Dear Mr. Hermann:
The Southold Town Board of Trustees reviewed the survey prepared by Kenneth M.
Woychuk, Land Surveying, PLLC, last dated August 22, 2018, and determined that the
construction of additions and alterations to the existing single family dwelling and
relocation and upgrade of the sanitary system_ on the captioned property are out of the
Wetland jurisdiction under Chapter 275 of the Town Wetland Code and Chapter 111 of
the Town Code.

Specifically regarding the proposed upgrade of the sanitary system, "the relocation of an
existing septic system from within Trustee jurisdiction to outside of Trustee jurisdiction"
is an activity exempt from requiring a wetland permit pursuant to Section 275-4(A)(1)(k).
Therefore, in accordance with the current Wetlands Code (Chapter 275) and the
Coastal Erosion Hazard Area (Chapter 111) no permit is required.
Please be advised, however, that no clearing, no removal of vegetation, no cut or
fill of land or removal of sod, no construction, sedimentation, or disturbance of
any kind may take place within 100' landward from the top of the bluff, or seaward
of the tidal and/or freshwater wetlands jurisdictional boundary or seaward of the
coastal erosion hazard area as indicated above, without further application to,
and written authorization from, the Southold Town Board of Trustees pursuant to
Chapter 275 and/or Chapter 111 of the Town Code.

It is your responsibility to ensure that all necessary precautions are taken to prevent any
sedimentation or other alteration or disturbance to the ground surface or vegetation
within Tidal Wetlands jurisdiction and Coastal Erosion Hazard Area, which may result
from your project. Such precautions may include maintaining adequate work area
between the tidal wetland jurisdictional boundary and the coastal erosion hazard area
and your project or erecting a temporary fence, barrier, or hay bale berm.
This determination is not a determination from any other agency.

Dear Mr.Domino:
We represent Laura McGrath and Richard George,who plan to construct additions and alterations to an
existing single family dwelling and relocate and upgrade the sanitary system on the captioned property,
all as depicted on the site plan prepared by Kenneth M.Woychuk Land Surveying,PLLC, last dated
August 22,2018,two(2)copies of which are enclosed herewith.
With the exception of the pumping and filling of the existing sanitary system components necessary to
abandon and relocate the existing sanitary system, all proposed construction and construction-related site
disturbance will occur more than 100 feet from the tidal wetlands boundary located to the east of the
property and thus outside Trustee jurisdiction pursuant to Section §275-3(C)(5) of the Town Code. And
although part of the existing septic system is located less than 100 feet from wetlands and thus partially
within Trustee jurisdiction, "the relocation of an existing septic system from within Trustee jurisdiction to
outside of Trustee jurisdiction"is an activity exempt from requiring a wetland permit pursuant to Section
§275-4(A)(1)(k).
Therefore, I am writing to request that you kindly prepare a Letter of Non-Jurisdiction stating that no
Town Wetlands Permit shall be required for the proposed additions and alterations or the relocation of the
existing sanitary system pursuant to Sections §275-3(C)(5) and §275-4(A)(1)(k) of the Town Code,
respectively.
In support of our request, enclosed with the two copies of the site plan are recent site photographs; a
check payable to the Town of Southold for $50; and authorization forms signed by the property owner
allowing En-Consultants to act as their agent and the Trustees to access the subject property.
