Y. SPECIAL EXCEPTION. By reso~tion of the Board R was determined th~ a ~ial exception ( ) be ~anted ( ) be deuled pursuant to Article .................... Section .................... Sub.etlon ....................paragraph .................... ~ the ~ning O~inance and the decision of the BuUdi~ Inspecinr ( ) be reversed ( ) be ~irmedbeca~e 9:10 P.M. (E.D.S.T.) upon application of Joseph Sawicki, North Road, Southold, New York, for a variance in accordance with the Zoning Ordinance, Article III, Section 100-30 and Bulk Schedule for permission to set off lot with insufficient width and area. Location of property: S/S North Road, Southold, bounded on the north by North (Middle Road); east by J. Sawicki; south by F. Sawicki; west by R.O.W., W. Sawicki and others. Fee paid $15.00. 2. VARIANCE. By resolution of the Board ~_t was determined that (a) Strict application of the Ordinance (would) (would not) produce practical hardship because SEE REVERSE difficulties or unnecessary (b) The hardship created (is) (is not) uulque and (would) (would not) be shared by all properties alike in the immediate viciul~ of this property and in the same use districZ because SEE REVERSE (c) The variance (does) (does not) observe the spirit of the Ordinance and (woUld) change the character of the district because (woUld not) SEE REVERSE and therefore, it was further determined that the requested variance ( ) be ~ranted ( that the previous decisions of the Bufldin~ Inspector ( ) be confirmed ( ) be reversed. Marjorie McDermott, Secretary ) be denied and After investigation and inspection the Board finds that applicant requests permission to set off lot with insufficient width and area on the south side of North Road, Southold, New York. The findings of the Board are that applicant has a potential hardship if the road, North Road, should be widened. Applicant has an existing dwelling on the easterly side of his building lot and an approved access road on the west. The lot under applica- tion will be compatible with other lots in the neighborhood. The Board agrees with the reasoning of the applicant. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be shared by all properties alike in the immediate vicinity of this property and in the same use district; and the variance will not change the character of the neighborhood, and will observe the spirit of the Ordinance. THEREFORE IT WAS RESOLVED, Joseph Sawicki, North Road, Southold, New York be GRANTED permission to set off lot which is approximately 105 feet in width and 150 feet in depth, bordered on the west by a 50 foot right of way to a minor subdivision, and which is located on the south side of North Road, Southold, as applied for, subject to applicant furnish- ing the Board of Appeals with a survey showing exact boundary determinations. Vote of the Board: Ayes:- Messrs: Gillispie, Grigonis, Hulse. STRICT APPLICATION OF THE ORDINANCE would produce practicaldifficulti~ orunneces- sary HARDSHIPbecau~: We have an existing dwelling on the easterly side of my building lot and an approved access road on the west so it i~ impossible to widen our road frontage. Proposed dwelling and lot would be for relatives. The lot will be of ample size to allow for future road widening of North Road. 2. The hardship created is UNIQUE and is not shared by all properties alike in the immediate vicinity of this property and in this use district because ; Our road frontage is limited by sales and dwellings built before the 150 ft width requirement. 3. The Variance would observe the spirit of the Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because: The proposed lot and dwelling will be for one family use in an "A" residential -agricultural district.
