ZBA FILE: #7189 old Town Clerk NAME OF APPLICANT: Alex Friedman PROPERTY LOCATION: 305 MacDonald's Road, Laurel NY SCTM: 1000-145-4-14.1 SEQRA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without further steps under SEQRA. SUFFOLK COUNTY ADMINISTRATIVE CODE: This application was referred as required under the Suffolk County Administrative Code Sections A 14-14 to 23, and the Suffolk County Department of Planning issued its reply dated May 17, 2018 stating that this application is considered a matter for local determination as there appears to be no significant county-wide or inter-community impact. LWRP DETERMINATION: This application was referred for review under Chapter 268, Waterfront Consistency review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. The LWRP Coordinator issued a recommendation dated August 14, 2018. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to us, it is our recommendation that the proposed action is EXEMPT from Coastal Consistency Review. PROPERTY FACTS/DESCRIPTION: The subject, non-conforming, 32,151 square feet, .738 acre creekfront corner parcel, located in the R40 Residential District, measures 136.68 feet along a private Paper Street referred to as Edgemere Avenue before turning at a rounded corner, 24.09 feet, then running west 186.94 feet along a second private Unnamed Street referred to as MacDonald's Road (aka MacDonald Crossing), then turning north along Brush's Creek and a rip-rap shore 90.80 feet,then dog-legging 26.35 feet along wood bulkheading with wood steps to the water, then continuing north 46.873 feet along wood bulkhead, and turning east, along the same creek and wood bulkheading, 213.02 feet meeting Edgemere Avenue. The site is developed with a 1 '/2 story frame house with attached wood deck and steps on the westside along with a brick patio on the eastside of the residence along with a second, 1 story frame residential structure with garage, located in the northeast corner of the lot and has an attached wood deck with stairs and a brick patio on the northside with access to the property by two driveways; an earth drive on Edgemere Avenue and a paved bluestone drive on MacDonald's Road. Additionally, there are two sheds and a triangular brick patio as represented on the survey prepared by Nathan Taft Corwin III,Land Surveyor, dated January 18, 2018. BASIS OF APPLICATION: Request for a Variance from Article XXIII, Section 280-124 and the Building Inspector's April 25, 2018, Notice of Disapproval based on an application for a building permit to demolish a portion of a dwelling and construct additions and alterations to an existing single family dwelling, at; 1) located less than the code required minimum front yard setback of 40 feet; at: 350 MacDonalds Road, Laurel, NY. SCTM#1000-145-4-14.1. Page 2, September 20,2018 #7189,Friedman SCTM No. 1000-145-4-14.1 RELIEF REQUESTED: The applicant requests a variance to demolish a portion of an existing dwelling and to construct renovations and additions, including a new second story measuring 27.4 feet by 27.5 feet and a roof terrace, accessed by interior stairs, of similar dimension with a finished height to the structure's ridge of 30.9 feet, to an existing single family residence with a front yard setback of 12.8 feet where the Code requires a 40 feet front yard setback. ADDITIONAL INFORMATION: The subject property is located in a private, waterfront, community known as Edgemera Park created in the early 20"' Century and does not conform to current zoning standards. According to the survey, the primary residence is located in the AE Flood Zone and is adjacent to Town of Southold underwater land (Brush's Creek). No prior variances are on file for this parcel. The property is well screened with mature trees and landscaping. The applicant and his agent spoke at the Public Hearing and indicated that they would work to preserve the large trees on the property and clarified that there is no formal neighborhood association. No member of the public or immediate neighbor spoke in favor or against this application. Included in the application is a letter dated February 26, 2018, from the Board of Town Trustees. The Trustees determined, after review of the site plan, that the proposed alterations and addition to the second floor of the home, which is to occur within the existing footprint of the existing house, is out of the Wetland jurisdiction under Chapter 275 of the Town Wetland Code and Chapter 111 of the Town Code. Therefore, in accordance with the current Wetlands Code (Chapter 275) and the Coastal Erosion Hazard Ara(Chapter 111) no permit is required. FINDINGS OF FACT/REASONS FOR BOARD ACTION: The Zoning Board of Appeals held a public hearing on this application on September 6,2018 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and surrounding neighborhood, and other evidence,the Zoning Board finds the following facts to be true and relevant and makes the following findings: 1. Town Law §267-b(3)(b)(1). Grant of the variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. Edgemera Park is a small-scale neighborhood of single family residences of varying size, scale and design the majority of which have, customary second floors. Several immediate homes have similar nonconforming front yard setbacks. The applicant's proposed additions and alterations are in keeping with the immediate neighborhood. 