Present were: Peter Young, Chairman John Stein, Member Peter Meeker, Member James Abbott, Member James Dinizio, Town Board Liaison Lauren Standish, Committee Secretary Absent was: Caroline Burghardt, Member CALL TO ORDER The meeting was called to order at 4:30PM by Chairman Peter Young. PLEDGE OF ALLEGIANCE TOWN BOARD LIAISON REPORT Councilman Jim Dinizio met with Mark Terry to discuss the LWRP reviews. Mark is currently reviewing applications before all Boards, not just the Board of Trustees. He could use help with the inspections in an effort to expedite the reviews. Councilman Dinizio and Peter Young will meet with Mark in September and work out the details. Peter Meeker requested an update on the committee vacancies. Councilman Dinizio stated that there weren't enough votes to move forward. Peter Young suggested the vacancies be re-advertised. 2 CHAIRMAN'S ANNOUNCEMENTS Chairman Peter Young attended the Annual Town Board Meeting on Fishers Island on Wed., August 8th and conducted field inspections with the Board of Trustees. He had an opportunity to discuss moorings and the phragmite remediation project with the Board. The Trustees are considering limiting the amount of public hearings each month due to the increased volume of application and SEQRA reviews. Chairman Young distributed copies of a Tidal Wetland Guide to the members, which includes techniques for shoreline erosion mitigation. REPORTS Peter Meeker attended the Board of Trustees meeting held on Wed., July 18, 2018. The new SEQRA requirements could delay the application reviews by two months. OLD BUSINESS 2019 budget requests are due by August 15th. John Stein will provide cost estimates and back-up for the LI Sound Shore Study. Peter Young suggested increasing the Meetings & Seminars to $1,000. Peter Young will revisit the issue of recommended code changes with Supervisor Russell and draft a letter to Mark Terry and Councilman Dinizio. APPROVAL OF MINUTES Moved by John Stein, seconded by James Abbott, to Approve the Minutes of July 11, 2018. DISCUSSION AND RECOMMENDATION OF WETLAND PERMIT & COASTAL EROSION PERMIT APPLICATIONS Moved by John Stein, seconded by James Abbott, it was RESOLVED to SUPPORT the application of STEPHEN & CHARLOTTE WAGNER to install approx. 69 If of 1.5' to 2.5' dia. 300-1,500 stone rip-rap on filter cloth along toe of eroding embankment; remove existing damaged steps to water and construct new 5'X 5' wood landing and 4'X 6' steps; and establish a 5' wide non-turf buffer in place of existing lawn adjacent to top of bank/landward edge of proposed rip-rap, to be planted with Cape American beach grass. Located: 20 Harbor River Rd., Orient. SCTM#24-1-11 Inspected by: James Abbott, John Stein Vote of Council: Ayes: All Motion Carried Moved by James Abbott, seconded by John Stein, it was 4 - 3 RESOLVED to SUPPORT the application of ISLE OF CEDARS LLC to construct an entry addition to the front of the existing dwelling, two bedroom additions, replace and reduce size of deck, install new cesspools and drywells, and new screened porch addition. Located: 2450 Peter's Neck Road, Orient. SCTM#32-1-8 Inspected by: James Abbott, John Stein Vote of Council: Ayes: All Motion Carried Moved by John Stein, seconded by James Abbott, it was RESOLVED to SUPPORT the application of KUPARI, LLC to install a 4.5'X 65' wide timber staircase on existing bluff on subject property. Proposed stair case to be supported by fourteen (14) 6" dia. X 12' deep timber piles. Located: 4115 Rocky Point Road, East Marion. SCTM#21-1-30.3 Inspected by: John Stein, James Abbott The CAC Supports the application with retractable stairs at the base of the bluff and consideration for a natural approach for beach access. Vote of Council: Ayes: All Motion Carried Moved by James Abbott, seconded by John Stein, it was RESOLVED to SUPPORT the application of TIMOTHY J. HILL & NANCY LEE HILL to construct 12'X 40.3' addition, legalize an existing 25.4'X 12.3' deck, construct an 182 sf. at-grade patio and steps leading from deck to patio. Located: 360 Oak Ave., Southold. SCTM#77-2-2 Inspected by: James Abbott, John Stein Vote of Council: Ayes: All Motion Carried Moved by John Stein, seconded by James Abbott, it was RESOLVED to SUPPORT the application of SOLUTION EAST, LLC to construct a 4'X 6' inclined ramp leading up to a 4'X 44' fixed timber catwalk (constructed with open-grate decking and elevated a minimum of 4' above tidal marsh) with 4'X 6' stairs to grade at its seaward end. Located: 900 Goose Creek Lane, Southold. SCTM#78-8-2 Inspected by: James Abbott, John Stein, Peter Meeker The CAC Supports the application with retractable stairs and handrails. The proposed structure was not staked and it was difficult to determine if it was in compliance with the 1/3 rule. 4 Vote of Council: Ayes: All Motion Carried Moved by Peter Meeker, seconded by James Abbott, it was RESOLVED to SUPPORT the application of JUSTIN & ELIZABETH MIRRO to demolish the existing one-story frame dwelling, decks, and detached garage, and abandon the existing sanitary system. Construct new two-story frame dwelling with flood compliant crawl space and four-car garage, approx. 