SOUTHOLD TOWN BOARD
SPECIAL MEETING
OCTOBER 1, 1993
A Special Meetincj of the Southold Town Board was held on Friday, October 1,
1993, at the Southold Town Hall, Main Road, Southold, New York. Supervisor
Harris opened the meeting at 4:00 P.M. All members received written notice of the
meeting from Supervisor Harris and Town Clerk Terry, dated September 28, 1993.
All members signed a Waiver of Notice of Town Board Meeting.

Town Clerk Terry formally presented the 1994 Tentative Budget of the Town of
Southold to the Town Board.
Supervisor Harris then read his 1994 Budget Message:
"As Supervisor Chief Financial Officer of the Town of Southold, I am pleased
and proud to announce that the financial position of the Town continues to be
positive. Not only is this my opinion and that of the Town's Senior Accountant,
but this opinion· has been recently declared by Moody's Municipal. In recently
awarding an "A" rating on Town issued bonds, on September 15th, Moody's affirmed
that "The Town continues to exhibit a positive financial position." and "Continued
sound finances are anticipated due in part to increased expenditure control." The
Town should be comforted by this independent appraisal of the Town's financial
condition; ' .
"I'm proud of the continued cooperation of Town departments to hold down their
costs. My requirement that all purchases be persor~ally approved by me insures that
Town spending is held to a minimum.
"The budget I have submitted is a'lean one. While fixed costs, such as
retirement costs, debt service, utilities, fuel, insurance, etc. continue to grow, I
have taken extraordinary efforts to reduce the following items: refinancing
retirement debt, reducing long distance telephone costs, and decreasing insurance
premiums.
"The bottom line results in almost a zero percent tax rate increase. I have
accomplished this despite a significant reduction in total assessed valuations due to
recent tax assessment settlements. In addition, all existing programs will be
maintained at current levels.

