Fee paid $15.00. 2. VARIANCE. The findings of the Board are that applicant does have a rear yard which could be used for locating an accessory building. The Board finds that strict application of the Ordinance would not produce practical difficulties or unnecessary hardship; the hardship created is unique and would be shared by all prop- erties alike in the immediate vicinity of this property and in the same use district; and the variance will change the character of the neighborhood, and will not observe the spirit of the Ordinance. THEREFORE IT WAS RESOLVED, James and Constance Pim, New Suffolk and Reeve Avenues, Mattituck, be DENIED permission to construct accessory building in legal front yard area, as applied for, for the reasons stated. The structure shall be removed from the front yard area within 90 days from August 22, 1974. Vote of the Board: Ayes:- Messrs: Gillispie, Bergen, Hulee, Grigonis. STRICT APPLICATION OF THE ORDINANCE would produce practicaldifficultiesorunneces- sary HAR~SHIPbecause the prescribed site for a t~¢i house is far moved from the large vegetable garden and backyard where the roto- til~er and garden too~s stored therein would be used. Zn addition it would be a practical difficulty and hardship in attempting the authentic restoration of an antique homesite to be forced hy the ordinance to p~ce an outbuilding in full vie~ of the attractive facade and main front door of the house~ Much time and expense has gone into making this fine old home an asset to the he~ighborhood and it would be regrettable if a variance did not allow the most aesthetic and practical site for the auxiliary building. 2. The hardship createdis UNIQUE and is not shared by all properties ali~ in the immediate vicini~ ofthis property and in this use district because the house was buiZt nearly one hundred years before New Suffolk Avenue was cut through about ninety feet behind it, creating a corner lot situation. The main front door, front yard: and interior layout of rooms are ~ideways to Reeve Avenue which was once a farm lane ~eading from Main Road to this old Reeve homestead. The uniquenes~ of age and placement on its lot have resulted in the historical and practical backyard being the portion of the lot between the house and New Suffold Avenue. There are no other homes in the area with a similar orient~ion. 3. The Variance would observe the spirit ofthe Ordinance and WOULD NOT CHANGE THE CHARACTER OF THE DISTRICT because it would encourage the attractive tasteful development of private property, the entire neighborhood has already benefited aesthetically from the re~tora¢ion of this old farmhouse which had fallen into disrepair and multiple The conStruction style and chosen location of this outbuilding are in keeping with the original layout of structures on this %ire. The new outbuilding is visible from only one neighbor, Laurence Reeve~ and even from there is screened by a mature spirea hedge and !~rge spruce trees~ It is m~ch better screened and !ess obvious to passers-by on the site requested by variance than in the area mandated by ordins~ce.
