After investigation and inspection the Board finds that
applicant requests permission to set off lot and access with
insufficient length of road to give access to undersized lot
located on the southerly end of Sunset Drive, Mattituck. The
findings of the Board are that applicant wishes to transfer~
Lot ~25 on "Map of Sunset Knolls, Sec. II" to the Town of
Southold to provide a recharge area for the street water
and wishes to utilize the premises as shown on the survey by
Young & Young, dated March 27, 1974, as a building lot. The
Board agrees with the reasoning of the applicant.
The Board finds that strict application of the Ordinance
would produce practical difficulties or unnecessary hardship;
the hardship created is unique and would not be shared by all
properties alike in the immediate vicinity of this property
and in the same use district; and the variance will not
change the character of the neighborhood, and will observe
the spirit of the Ordinance.
THRREFIRE IT WAS RESOLVED, Stanley Sledjeski- 2760 Ruth Road,
Mattituck, New York, be GRANTED permission to set off lot and
access with insufficient length of road to give access to under-
sized lot located on the southerly end of Sunset Drive, Mattituck,
as applied for, subject to the following condition:
That in creating the new lot as described in the application
the applicant shall deed to the Town of $outhold, Lot 25.
(This becomes a mortgage transfer and a deed transfer).

1. STRICT APPLICATION OF THE ORDINANCE would produce practicaldifficultieeorunneces-
sary HARDSHIPbecouse during periods of rain the westerly part of Stanley
Road is flooded causing inconvenience and a hazard to the residents
of the area. The applicant is attempting to aid the Superintendent
of Highways in alleviating this problem by deeding to Southold Town,
for the sum of $1.00~ Lot ~25 on the "Map of Sunset Knolls, Sec. II,"
for a recharge area. In order to accomplish this, the present owner
of Lot ~25 has agreed to convey this lot to the applicant in exchange
for the premises as shown on Exhibit "A," providing it can be utilized
as a building lot. In essence, this is a land exchange for the pur-
pose of correcting a road drainage problem.

vicini~ ofthisproperty and in this use district because there is a severe drainage
problem on Stanley Road in front of Lot 425 on the "Map of Sunset
Knolls, Sec. !I~" and this lot will be utilized not as a building
lot, but as a recharge area for the street water.
3. The Variance would observe the spirit ofthe Ordinance and WOULD NOT CHANGE THE
CHARACTER OF THE DISTRICT because the premises as shown on Exhibit "A"
consist of 20,001 square feet, and Lot ~25 on the "Map of Sunset
Knolls, Sec. II," is 20,000 square feet. Since Lot 425 will be con-
veyed to the Town of Southold for drainage purposes, it will not be
utilized as a building lot so that there will be no increase in the
density in the area. The parcel on Exhibit "A" conforms to the
existing size and shape of the lots in Sunset Knolls, Sec. I and
Sec. II, which are to the North and East.
