Requesting a Change from Residential (R40) to Hamlet
Commercial/Residential (HC), Noyac
WHEREAS, in July 2016, 5 Cedar Lane LLC submitted a request, pursuant to Town Code
§330-185(C), for a public work session to discuss a proposed application for a change-of-
zone; and
WHEREAS, specifically, Cedar Lane LLC seeks a zoning change from Residential (R-40) to
Hamlet Commercial/Residential (HC) on a .1 acres (5,172.01 sq. ft.) parcel located on the
west side of Cedar Lane Avenue approximately 150 ft. north of Noyack Rd, within the
Hamlet of Noyac (SCTM #900-6-1-44); and
WHEREAS, the subject parcel is a pre-existing, non-conforming lot in the Residential (R-40)
zone directly adjacent to Cromer's Market and is currently utilized for ancillary parking and
storage associated with the Market; and
WHEREAS, the proposed zone change would allow the applicant to formalize the parking for
the Market use in addition to retaining the existing building on the site for office/storage
use; and
WHEREAS, pursuant to Town Code §330-185(C) (4), on December 12, 2017 by Resolution
2017-1154, the Town Board elected to consider a formal application on said proposal; and
WHEREAS, on April 12, 2017, the Town Clerk received a formal application for the change of
zone; and
WHEREAS, the subject zone change is considered an Unlisted action within the provisions of
the New York State Environmental Quality Review Act (SEQRA) and Chapter 157 of the
Town Code; and
WHEREAS, with the referral of the zone change application, the Town Board coordinated
Lead Agency with the Planning Board as the only other identified involved agency; and
WHEREAS, on August 23, 2018 the Planning Board declined Lead Agency status by
Resolution 2018-284; now, therefore,
BE IT RESOLVED, that the Town Board of the Town of Southampton hereby assumes Lead
Agency for the purpose of SEQRA review for the subject application.

Re-establish Lead Agency f or Preparation of a Supplemental
Generic Environmental Impact Statement (SGEIS) f or the
Hampton Bays Downtown Overlay District, Hampton Bays
WHEREAS, the Vision for the Hamlet of Hampton Bays within the 1999 Comprehensive Plan
Update recommends "intensifying development in the traditional hamlet center, including
redevelopment and infill development, allowing mixed-use development of a variety of
scales, in connection with either preservation of the existing residential and historic scale of
development, and/or the provision of access and design improvements"; and
WHEREAS, the Hampton Bays Corridor Strategic Plan, adopted in 2013 as part of the Town's
Comprehensive Plan and analyzed as part of the Cumulative Impact of Build-Out GEIS
Study further considers the following elements: an improved pedestrian-scaled environment
for the existing hamlet center; new land use/development options; integrated
transportation planning and design improvements for Montauk Highway, Good Ground
Road, and associated linkage roadways (including cross-access agreements through
adjacent commercial properties); and adding the HO/HC zoning categories along Montauk
Highway; and
WHEREAS, despite the economic recovery since 2008, private economic investment and
revitalization of downtown Hampton Bays has been slow-going and local businesses
continue to lack capital and infrastructure to realize their full development potential; and
WHEREAS, in an effort to kick start the revitalization of the Hamlet Center, the Town Board
has made significant economic investment and leveraged grant monies to realize the initial
phases of construction within Good Ground Park; and
WHEREAS, in the first phase of the effort to implement the recommendations from the
Strategic Plan and GEIS, a Pattern Book was prepared by Historical Concepts to identify the
essential qualities and key patterns that should be encapsulated within an overlay district
including but not limited to community patterns, architectural styles and details and
landscape patterns; and
WHEREAS, through the Pattern Book process the Town has engaged with the community to
determine the desired outcome and character for the development within a specified area
(from Ponquogue Avenue to Springville Road extending north from Good Ground Road to
the Park) in order to begin formulating the parameters of the "Hampton Bays Downtown
Overlay District"; and
WHEREAS, the Town Board's implementation of this optional zoning overlay will allow for
the flexible, creative and innovative use of design standards to realize the forms of
development and advance the Town and Community's objectives to encourage the economic
redevelopment of the Central Business District of Hampton Bays; and
WHEREAS, the finalized Pattern Book will serve as a guiding document to formulate the
zoning code revisions that will ensure redevelopment is consistent with the community's
preferences and will be codified as part of the Form Based Code for the Downtown Overlay
District; and

WHEREAS, the Town Board as Lead Agency for the original GEIS finds that a Supplemental
GEIS is needed and appropriate to update the data from the previous GEIS based on today's
conditions, and will include an additional level of detail such as a hypothetical build-out
scenario in order to test the parameters of the proposed Overlay District that will be
expressed within the Form-Based Zoning Regulations as well as indicate thresholds and
conditions where a site-specific EIS may be required; and
WHEREAS, the Town Board is the only agency approving, funding or directly undertaking
this action of the preparation of a Supplemental GEIS and therefore pursuant to SEQRA is
automatically the Lead Agency, with the following entities considered as Interested
Agencies:

WHEREAS, as part of the Supplemental GEIS a market study will be included to determine
the potential mix of uses that can be supported; a traffic impact study to include pedestrian
and vehicular circulation; parking demand and any additional requirements for public
parking within the District; anticipated infrastructure improvements; consistency with the
goals and objectives of past planning initiatives and the Comprehensive Plan; an analysis of
the projected build out as compared to the original build out in the GEIS; tax implications
and other economic development considerations; as well as fair-share mitigation and
ongoing maintenance needs within the Overlay District; now therefore,
BE IT RESOLVED, that pursuant to SEQRA the Town Board of the Town of Southampton
hereby re-establishes itself as Lead Agency for the preparation of a Supplemental Generic
Environmental Impact Statement for the Hampton Bays Downtown Overlay District rezoning
effort and directs the Town Clerk to forward a copy of this resolution to the Interested
Agencies identified herein.
