SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated May 21, 2018 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: The relief, permit, or interpretation requested in this application is listed under the Minor Actions exempt list and is not subject to review under Chapter 268. PROPERTY FACTS/DESCRIPTION: The subject property is a 217, 801 sq. ft. property located at 6175 Sound Avenue, Mattituck, NY. The property has two front yards, one being Sound Avenue, and the other being a private road abutting the eastern property line of the subject lot. The property has a frontage of 441. 77 ft. running along the north side of Sound Avenue, then running 463.87 ft. north, where it turns west for 477.07 ft. and finally returns 462.84 ft. south to Sound Avenue. The subject property is in an Agricultural Conservation Zoning District (AC) improved with an existing 3,000 sq. ft. two story residence on the There is an existing area in the rear yard currently surrounded by a deer fence which contains (2) two frame barns, and (3) three frame sheds, and one (1) frame lean to. The property has been heavily clear cut and regraded towards the southeast corner with manure. BASIS OF APPLICATION: Request for Variances from Sections 280-15 and the Building Inspector's April 24, 2018, Notice of Disapproval based on an application for a building permit to relocate an existing accessory barn and a shed, and to construct a new accessory building at; 1) accessory barn to be relocated in other than the code required rear yard; 2) accessory shed to be relocated in other than the code required rear yard; 3) proposed accessory building to be located in other than the code required rear yard; at: 6175 Sound Avenue, Mattituck, NY. SCTM#1000-121-1-4.3. RELIEF REQUESTED: The applicant requests several variances on this conforming 217, 801 sq. ft. residential lot with two front yards in the Agricultural-Conservation Zoning District. The proposed variances are for the Page 2, September 20,2018 #7190, Harkin SCTm No 1000-121-1-4.3 construction of a 100 ft. by 30 ft. hoop house in the front yard. Two other existing structures; a barn and shed,will be relocated in a conforming location. ADDITIONAL INFORMATION: The applicant currently is in litigation with the adjoining property owner to the north over issues relating to access over the private road to the east of the property. Testimony was offered by a representative of the neighbor to the north about the pending litigation. The attorney also described some recent tree trimming and removal of vegetation along the private road that was allegedly done by the applicant. The neighboring property owner provided testimony and some history of the private road to the east of the subject property, as well as her recent interactions with the applicant relating to his use and access of the private road. Furthermore, a neighbor to the west submitted a letter in opposition. The applicant stated that the reason for the proposed location of the barns is because the sloping and topography make it difficult for alternative placement of structures on the site, but he offered no topological documentation showing contours on the survey, and described the land on the application as "primarily flat". According to the applicant,the property has also been regraded on its southeast corner and filled with manure. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on September 6, 2018 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law V67-b(3)(b)(1). Grant of the variances will produce an undesirable change in the character of the neighborhood and a detriment to nearby properties. The subject property has more than enough space to site the proposed buildings in a conforming manner. The property is in a residential area, and not characterized as having a farming operation, where these activities in the front yards would cause considerable changes to the neighborhood. Moreover, applicant proposes to relocate two conforming accessory structures from the rear yard, where they are not visible to the neighbor, to nonconforming front yard locations where they are nonconforming and would be very visible to the public 2. Town Law §267-b(3)(b)(2). The benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue, other than an area variance. The applicant has enough property to place the proposed barns and hoop house in an area that would not require variance relief. The applicant has not proven that he cannot achieve his goals in a conforming manner. 3. Town Law &267-b(3)(b)(3). The variances granted herein are mathematically substantial, representing 100% relief from the code for non-conforming front yard locations of two as built accessory structures and one large proposed accessory structure. 4. Town Law $267-b(3)(b)(4): Evidence has been submitted to suggest that a variance in this residential community will not have an adverse impact on the physical or environmental conditions in the neighborhood. While farming is permitted on residential zoned properties,the proliferation of multiple large agricultural structures on a nonconforming residential front yard would have adverse impacts on the physical appearance of residential neighborhoods. 5. Town Law X267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. Grant of the requested relief is NOT the minimum action necessary and adequate to enable the applicant the benefit of accessory structures in a nonconforming front yard while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. There is plenty of room on the property to place structures in conforming locations. Although I am not familiar with the applicant, Michael Harkin, we are concerned with what has been going on at the subject premises since there has been substantial clearing and filling in of the property along Sound Avenue. Unfortunately, I have now read that he is applying to relocate certain buildings to the area contiguous to the road, as well as construct a new accessory building on said property. It is our fear that the moving of the accessory buildings, as well as the construction of new buildings on the property alongside the road will result in substantial changes not only to the scenic roadway, but also to the change in the character of the community, as well as (most importantly) traffic patterns as they currently exist. That is to say there are many times we cannot exit our property because of a constant flow of traffic going both east and west. } Our concerns are that the applicant will erect ingress and egress to these buildings off of Sound Avenue in addition to the driveway that he currently has. Additionally, the potential use by himself, others and perhaps the public at large should he subsequently make another application for a farm stand or other type of commercial structure would create a bottleneck which, I submit, this Board should not countenance. We recognize that one should be entitled to utilize his or her property as best he or she can. However, when that use negatively impacts upon the community and the neighbors, I submit that this Board should not approve such an application. Unfortunately, because of certain court commitments, I am unable to appear before the Board on this date and would ask that this letter be read into the record to voice our opposition to the application by Mr. Harkin.