6,700 sf. with footprint of 4,191 sf. with three attached covered porches, open decks and exterior stairs attached to the residence. Construct one-story non-habitable pool house with covered porch, stone terrace at grade, wood stairs and deck between pool house and bulkhead, reconstruct wood stairs from top of bulkhead to beach in new location, 4' high pool enclosure fence, raise height of existing timber retaining wall approx. 12", construct timber retaining wall at south edge of property, provide clean fill contoured per site plan, provide new topsoil and landscaping, maintain existing non-turf buffer between bulkhead and retaining wall, provide new gravel driveway, provide new sanitary system, and provide leaders/gutters connected to new drywells to contain roof/stormwater runoff. Located: 2455 Nassau Point Rd., Cutchogue. SCTM#104-13-6 Inspected by: Peter Meeker, Peter Young The CAC Supports the application with retractable stairs at the base of the beach access stairs and encourages the applicant consider the installation of an upgraded onsite wastewater treatment system. Vote of Council: Ayes: All Motion Carried Moved by John Stein, seconded by Peter Meeker, it was RESOLVED to NOT SUPPORT the application of VANSTON BEAR, LLC to remove and replace (in-place) approx. 1,032 If. of existing timber bulkhead forming boat basin and channel jetties with vinyl bulkhead; dredge with ten years maintenance an approx. 7,800 area of channel/mouth of basin to a maximum depth of 4' below mean low water; place approx. 500 cy. of approx. 1,400 cy. resultant sand spoil as backfill around replacement bulkheading, palce approx. 600 cy. spoil in designated +/-9,100 sf. on-site disposal area above spring high water to south of channel, and place approx. 300 cy. of spoil in designated +/-5,800 sf. spoil site on beach above spring high water on two adjoining properties to north, including unopened "West Bay Road" and SCTM#1000-111-10-12 (Harbor Cove Property Owners Assoc.); and remove and replace (in-place) 3.5'X 36' and 5'X 81' fixed timber docks located inside boat basin during bulkhead replacement. Located: 5250 Vanston Rd., Cutchogue. SCTM#111-10-14 Inspected by: Peter Meeker, John Stein 5 The CAC does Not Support the application and recommends that both groins are cut back, at least by half, to open up and allow for the proper flushing of the boat basin. The engineering plan is flawed and there will be a need for constant dredging unless the groins are cut back. TEICHER to replace existing staircase and landing, remove existing brick patio and replace with lawn, existing deck off house with as-built addition, and existing as-built lower decks, boardwalks and storage bins. Construct masonry pad to accommodate the placement of refuse containers at ground level and proposed grade level stepping stone path and masonry pad. Located: 6825 Nassau Point Rd., Cutchogue. SCTM#119-1-1 Inspected by: Peter Young, Peter Meeker Vote of Council: Ayes: All Motion Carried Moved by Peter Meeker, seconded by Peter Young, it was RESOLVED to SUPPORT the application of 1663 BRIDGE, LLC C/O DONALD BRENNAN to raise the existing boat shed to allow removal of the 125'X 13.5' existing deck, 125' existing bulkhead, existing and west returns completely. Construct a new 125' bulkhead with a 13' east return and 12' west return in-place raising the top elevation of bulkhead +6". Construct a new 125'X 13.5' wood deck, in-place. Reset existing boat shed in-place at new elevation providing new supports below as needed. Modify and replace rear ramp to boat shed. Install two new 8" mooring pilings. Located: 1663 Bridge Lane, Cutchogue. SCTM#118-2-4.2 Inspected by: Peter Young, Peter Meeker The CAC Supports the application with the Condition no animals are kept in the cage. Vote of Council: Ayes: All 6 Motion Carried FREDERICK LIGUORI to complete the construction of a second-story deck located partially within Ch. 275 jurisdiction, which replaces a previously existing, storm-damaged deck attached to an existing two-story frame building (apartment over garage) that pre- dates 1977; and legalize an existing 8'X 12' shed with attached 4'X 4' access ramp, 3'X 6' storage box, and two sets of steps off existing retaining wall, which was reconstructed after Hurricane Sandy pursuant to Wetlands Permit#8297. Located: 5600 Great Peconic Bay Blvd., Laurel. SCTM#128-2-11 The CAC did not make an inspection, therefore no recommendation was made. RECOMMENDATIONS — APPLICATIONS TO AMEND WETLAND PERMITS AND COASTAL EROSION PERMITS Moved by Peter Meeker, seconded by Peter Young, it was RESOLVED to SUPPORT the application of KATHY HALBREICH to Amend Wetland Permit#9024 to conform to the NYSDEC permit requirements. Remove existing 5.5'X 6' wood dock and two (2) 4"X 6" wood pilings. Construct 4'X 5'6" walkway to a 4'X12' fixed dock Weight (8) pilings. Walkway 22 sf. and fixed dock 48 sf. decking shall be thru-flow for both walkway and fixed dock 1' further seaward than previously approved. Located: 4955 Skunk Lane, Cutchogue. SCTM#138-2-3.6 Inspected by: Peter Young The CAC Supports the application using Thru-flow decking on the walkway. Vote of Counci: Ayes: All Motion Carried John Stein will attend the next regular meeting of the Board of Trustees scheduled for Wed., August 15, 2018 at 5:30PM. The next meeting of the Conservation Advisory Council will be held on Wed., September 12, 2018 at 4:30PM at Down's Farm Preserve.
