. Klipp Marine Park: $1,199.95 for trees, shrubs, filter cloth; $46.67 for pipe: To: Revenues: A2025 Special Recreation Facilities $ 1,246.62 Appropriation s: Z7110.2 Parks, Equipment $ 1,246.62 9.-Vote of the Town Board: Ayes: Councilwoman Hussie, Councilman Lizewski, Councilman Wickham, Councilman Penny, Justice Edwards, Supervisor Harris. This resolution was declared duly ADOPTED. 10.-Moved by Justice Edwards, seconded by Councilwoman Hussie, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes and directs Supervisor Scott L. Harris to execute acjreements with Jacy Orlowski and Sarah Volinski, Gymnastics Spotters for the 1992 Summer Recreation Program, effective July 15, 1992, at a salary of $5.00 per hour. 10.-Vote of the Town Board: Ayes: Councilwoman Hussie, Councilman Lizewski, Councilman Wickham, Councilman Penny, Justice Edwards, Supervisor Harris. This resolution was declared duly ADOPTED. 11.-Moved by Councilwoman Hussie, seconded by Supervisor Harris, it was RESOLVED that the Town Board of the Town of Southold hereby appoints Victor Santagato as a Lifeguard (1st year), for the 1992 Summer Season, effective immediately, at a salary of $7.42 per hour. 11.-Vote of the Town Board: Ayes: Councilwoman. Hussie, Councilman Lizewski, Councilman Wickham, Councilman Penny, Justice Edwards, Supervisor Harris. This resolution was declared duly ADOPTED. 6 JULY 14, 1992 12.-Moved by Councilman Wickham, seconded by Justice Edwards, it was RESOLVED that the Town Board of the Town of Southold hereby authorizes and directs the Town Clerk to issue a $750.00 credit to the North Fork Sanitation Service tipping fee account in order to reimburse them for costs incurred through R&R Builders on behalf of the Village of Greenport while R&R Builders was working on the renovation of the Long Island Rail Road Passenger Station and establishing a Maritime Museum. 12.-Vote of the Town Board: Ayes: Councilwoman Hussie, Councilman Lizewski, Councilman Wickham, Councilman Penny, Justice Edwards, Supervisor Harris. This resolution was declared duly ADOPTED. SUPERVISOR HARRIS: It's always been the policy of this Town to help out the Village of Greenport at any time within our disposal when possible, especially in a project such as the one that was undertaken by the Village, and the East End Maritime Museum. This project is, I think, going to be a great thing for the Town of Southold, not to mention for the Village of Greenport, and we were notified, unfortunately, too late before the trucks started rolling into the Landfill to waive the fees. However, we have rectified that situation by this resolution, and are pleased to do so for the Village Board, and Mayor Pell. 13.-Moved by Councilman Lizewski, seconded by Councilwoman Hussie, it was RESOLVED that the Town Board of the Town of Southold hereby reappoints Stephen T. Burns as a member of the Southold Town Water Advisor,/ Committe~, for a five (5) year term, effective July 3, 1992 through July 3, 1997, he to serve in said position without compensation. !3.-Vote of the Town Board: Ayes: Councilwoman Hussie, Councilman Lizewski, Councilman Wickham, Councilman Penny, Justice Edwards, Supervisor Harris. This resolution was declared duly ADOPTED. SUPERVISOR HARRIS: This following resolution, that we iust passed, has been done so with the insistence of the Justices, that exist. Our Town Justices have felt that the computerization system, that the Town has, would be enhanced by having a direct access to Department of Motor Vehicles, ~specially during arraignments, and especially during hours where the Police Department does not have direct data link with the Department of Motor Vehicles on an ongoing basis, which the Judges could make available to them when they're doing arraignments. This arraignment process we hope will help execute this system to generate revenues, not only for the Town of Southold, but, also, to make sure that those individuals who are being arraigned are not on a second, or third time notice of a same infraction, or other infractions where the PD in conjunction with the Justice Department has not sufficient time to notify the sitting judge when an arraignment takes place, especially if it's on a Saturday night, late in the evenings, or on a Sunday, or anytime that aren't considered normal hours. So, again, this has been asked for, for some time, by the Judges, and We're glad to provide this service to them. At this time, we have a public hearing scheduled for 8:00 o'clock. Before we go into the public hearing of the evening, are there any members of the audience, that would like to address this Board on any other issue, that you may feel is important for us to be notified about, or any other concern that you may have other than the public hearing, which will be set for 8:00 o'clock? Councilwoman Hussie? JULY 14, 1992 47 COUNCILWOMAN HUSSIE: I'm delighted to see so many people here, because I have some good news. You've been doing marvelous work, as far as recycling is concerned. As you know in April we started really looking at the garbage that you brought in, to find out if indeed there were any glass, or metal, or any of the things, that we can recycle in the garbage. I must say it's been very difficult to find anybody, who has not followed the rules. Our recycling in May was 15% of the total wastestream. In June is went up to 17%. We're aiming for 25%. If we can do 2% a month, in a couple of months we'll be there. The other thing I'd like to tell you about is that our Stop and Swap platform will be ready in about 10 days. This is something that those of us who have been in Southold for quite awhile really have missed. If you recall we used to be able to go down, and find a marvelous chair, that someone had thrown out, and you can take it, or window, or whatever it was, and then that stopped. We're starting that again, and it is for those