2. Town Law &267-b(3)(b)(2). The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The existing residence was built prior to current Zoning with a 12.8 feet front yard setback and the applicant proposes to maintain that setback. The interior first floor renovation of the existing house does not include any additional living space or expansion to the footprint of the house. The proposed alteration is to add second floor living space, consisting of a master bedroom and bathroom suite, along with a roof deck, over the existing residence. 3. Town Law §267-b(3)(b)(3). The variance granted herein is mathematically substantial,representing 68%relief from the code. However, the structure was built prior to current zoning. Moreover,the subject parcel does not have any immediate residential neighbor who would be impacted by this application. Brush's Creek is owned by the Town of Southold and the immediate neighbors opposite the dual road frontage have similar hardship. Furthermore, the paper road (MacDonald's Crossing) running parallel to the Peconic Bay and approximately 26 feet wide is not paved and grass has grown over creating a greater buffer and setback from the closest neighbor. 4. Town Law §267-b(3)(b)(4) No evidence has been submitted to suggest that a variance in this residential community will have an adverse impact on the physical or environmental conditions in the neighborhood. The applicant must comply with Chapter 236 of the Town's Storm Water Management Code. Page 3, September 20,2018 #7189,Friedman SCTM No. 1000-145-4-14.1 5. Town Law &267-b(3)(b)(5). The difficulty has been self-created. The applicant purchased the parcel after the Zoning Code was in effect and it is presumed that the applicant had actual or constructive knowledge of the limitations on the use of the parcel under the Zoning Code in effect prior to or at the time of purchase. 6. Town Law &267-b. Grant of the requested relief is the minimum action necessary and adequate to enable the applicant to enjoy the benefit of alterations and additions to an existing single family residence consisting of a 27.4 feet by 27.5 feet second story with roof deck while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION OF THE BOARD: In considering all of the above factors and applying the balancing test under New York Town Law 267-B, motion was offered by Member Planamento, seconded by Member Weisman (Chairperson), and duly carried,to GRANT the variance as applied for, and shown on the survey prepared by Nathan Taft Corwin 111, Land Surveyor and dated January 18, 2018 and the architectural drawings labeled A100,A200, A300,A400 and A401 prepared by Anthony M. Portillo, Registered Architect and dated April 26, 2018. Any deviation from the survey, site plan and/or architectural drawings cited in this decision will result in delays and/or a possible denial by the Building Department of a building permit, and may require a new application and public hearing before the Zoning Board of Appeals. Any deviation from the variance(s) granted herein as shown on the architectural drawings, site plan and/or survey cited above, such as alterations, extensions, or demolitions, are not authorized under this application when involving nonconformities under the zoning code. This action does not authorize or condone any current or future use, setback or other feature of the subject property that may violate the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Board reserves the right to substitute a similar design that is de minimis in nature for an alteration that does not increase the degree of nonconformity. Pursuant to Chapter 280-146(B) of the Code of the Town of Southold any variance granted by the Board of Appeals shall become null and void where a Certificate of Occupancy has not been procured, and/or a subdivision map has not been filed with the Suffolk County Clerk,within three (3) years from the date such variance was granted. The Board of Appeals may, upon written request prior to the date of expiration, grant an extension not to exceed three (3) consecutive one (1) year terms.
