The plan of financing includes the expenditure of approximately $25,000 which may be received as a trade-in credit for a separate item of equipment to pay a part of the cost, the issuance of bonds in the principal amount of not to exceed $500,000 to finance the balance of said cost, and the assessment, levy and collection of assessments upon the several lots and parcels of land within the District which the Town Board shall determine and specify to be especially benefited by such increase and improvement, so much upon and from each as shall be in just proportion to the amount of benefit which the increase and improvement shall confer upon the same. Section 2. Bonds of the Town are hereby authorized to be issued in the principal amount of not to exceed $500,000 pursuant to the provisions of the Local Finance Law, constituting Chapter 33-a of the Consolidated Laws of the State of New York (herein called the "Law"), to finance a part of said appropriation. Section 3. The following additional matters are hereby determined and stated: (a) The period of probable usefulness of the object or purpose for which said bonds are authorized to be issued, within the limitations of Section 11.00 a. 28 of the Law, is fifteen (15) years. (b) The proceeds of the bonds herein authorized and any bond anticipation notes issued in anticipation of said bonds may be applied to reimburse the Town for expenditures made after the effective date of this resolution. The foregoing statement of intent with respect to reimbursement is made in conformity with Treasury Regulation Section 1.150-2 of the United States Treasury Department. (c) The proposed maturity of the bonds authorized by this resolution will exceed five (5) years. Section 4. Each of the bonds authorized by this resolution and any bond anticipation notes issued in anticipation of said bonds shall contain the recital of validity prescribed by Section 52.00 of the Law and said bonds and any notes issued in anticipation said bonds shall be general obligations of the Town, payable as to both principal and interest by a general tax upon all the taxable real property within the Town. The faith and credit of the Town are hereby irrevocably pledged to the punctual payment of the principal of and interest on said bonds and any notes issued in anticipation of the sale of said bonds, and provision shall be made annually in the budget of the Town by appropriation for (a) the amortization and redemption of the bonds and any notes issued in anticipation thereof to mature in such year and (b) the payment of interest to be due and payable in such year. Section 5. Subject to the provisions of this resolution and of the Law and pursuant to the provisions of Section 21.00 of the Law relative to the authorization of the issuance of bonds with substantially level or declining annual debt service, Section 30.00 relative to the authorization of the issuance of bond anticipation notes and Section 50.00 and Sections 56.00 to 60.00 and 168.00 of the Law, the powers and duties of the Town Board relative to authorizing bond anticipation notes and prescribing the terms, form and contents and as to the sale and issuance of the bonds herein authorized, and the renewals of said bond anticipation notes, and relative to executing contracts for credit enhancements and providing for substantially level or declining annual debt service, are hereby delegated to the Supervisor, the chief fiscal Southold Town Board Regular Meeting July 17, 2018 page 27 officer of the Town. Section 6. The validity of the bonds authorized by this resolution, and of any notes issued in anticipation of said bonds, may be contested only if: (a) such obligations are authorized for an object or purpose for which the Town is not authorized to expend money, or (b) the provisions of law which should be complied with at the date of the publication of such resolution, or a summary thereof, are not substantially complied with, and an action, suit or proceeding contesting such validity is commenced within twenty days after the date of such publication, or (c) such obligations are authorized in violation of the provisions of the constitution. Section 7. This resolution shall take effect immediately and the Town Clerk is hereby authorized and directed to publish the foregoing bond resolution, in summary, in "The Suffolk Times, " a newspaper having a general circulation in said Town, which newspaper is hereby designated as the official newspaper of the Town for such publication, together with the Town Clerk's statutory notice in the form prescribed by Section 81.00 of the Local Finance Law of the State of New York. Scott, I was wondering if you can give us an update on the County's participation and support for the Army Corps of Engineers project at Goldsmiths Inlet? SUPERVISOR RUSSELL: Suffolk County, I actually talked to Legislator Al Krupski about two weeks ago, they seem to have a great deal of support. I am unaware of any type of formality or anything along those lines but certainly Al is well aware of the challenges here, obviously, as a Southold Town Board Regular Meeting July 17, 2018 page 30 former Trustee and Town Board member. And from every indication I got from him, the County will be in support of it. I can't speak for him, I am just saying my conversation seemed positive. MR. SWITZER: I understand. Thank you very much. SUPERVISOR RUSSELL: Who else would like to address the Town Board? Robert Dunn, Peconic ROBERT DUNN: Robert Dunn, Peconic. I hate to sound like a broken record here, last summer I spoke to you about