(E.D.S.T.), upon application of Barbara T. Starzee, 405 Youngs Avenue, Mattituck, New York, for a variance in accordance with the Zoning Ordinance, Article III, Section 100-35 for permission to erect fencing over 4 feet in height on road frontage. Location of property: N/S Youngs Avenue, Mattituck, bounded north by M~rk Road; east by R. Mazgulski; south by Youngs Avenue; west b y H. Fisher. Fee paid $15.00. 2. VARIANCE. By resolution of the Board it was determined that (a) Strict application of the Ordinance (would) (would not) produce practical hardship because SEE REVERSE di/ficulties or unnecessary (b) The hardship created (is) (is not) unique and (would) (would not) be shared by all properties alike in the immediate vicinity o/ this property and in the same use district because SEE REVERSE (c) The variance (do~s) (does not) observe the spirit of the Ordinance and (would) change the character of the district because SEE REVERSE (would not) and therefore, it was /urther determined that the requested variance ( ) be granted ( ) be d~nied and that the previous decisions of the Building Inspector ( ) be confirmed ( ) be reversed. 'ii. ZONING BOARD OF ~A_PPEA~S~ ,oRM w. , - . ' Marjdrie McDezmott, Secretary After investigation and inspection the Board finds that applicant requests permission to erect fence over 4 feet in height on road frontage. The property is located on the north side of Youngs Avenue, Mattituck. The findings of the Board are that applicant has a rear yard which faces on a street to the north of the property. Applicant is actually the owner of two lots and the rear yard will correspond with neighbors' rear yards to the east and west. The Board agrees with the reasoning of the applicant. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance will not change the character of the neighborhood, and will observe the spirit of the Ordinance. THEREFORE IT WAS RESOLVED, Barbara T. Starzee, 405 Youngs Avenue, Mattituck, be GRANTED p~rmission to erect fence over 4 feet in height on road frontage, as applied for. Location of property: north side of Youngs Avenue, Mattituck, New York. The height of the fence shall not exceed 6 feet.