~'My budget also includes additional funding for both Emergency Preparedness
and Highway maintenance as well as the creation of a Youth Bureau and a Parks
Department. The Parks Department will maintain all of our recreation facilities as
well as be responsible for the continued development of Tasker Memorial Park.
"Because of the creation of the Town's solid waste district, this year the cost
of solid waste will be displayed separately on a new line on your tax bill. The three
dollars and eight cents ($3.08) per thousand of assessed value charge in the solid
waste district line is offset by a two dollar and seventy-eight cents ($2.78) per
thousand of assessed Value decrease in the General Fund Whole Town budget.
"This all translates into a total tax increase of thirty-one cents ($.31) per
thousand of assessed value on one dollar and eighty-six cents ($1.86) increase per
average assessed household."
SUPERVISOR HARRIS: At this time we have two resolutions in reference to the award-
of contracts for hauling our' solid waste. One is going to be dealing with the Town
refuse and garbage, the second is going to be dealing with construction and demoltion,
and 1'11 turn this over for one second to Chairperson Alice Hussie of the Landfill
Committee to say about our meeting that we had this morning, and of course, the
beginning of this week in reference to the selection.
1-Moved by Councilwoman Hussie, seconded by Councilman Penny, it was
RESOLVED that the Town Board of the Town of Southold hereby accepts the proposal
of Star Recycling Inc., Brooklyn, New York, in the amount of $59.48 per ton, for
the transfer and disposal/processing of solid waste from the Southold Town Landfill,
Cutchogue, for a period of six (6) months, effective October 9, 1993, with a Town
option for.a three (3) month extension, all in accordance with the specificastions
under the solicitation for proposals; and be it
FURTHER RESOLVED that Supervisor Scott L. Harris be and he hereby is authorized
and directed to execute a contract between the Town of Southold and Star Recycling
Inc. for the aforesaid services all in accordance with the approval of the Town Attorney.
1-Vote of the Board: Ayes: CouncilWoman Hussie, Councilman Wickham, Councilman
Penny, Justice Edwards, Supervisor Harris.
This resolution was declared duly ADOPTED.
2-On motion of Councilwoman Hussie, seconded by Justice Edwards, it wzs
RESOLVED that the Town Board of the Town of Southold hereby accepts the proposal
of North Fork Sanitation Service, Southold, New York, in the amount of $49.00 per
ton, for the removal and disposal of construciton and demolition debris and concrete
from the Southold Town Landfill, Cutchogue, for a period of six (6) months,, effective
October 9, 1993, with a Town option for a three (3) month e~tension, all in accordance
with the specifications under the solicitation for proposals; and be it
FURTHER RESOLVED that Supervisor Scott L. Harris be and he hereby is authorized
and directed to execute a contract between the Town of Southold and North Fork
Sanitation Service for the aforesaid services, all in accordance with the approval
of the Town Attorney.
2-Vote of the Board: Ayes: Councilwoman Hussie, Councilman Wickham, Councilman
Penny, Justice Edwards, Supervisor Harris.
This resolution was declared duly ADOPTED.
SUPERVISOR HARRIS: Thank you, Alice. t'd like to further state that just for
the record, so that there is no misunderstanding, that the Landfill in the Town of
Southold will be accepting shellfish debris, that being scallops, oysters and conks,
at no charge, for the duration of our Landfill, as long as it continues in the Town
of Southold. It is going to be stockpiled, and those materials are going to be used
for roadbeds. There have been some questions about what will happen to that material
once scallop season opens on Monday the 4th, and whether shells will still be able
to come at no charge, and they will continue to come in as they have in the past.
Other th~n that, I need a motion to adjourn.
COUNCILMAN WICKHAM: Scott, I have a comment first, and that is that I voted
for these things, and I support them because it's time the Town got a plan in place
and moved ahead with it. But want to go on record as saying that I believe that
we have not done this properly. I believe that the proposals, the seeking of proposals
that we did, was not in conformity with the law, and I just want to disassociate myself
from that process. Nevertheless It's time we had a plan, and I'm pleased to vote
for it, and I think that these two firms that we are accepting at this stage is in
the interest of the Town.
'SUPERVISOR HARRIS: Anybody else? I'd just like to say that the Town Board
has done a great job with this, in the working on this, for a lot of years, and it's
finally come to fruition that we have completed the task before us. The individuals
from the Task Force, as well as those who have been on the Town Board, have
accomplished this deed, and those volunteers who have given of their time outside
of the Task Force also should be commenced for the time and effort that they gave

to the Town's people. This dilemma which has faced this Nation, and still faces many
of the states in this Nation, hopefully will resolve to this township once and for all,
and we hope that in the future we can move on to other issues that would be of such
economic and environmental importance such as this one has been since the inception
of the Long Island Landfill Law, which each and every one of us knows is a flawed
piece of legislation, and of which not one legislator ever had the courage to amend
the Long Island Landfill Law s,nce it was adopted in 1983.
COUNCILMAN WICKHAM: And ] just have to add to that, Scott, that this Town Board
didn't have the courage to push the legislators to make those changes when the time
was appropriate.
SUPERVISOR HARRIS: Well~ again, I'm not a debate, Tom.
COUNCILMAN WICKHAM: Neither am l.
SUPERVISOR HARRIS: The Town Board certainly did push those legislators and
there was legislation in place, and unfortunately through' politics in the Assembly
it never got through that house and it stayed in committee, but it was. in the Senate
and it was adopted by the Senate, and were ready for an amendment. Unfortunately
the political scenario within the State of New York would not allow this happen, nor
would the legislators who were involved in the Assembly-side from Long Island allow
this to happen. So, this Board has been on record, and continues to be on record
while we still are in appeal for the Long Island Landfill Law, and parts of that litigation
we still are pursuing. Hopefully administrative relief in that respect, and will three
towns will' certainly continue to do so for as long as it's possible. Anybody else?

On motion of Councilman Penny, seconded by Councilman Wickham, it was
RESOLVED that this Town Board meeting be adjourned at 4:15 P.M.
Vote of the Board: Ayes: Councilwoman Hussie, Councilman Wickham, Councilman
Penny, Justice Edwards, Supervisor Harris.
