New York 11971, as tenants in common, party of the first part; and
ROBERT C.MALLGRAF AND PHYLLIS B. MALLGRAF, husband and wife, residing at 500 Goose
Creek Lane, Southold, New York 11971, as tenants by the entirety, party of the second part; and
WITNESSETH,that the party of the first part, in consideration of Ten and 001100--($10.00)--Dollars, and
other good and valuable consideration paid by the party of the second part,does hereby grant and release
unto the party of the second part, the heirs or successors and assigns of the party of the second part
forever,
ALL that certain plot,piece or parcel of land,with the buildings and improvements thereon erected,situate,
lying and being at Bayview,near Southold,in the Town of Southold,County of Suffolk and State of
New York,bounded and described as follows:
BEGINNING at a stake set on the northerly line of a certain 20 foot right of way leading to North Bayview
Road at the southeasterly corner of land now or formerly of Charles Richard Van Duzer,being 225.0 feet
westerly along said northerly line from a concrete monument set at the southwesterly corner of land now or
formerly of Charles McNeilly;and
RUNNING along said land now or formerly of Van Duzer,North 29 degrees 12 minutes 40 seconds West,
a distance of 242 feet,more or less,to the ordinary high water mark of Goose Creek;
THENCE easterly along said ordinary high water mark, 75 feet, more or less,
THENCE along land now or formerly of F.Harold Sayre and Ray I. Young,on a line parallel with the
easterly boundary line of said land now or formerly of Van Duzer,South 29 degrees 12 minutes 40 seconds
East,a distance of 235 feet,more or less,to a stake set on said northerly line of said 20 foot right of way;
THENCE along said northerly line, South 61 degrees 47 minutes 20 seconds West,a distance of 75.0 feet
to the point or place of BEGINNING.
TOGETHER with all right,title and interest of the party of the first part in and to the waters and the lands
under the water of Goose Creek as it adjoins the premises above described on the North.
TOGETHER with the right to the use of a 20 foot right of way to be used in common with others
immediately adjoining said premises on the South and running from the southwesterly corner of said
premises easterly about 525 feet to North Bayview Road.
SUBJECT to the covenants and restrictions of record.
Being and intended to be the same premises conveyed to the party of the first part by deed dated November
3,2004,recorded November 30,2004 in Liber 12357 page 810 in the Suffolk County Clerk's Office.
TOGETHER with all right, title and interest, if any, of the party of the first part in and to any streets and
roads abutting the above described premises to the center lines thereof;TOGETHER with the
appurtenances and all the estate and rights of the party of the first part in and to said premises.
TO HAVE AND TO HOLD the premises herein granted unto the party of the second part,the heirs or
successors and assigns of the party of the second part forever.
AND the party of the first part covenants that the party of the first part has not done or suffered anything
whereby the said premises have been encumbered in any way whatever, except as aforesaid.
AND the party of the first part, in compliance with Section 13 of the Lien Law,covenants that the party of
the first part will receive the consideration for this conveyance and will hold the right to receive such
consideration as a trust fund to be applied first for the purpose of paying the cost of the improvement and
will apply the same first to the payment of the cost of the improvement before using any part of the total of
the same for any other purpose.The word"party"shall be construed as if it read"parties"whenever the
sense of this indenture so requires.
