By resolution of the Board i_t was determined that (a) Strict application of the Ordinance (would) (would not) produce hardship because SEE REVERSE practical difficulties or (b) The hardship created (is) (is not) unique and (would) (would not) be shared by all properties alike in the immediate vicinity of this property and in the same use district because SEE REVERSE (c) The variance (does) (does not) observe the spirit of the Ordinance and (would) change the character of the district because REVERSE (would not) and therefore, it was further determined that the requested variance ( ) be granted ( ) be denied and that the previous decisions of the Building Inspector ( ) be confirmed ( ) be reversed. FORM ZB4 Se crc tary After investigation and inspection the Board find~ that applicant requests permission to divide property with insufficient area and frontage on premises located on the north side of Bailey Beach Road, Mattituck. The findings of the Board are that applicant wishes to create two parcels of approximately 37,000 sq. ft. in each lot. The applicant owns sufficient property contiguous to subJest property to create the required 40,000 sq. ft. in each lot. The Board finds that strict application of the Ordinance would produce practical difficulties or unnecessary hardship; the hardship created is unique and would not be sha~ed by all properties alike in the immediate vicinity of this property and in the same use district; and the variance will not change the character of the neighborhood, and will observe the spirit of the Ordinance. THEREFORE IT WA~RE$OLVED Dante ~. Catullo, 15 Rosstter Avenue, Yonkers, New York, be GRANTED permission to divide lots in such a way as to furnish at ~east 40,000 sq. ft. in each lot on property located on the .north side of Bailey Beach Roa~, Mattituck, New York, subject to the following conditions: 1. That applicant shall advise the Southold Town Board of Appeals as to whether he will furnish the ~0,000 sq. ft. by inclmding the westerly right of way or whether he will meet this requirement by extending the two proposed lots north to other property of the applicant which is contiguous to these lots. That applicant shall advise the Building Inspector as to the exact dimensions of these two lots within 60 days of today's date, March 29, 1973.
