Findings: The Board of Trustees DENIES WITHOUT PREJUDICE the application as submitted. The project does not meet the requirements for issuance of an Administrative Permit set forth in Chapter 275 of the Southold Town Code. The LWRP Coordinator found the proposed action to be Inconsistent with the Policy Standards due to the fact that public access would be eliminated or impeded by the construction of the proposed fence across a paper road. The Board of Trustees determined, according to survey of John C. Ehlers Land Surveyor received on July 27, 2018, submitted by the applicant, that the proposed fence is to be placed on a road. I have reviewed the use of this right of way and observed that the prior owner had continuous maintained a fence across the right-of-way for over thirty(30)years. It also appears that the right-of-way is a paper road which has been blocked by impassable vegetation, topography, and physical obstructions for the past 30 years. In addition,prior deeds grant title to the easterly 15 feet of the right-of-way to the owner of the garage parcel (Mr. Geroulanos). Mr. Geroulanos's predecessor extinguished the rights of others to use of the right-of-way by adverse possession. Please be advised that the Association does not have authority to place any structures on this land,therefore,the purported intent to place kayaks or create access for anyone on the right- of-way is not permitted.