ice cream trucks and several weeks ago the town raised a dispute with some of the wineries about food trucks, yet they continue to allow ice cream trucks to use their property to do the same things that food trucks do at wineries. Yes, you can make a point that it's a difference between ice cream and sandwiches but they are both food and they are both retail sales and they are both happening where they shouldn't per your, per the Town's decision. I don't have a problem with the ice cream trucks and I think it's a kids right to eat ice cream, get it all over themselves on the beach. COUNCILMAN GHOSIO: What about me? MR. DUNN: However, I do have a real problem with some of these guys who seem to think nothing wrong with making noise in my living room five or six times a day, and there's two of them, and I have a bigger problem with my township supplying them with the property to do that on 150 feet from my living room window. When I was a kid, we had Good Humor and Bungalow Bar and the guy pulled the string and rang a mechanical bell. When he got to where he was selling ice cream, he got up out of his seat and the bell stopped. He sold ice cream. These guys are here for 15 minutes sometime, ringing bells. I would love to see one of you tell me you would be okay with that in your living room. I am not going to tell anybody what to do on the beach but these guys are using loud speakers with amplified speakers and we need to do something about it. It's not right. I have heard people screaming on the beach, shut up. You know, people go to the beach to enjoy themselves. And there's one of them, I have spoken to them all, one of them has absolutely no interest in anything but making money. The Mr. Softee guys have actually made an attempt to do it, they ring the bell,they come, I unfortunately have to live with the dogleg is on Mill Road and for some reason they pick that spot to turn on their bells. I don't have to tell you, when you are watching the news, this guy revs up this jingle in front of your house, it's kind of startling. The Softee guy, when he gets to the beach, he gives a minute, everybody knows he's there, he turns it off. The other guy, it's almost like he's annoying people into buying ice cream. And he is going to sit there until they come and he has a line outside and he leaves his jingle on. So now he's there eight, nine, twelve minutes and it's obviously noticed by watch, he starts at 11:00 like clockwork and his last one is somewhere between 6:30 and 7:30. And depending on how busy he is at the other spots, he's back five or six times a day. COUNCILWOMAN DOHERTY: Scott, can I,just want to clarify a couple of things. First of all, we didn't raise an issue with food trucks at wineries, we raised issue of food trucks retailing at residential and agricultural... Southold Town Board Regular Meeting July 17, 2018 page 31 MR. DUNN: Okay. COUNCILWOMAN DOHERTY: Zones, okay. MR. DUNN: Fine, if I am wrong, you need to clarify that. I don't want to offend anybody or cause any problems here. COUNCILWOMAN DOHERTY: Okay. And the other is, we do have a code, I don't know it word for word but you can do a transient, go sell with the lines, when the line is down, you can't stay there. So the ice cream trucks are allowed. They go, sell their product, they leave. They are allowed to do that. MR. DUNN: Nobody can allow them to make noise in my living room. COUNCILWOMAN DOHERTY: 1, we don't have a code that and 1 120 percent agree with that because when I am sitting on the beach and you hear that jingle over and over again, you want to yell. MR. DUNN: Obviously you know the guy I am talking about. Not the Mr. Softee guy. COUNCILWOMAN DOHERTY: Yes. No,no. And I don't know what we can do about that. SUPERVISOR RUSSELL: We will sit down with the Town Attorney later this week, we will go over... TOWN ATTORNEY DUFFY: I think the code addresses it, the code does address making noise to attract attention. We just need a complaint. MR. DUNN: I mean, he can, I am not against him, it's annoying but the guy has got to make a living and people have got to know he's there so I am not against him ringing his bell as he comes down the street, I am not against him giving it a minute or two because people are down this way, down that way, fishing or whatever, let them know... SUPERVISOR RUSSELL: I will give it to the code enforcement officer tomorrow to address it with all the operators, so they all get equal notice. MR. DUNN: Okay and... SUPERVISOR RUSSELL: The cod doesn't allow barking or something, like this old antiquated term with selling but it's all the same. MR. DUNN: I am not trying to stop the guy from selling, let him make a living and let the kids enjoy the ice cream but be a little appreciative of the people that live there. Thank you. MR. DUNN: I don't have a problem, if he has got business and he needs to be there for a half hour, that's fine. just so he doesn't have to make noise. COUNCILWOMAN DOHERTY: From what Bill is saying, it's already addressed in the code, so when it's happening, you know, you can do your online complaint and we can send the code officer there. MR. DUNN: By the time he gets there, he's gone. Somebody needs to print a piece of paper, bring it to this guy and tell him this is what you can't do. SUPERVISOR RUSSELL: I am going to something more overt, what we will do is I will make sure that code enforcement gets notice out to all of them, so they are all well aware of it and from there we will determine the compliance but they couldn't say they were not notified at that point.
