(E.D.S.T.) upon application of Paradise Aqua Farms, Inc. % Shelter Island Oyster Co., Sterling Avenue, Greenport, N. Y. for a variance in accordance with the Zoning Ordinance, Article III, Section 100-35 as applicable to Article VIII for permission to construct fencing in excess of four foot (front yard) height. Location of property: Right of way off N/S North Bayview Road, Southold, bounded on the north by Peconic (Southold) Bay; east by R. Kerester & Ors; south'by R. Kerester & Ors; west by Reydon Shores Sub. 2. VARIANCE. By resolution of the Board it was determined that (a) Strict appllcation of the Ordinance (would) (would not) produce practical hardship because difficulties or unnecessary SEE REVERSE (b) The hardship created (is) (/s not) unique and (would) (would not) be shared by all properties alike in the immediate vicinity of this property and in the same use district because SEE REVERSE (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) change the character of the district because (would not) SEE REVERSE and therefore, it was further determined that the requested variance ( ) be granted ( ) be denied and that the previous decisions of the Building Inspector ( ) be confirmed ( ) be reversed. SEE REVERSE FORM ZB4 Mar j ori~ Mc~,ermott ,· Secret~ry.~ After investigation and inspection the Board finds that applicant requests permission to construct fencing in excess of four foot front yard height. The purpose of this fencing is to prevent vandalism of their valuable aqua farming... seed oysters, clams, shellfish. The permitted front yard height of four feet is not sufficient to protect this property. The Board agrees with the reasoning of the applicant. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance will not change the character of the neighborhood, and will observe the spirit of the Ordinance. THEREFORE IT WAS RESOLVED, Paradise Aqua Farms be GRANTED permission to construct fencing in e~ess of four foot front yard height on property located: right of way off north side North Bayview Road, Southold, New York, as applied for. Vote of the Board: Ayes:- Messrs: Gillispie, Grigonis, Hulse.