things that you find too good to throw away, but you really don't need them~ So, we!fl start to accept those things on about the 25th of July, windows, furniture, a lawn mower, things that work, not junk. I just wanted to let everybody know that. Thank you. SUPERVISOR HARRIS: Are there any other Councilman that Would like to report? Judge Edwards? JUSTICE EDWARDS: I'd just like to fill in on this new interface with the Department of Motor Vehicles, Albany's computer. It's very difficult to sit up here, and have a defendant come before you on a motor vehicle thing without him having his conviction stub, and he'll say, oh gee, Judge, they haven't ticketed me in the last five years, but now all we have to do is ring the computer, and poke it up, and say, well, gee, how about this one, how about that one? Oh, I forgot about that. So, this interface makes it very easy for us on the bench to clarify these defendents, when they come in. Not only that, but if it's a serious offense, we can see whether or not it's his first DWI, how long his last one was, and so forth, and so on. So, I'm very glad to see tfie Town Board be unanimous in going for this interface. We have been looking forward in the backroom here for the past six months, looking forward to having it ~n operation. Thank you. There are many people in this audience that have not voiced an opinion for or against. ED SIEGMANN: That doesn't make any difference, and I'm telJingyou if you're going to do that, put it on the ballot, and let the whole town ~)ote. NANCY GILLES: I think that's a very good thing to do to get a sense of the meeting. How can you get a sense of the meeting? SUPERVISOR HA'RRIS: We'll dispense with the show of hands. Obviously there are people in her that don't want to move ahead. There are people that do. ED SIEGMANN: Don't say that I want to move ahead, that ! don't want to move ahead. SUPERVISOR HARRIS: Mr. Siegmann, I have the floor. I'm sorry, you don't have the floor. You had your opportunity to speak. I am running this meeting. Could you please condone yourself. ED SIEGMANN: 1'11 ask for the right of the floor. SUPERIVOSR HARRIS: You will as soon as I'm finished speaking. ED SIEGMANN: Okay, I'll wait for you to talk. SUPERVISOR HARRIS: At this time, the Board has closed this public hearing already. It is going to reserve decision. This Board has moved in the past on many issues, that have been controvers~l, whether they have been the Home Occupation, solid waste, or many other issues, thiS Town has been around for 352 years. It is the oldest town in New York State. It has been the first in many endeavors. Your history will show that. It does not mean for those who spoke, and for those who haven't, that Southold should not endeavor to move in any direction, pro or con, to be the first to do something. It doesn't mean it's wrong, and it doesn't mean it's right. It doesn't mean that Southold, the people who are elected by this Town, should not move in a direction that are first, are innovators in many areas that they feel are important to the residents of the town. That is their perogative. That's the charge you have given them. That's all I have to say on that issue. Mr. Siegmann? ED SIEGMANN: The only reason I'm riding Harris is the fact that you made the comment that some people don't want to get ahead, and I'm the only one that talked, so you have to be referring to me. SUPERVISOR HARRIS: No, I was not referring to you. ED SIEGMANN: I've only be out here eleven years, but I've taken more interest in this town in eleven years, and done a lot of work, than a lot of people that have lived here for years, and I don't think some of the. comments that were made tonight about young, and old, this shouldn't be an arguement of young against old, or old against young, because both of them are in trouble. The young people can't stay here, because they can't get jobs, and the old people have to get out of here because they can't afford to pay the taxes. I want to tell you one thing. The people that moved out here over the last twenty years are the people that kept the people working to build the houses, that they were able to build, so one hand washes the other. We were doing something that was helping them. They were doing something that was helping us, and this is what we should continue to do, work together, not fight young against the old. - SUPERVISOR HARRIS: And that's what made Southold great for all these years, Mr. Siegmann, and everyone in this room, including YOurself, and everybody Seated on this dais, recognizes that fact. If there's no other comments to be made in reference to any other issue other than the public hearing, which is closed, entertain a motion to adjourn. JULY 14, 1992 49 NANCY GILLES: I stood up before, but the last vote by hands, even those of us who spoke, I don't think anybody gave you a clear picture, yes or no. I think we all gave you our concerns, and thought that it was not a simple yes or no, that there was a lot more that has to be done, and i agree that it should go back to the Stewardship. That I think should be point rather than it is a clear cut picture. SUPERVISOR HARRIS: Thank you. yes? DOROTHY PHILLIPS: When you spoke you intimated that this is a , but you also intimated that this Board was capable of making new fresh decisions. That was less than an impartial, because public officials are supposed to respond to their constituents to find out what the majority means, what the majority wants, what the majority understands. We understand this is a question of rezoning. I just did not care for the way you intimated that this Board could do innovative things, even if you do find the support of the public. SUPERVISOR HARRIS: Nobody said that, Mrs. Phillips. I'm sorry l'm not going to argue With you. Nobody said anything about support of the public. I entertain a motion to adjourn.
