Bancroft, Jr. PROPERTY LOCATION: 38099 Main Road(Adj.to Long Island Sound), Orient SCTM#1000-15-2-16 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated May 21, 2018 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated August 14, 2018. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our recommendation that the proposed action is EXEMPT from Coastal Consistency Review. PROPERTY FACTS/DESCRIPTION: The subject parcel is a non-conforming 20,500 square foot water front lot located in an R-80 Zoning District. The parcel is a flag lot that runs 101.58 of the Long Island Sound bluff frontage along the northerly property line along Long Island Sound. The parcel runs 286.55 feet on the West side, 100 feet on the South side, and 286.55 feet on the East side. The parcel is accessed by a 15 foot right of way that accesses NYS Route 25 (Main Road), and is improved with an existing two story house and an accessory swimming pool. All is shown on a site plan by Richard M Suter, Architect, dated May 7, 2018, revised September 10, 2018. BASIS OF APPLICATION: Request for Variance s from Sections 280-124 and the Building Inspector's April 23, 2018, Amended May 9, 2018 Notice of Disapproval based on an application for a building permit to construct an accessory swimming pool and an accessory garage on a residential parcel; at 1) accessory in-ground swimming pool located in other than a code conforming rear yard or front yard location for waterfront properties; 2) proposed accessory garage located less than the code required minimum front yard setback of 40 feet located at 38099 Main Road (Adj to the Long Island Sound), Orient,NY. SCTM No. 1000-15-2-16. RELIEF REQUESTED: The applicant requests variances to place an accessory garage 10 feet from the front yard property line where code requires 40 feet, and to remove a 38 feet swimming pool and replace it with a 50 feet long Page 2, September 20,2018 #7194,Bancroft SCTM No. 1000-15-2-16 in-ground lap swimming pool in a partial side yard location where code requires a front, if the property is waterfront, or in a rear yard location. ADDITIONAL INFORMATION: A representative for the surrounding neighbor spoke against the application. He was not able to articulate a reason that the proposed accessory structures had any effect on the neighbor's property, and furthermore, when questioned by board members, the representative was unsure whether the subject pool in the side yard would be visible from his client's property. The applicant proposes to remove the gazebo and the accessory garage will not be used as habitable space. Prior ZBA variance for the swimming pool in the side yard (ZBA File 45484)was granted on April 6, 2004. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on September 6, 2018 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law §267-b(3)(b)(1). Grant of the variances will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The neighborhood is a mixed neighborhood consisting of single family homes and wooded land. The nearest home is located a substantial distance from the applicant's home. The applicant's property is located a considerable distance from NYS Route 25. The proposed accessory structures are screened by existing woodland and will not be visible from the NYS Route 25 or by neighbors. 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than area variances. The applicant's home is setback 110 feet from the bluff where code requires a 100 foot setback. Any accessory structure built in the rear yard would require the benefit of an area variance. Because of the required bluff setback of 100 feet, it is reasonable to grant variance relief for the non-conforming side yard location of the pool and front yard setback for the proposed garage which cannot meet a conforming setback because of the location of the house. Moreover, the pool had received variance relief under Appeal No. 5484, dated April 8, 2004, for being located 9 feet from the side yard property line, and the proposed pool will replace and slightly expand the existing swimming pool. 3. Town Law X267-b(3)(b)(3). The variances granted herein are mathematically substantial, representing 100% relief from the code for the non-conforming side yard location of the swimming pool and 75%relief from the code from the front yard setback for the garage. Moreover,the conforming bluff setback location of the house on the lot makes it difficult to place accessory structures in the front yard with conforming setbacks. 4. Town Law 4267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. 5. Town Law 4267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law V67-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of a swimming pool and accessory garage while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. Page 3, September 20,2018 #7194,Bancroft SCTM No. 1000-15-2-16 RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-13, motion was offered by Member Dantes, seconded by Member Lehnert, and duly carried, to GRANT the variances as applied for, and shown on the Architectural site plan prepared by Richard Suter, Architect, dated April 30 2018 and last revised September 10, 2018. SUBJECT TO THE FOLLOWING CONDITIONS: I. Existing vegetated screening of the swimming pool shall be maintained. 2. Pool mechanicals shall be placed in a sound deadening enclosure. 3. A drywell for swimming pool de-watering shall be installed. 4. The existing gazebo shall be removed from the property as noted on the survey. 5. The proposed accessory garage shall not be used for habitable space. That the above conditions be written into the Building Inspector's Certificate of Occupancy, when issued. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured,and/or a subdivision map has not been filed with the Suffolk County Clerk,within three(3)years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1) year terms.
