A Special Meeting of the SOUTHOLD TOWN ZONING BOARD OF APPEALS was held at the Southold Town Hall Annex, Second Floor Conference Room, 54375 Main Road at Youngs Avenue, Southold on Thursday, August 16, 2018 commencing at 5:00 P.M. Present were: Leslie Kanes Weisman, Chairperson Eric Dantes, Member Nick Planamento, Member Patricia Acampora, Member Robert Lehnert, Member William Duffy, Town Attorney Kim Fuentes, Zoning Board Assistant Call to Order at 5:00 P.M. by Chairperson Weisman. 5:09 p.m. Motion was offered by Chairperson Weisman, seconded by Member Lehnert to enter into Executive Session for Attorney/Client advice. Vote of the Board: Ayes: All. This Resolution was duly adopted (5-0). EXECUTIVE SESSION: 1. Attorney/Client advice. 2. Litigation 3. Case Law Update Page 2—Minutes Special Meetmg held August 16, 2018 Southold Town Zoning Board of Appeals 6:34 p.m. Motion was offered by Member Weisman, seconded by Member Acampora to exit Executive Session. Vote of the Board: Ayes: All. This Resolution was duly adopted (5-0). WORK SESSION: a) Requests from Board Members for future agenda items. b) Training to be scheduled: SCHD—Advanced Septic System; Planning Dept. —SEQR; SC Soil & Water Conservation District—CEHA, Protection of Fisher Island Sound and Long Island Sound, Banks & Bluff. POSSIBLE RESOLUTION TO CLOSE THE FOLLOWING HEARINGS: PATRICIA C. BOOTH REVOCABLE TRUST 47183 —(Adjourn from August 2, 2018)Request for a Waiver of Merger petition under Article II, Section 280-10A, to immerge land identified as SCTM No. 1000-67-4-16 which has merged with SCTM No. 1000-67-4-9, based on the Building Inspector's April 11, 2018 Notice of Disapproval, which states that a non-conforming lot shall merge with an adjacent conforming or non-conforming lot held in common ownership with the first lot at any time after July 1, 1983 and that non-conforming lots shall merge until the total lot size conforms to the current bulk schedule requirements (minimum 40,000 sq. ft. in the R-40 Residential Zoning District); located, at 265 Burtis Place, Peconic, NY. SCTM Nos.1000-67-4-9 and 1000-67-4-16. BOARD RESOLUTION: Motion was offered by Chairperson Weisman, seconded by Member Planamento to Adjourn the matter to September 6, 2018. Vote of the Board: Ayes: Members Weisman, Dantes, Planamento, Acampora, and Lehnert This Resolution was duly adopted; (5-0). SIGURDSSON BALDUR, LLC,/WADE GUYTON, MGR. #7184 — (Adjourn from August 2, 2018) Request for Variances under Article 111, Section 280-15; Article XXII, Section 280-116A; and the Building Inspector's January 16, 2018, Amended February 27, 2018 and March 5, 2018 Notice of Disapproval based on an application to demolish an existing single family dwelling and construct a new single family dwelling and in-ground swimming pool; at: 1) proposed dwelling located less than the code required 100 feet from the top of the bluff, 2) proposed swimming pool located in other than the code required rear yard; located, at: 1800 Hyatt Road, (Adj. to Long Island Sound) Southold ,NY. SCTM#1000-50-1-4. BOARD RESOLUTION: Motion was offered by Chairperson Weisman, seconded by Member Planamento to Close the hearing. O'Neill, Trustee#7174 Brian Morrissey#7177 RELIEF DENIED, Partially Overturn the Notice of Disapproval Virginia Gilmour/Robert White (Jesse Dorfman CV) #7185 Vote of the Board: Ayes: Members Weisman (Chairperson), Acampora, Planamento, Dantes and Lehnert. This Resolution was duly adopted (5-0). RESOLUTIONS: A. RESOLUTION ADOPTED: Motion was offered by Chairperson Weisman, seconded by Member Planamento to authorize advertising of hearings for Regular Meeting to be held on September 6, 2018 which Regular Meeting will commence at 8:30 A.M., Town Meeting Hall, 53095 Main Road, Southold. Vote of the Board: Ayes: Members Weisman (Chairperson), Dantes, Acampora, Planamento and Lehnert. This Resolution was duly adopted (5-0). B. RESOLUTION ADOPTED: Motion was offered by Chairperson Weisman, seconded by Member Lehnert to approve minutes from August 2, 2018, Regular Meeting. Vote of the Board: Ayes: Members Weisman (Chairperson), Dantes, Acampora, Planamento and Lehnert. This Resolution was duly adopted (5-0).
