Scott Wachenfeld and Dianne Wachenfeld, as husband and wife, whose address is 30 Hamilton Court,
Whippany, New Jersey 07981 ("Wachenfeld")and Nail Capri, whose address is 65 Helene Court, Staten Island,
New York 10309(`Capri") with Wachenfeld and Capri being tenants in common, with Wachenfeld having an
undivided 51% interest and Capri having an undivided 49% interest,

WITNESSETH, that the party of the first part, in consideration of SIX HUNDRED FIFTY THOUSAND
AND NO/100 DOLLARS ($650,000.00), lawful money of the United States, paid by the party of the second part,
does hereby grant and release unto the party of the second part, the heirs or successors and assigns of the party of

BEGINNING at the northeasterly corner of the premises hereby conveyed on the northerly side
03.00 of a right of way hereinafter mentioned and defined, which line is also the southerly side of land
of Herbert Fordham and at a stake set in said corner, which stake is distant 35 feet westerly on a
course of North 68 degrees, 53 minutes, 20 seconds West from a locust post set in the westerly
000 side of land of Inez Fordham;
RUNNING THENCE from said point of beginning along the northwesterly side of land now of
Wachenfeld South 21 degrees, 06 minutes, 40 seconds West 136.36 feet to the Mean High Water
Mark of Greenport Harbor;
THENCE along the mean high water mark of Greenport Harbor North 66 degrees, 23 minutes,
10 seconds West 31.97 feet to the Southeasterly side of land now or formerly of Craig;
THENCE along said last mentioned land North 25 degrees, 06 minutes, 40 seconds East 135.29
feet;
AND THENCE South 68 degrees, 53 minutes, 20 seconds East 22.5 feet to the point or place of
BEGINNING.
ALSO TOGETHER with a right of way in common with others, upon over and across a parcel
of land adjoining said last above mentioned right of way on the North thereof, and which parcel
of land is referred to as Parcel "C" in the interlocutory judgment of 1929 in the partition action in
the county court, Suffolk County, entitled Archibald N. Young, Plaintiff, against Nettie E. Hall
and others, Defendants, which said last mentioned right of way extends north to Manhanset
Avenue.
BEING AND INTENDED TO BE the same premises as conveyed to the party of the first part
by deed dated August 31, 1990 heretofore recorded in the Office of the Suffolk County Clerk. >/

TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof,
TOGETHER with the appurtenances and all the estate and rights of the party of the first part in and to

TO HAVE AND TO HOLD the premises herein granted unto the party of the second part, the heirs or
successors and assigns of the party of the second part forever.
AND the party of the first part, covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the part,of the first part, in compliance with Section 13 of the Lien Law, covenants that the party
of the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of any improvement and will
apply the same first to the payment of the cost of the improvement before using any part of the total of the same
for any other purpose.
'rhe word "parry" shall be construed as if it read "parties" whenever the sense of this indenture so
requires.
