SPECIA~ EXCEPTION. By resolution of the Board it was detemined that a special exception ( ) be granted ( ) be denied pursuant to Article .................... Section .................... (E.S.T;), upon application of George Bird, Lupton's Point Road, Mattituck, New York, for a special exception in accordance with the' Zonin9 Ordinance, Article III, Section 300, B-14, for permission to conduct an auction sale on property of J. H. Cassidy, Inc., east side Boisseau Avenue, Southold, bc. unded north by Peter Meyer, Jr.; east by Peter Meyez, or.; soutn by Long Island Railroad; west by Boisseau Avenue. Fee paid $15.00. 2. VARIANCE. By resolution of the Board it was determined that (a) Strict application of the Ordinance (would) (would not) produce hardship because practical difficulties SEE REVERSE (b) The hardship created (is) (is not) unique and (would) (would not) be shared by all properties alike in the immediate vicinity of this property and in the same use district because SEE REVERSE (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) change the character of the district because (would not) SEE REVERSE and therefore, it was further determined that the requested variance ( ) be granted ( ) be denied and that the previous decisions of the Building Inspector ( ) be confirmed ( ) be reversed. SEE REVERSE APPROVED _ . After investigation and inspection the Board finds that applicant requests permission to conduct an auction sale on property of J. H. Cassidy, Inc., east side Boisseau Avenue, Southold, on May 26, 1973. No rain date requested. The Board finds that the public convenience and welfare and justice will be served and the legally established or permitted use of neighborhood property and adjoining use districts will not be permanently or substantially injured and the spirit of the Ordinance will be observed. THEREFORE IT WAS RESOLVED George Bird, Lupton's Point Road, Mattituck, New York, be GRANTED permission to conduct an auction sale on property of J. H. Cassidy, Inc., east side of Boisseau Avenue, SQuthold, New York, on May 26, 1973, subject to conditions of Resolution of the Southold Town Board of Appeals dated June 15, 1973, as follows: Permission is for a one day auction sale to be held on a specific date, with a specific rain date if requested. Applicant must provide someone to supervise parking at the auction sale to prevent the blocking of neighbors' driveways. Vote of the Board: Grigonis.
